R-2022- If7� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING CHANGE ORDER NO. 1 TO TASK AUTHORIZATION NO. 19-17D, APPROVED BY CITY COMMISSION OF THE CITY OF TAMARAC VIA RESOLUTION NUMBER R-2019-45 ON JUNE 12, 2019 AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE CHANGE ORDER #1 WITH ECKLER ENGINEERING, INC., TO PROVIDE PROFESSIONAL ENGINEERING SERVICES FOR ADDITIONAL CONSTRUCTION ADMINISTRATION ON THE TRACT 27 BOOSTER STATION UPGRADE PROJECT IN THE AMOUNT OF $7,580.00, IN ACCORDANCE WITH THE CITY'S CONSULTING ENGINEERING AGREEMENT AS AUTHORIZED BY RESOLUTION NO. R-2016-80, FOR AN AMOUNT NOT TO EXCEED $7,580.00; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ADMINISTER THE CONTRACT; AUTHORIZING ANY NECESSARY BUDGET TRANSFER OR APPROPRIATION FOR SAID PURPOSE TO BE INCLUDED IN A FUTURE BUDGET AMENDMENT PURSUANT TO F.S. 166.241(2) FOR THE PURPOSE OF RECEIVING A CREDIT IN THE AMOUNT OF $7,580.00 FROM C&I CONSTRUCTION AND DESIGN AND APPLYING IT TO THE COST FOR ADDITIONAL PROFESSIONAL ENGINEERING SERVICES TO BE PROVIDED BY ECKLER ENGINEERING, INC.; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FORAN EFFECTIVE DATE. WHEREAS, the Tract 27 Booster Station was constructed in 1986; and WHEREAS, the Tract 27 Booster Station assists in providing additional water pressure and chemicals to the distribution system and ensures that the communities to the extremities of the system receives adequate water flows and clean water; and WHEREAS, the existing generator and pumps are all original items and are now Temp. Reso. No. 13843 September 14, 2022 Page 2 of 5 past their useful life, and are presently out of compliance with current building codes including hurricane wind resistance are being replaced; and WHEREAS, via Resolution Number R-2019-45, dated June 12, 2019, the City Commission of the City of Tamarac approved Task Authorization Number 19-17D with Eckler Engineering, Inc. to provide design and bidding assistance along with professional engineering services during the construction, at a cost not to exceed $250,100.00, a copy of Resolution Number R-2019-45 is incorporated herein by reference and is on file in the City Clerk's Office; and WHEREAS, Task Authorization No. 19-17D is allowable pursuant to Florida Statute 287.055 under the City's Consulting Engineering Agreement since the construction cost is less than $2,000,000; and WHEREAS, the City Commission of the City of Tamarac approved and authorized award of Bid No. 21-01 B to C&I Construction and Design, via Resolution Number R-2021- 036, dated March 24, 2021, for construction and installation of a new standby generator, new service pumps and associated piping, improvements to the existing pump station building to comply with new building codes, new HVAC system for the updated pump station building and new primary power distribution system for the Tract 27 Booster Station; and WHEREAS, During the Shop Drawing review phase of the project, C&I Construction and Design submitted sixty-four (64) unique shop drawings. Of these, sixteen (16) failed to be in accordance with the specifications or design plans after the second submittal, Per Specification Section 01300, Article 1.01, B, the Contractor is responsible for compensation related to the additional time spent reviewing shop drawings, beyond the second submittal. No. 13843 September 14, 2022 Page 3of5 The previously approved credit in the amount of $7,580.00 from C&I Construction and Design, will be used to pay the Consultants, Eckler Engineering, Inc., for their added review time; and WHEREAS, it is the recommendation of the Acting Director of Public Services, and the Purchasing and Contracts Manager that Change Order#1 for Eckler Engineering, Inc., be approved by the City Commission and executed by the appropriate City Officials, a copy of Changer Order No. 1 is attached hereto as "Exhibit 1 "; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve Change Order No. 1 and authorize the appropriate City Officials to execute said Change Order with Eckler Engineering, Inc., to provide additional engineering services during construction of the Tract 27 Booster Station Upgrade Project for a total amount not to exceed $7,580.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and made a specific part hereof. SECTION 2: The City Commission approves Change Order #1 and authorizes the appropriate City Officials to execute Change Order #1 with Eckler Engineering, Inc., to provide engineering services during construction of the Tract 27 Temp. Reso. No. 13843 September 14, 2022 Page 4 of 5 Booster Station Upgrade Project, for an amount not to exceed $7,580.00, a copy of Change Order No. 1 is attached hereto as "Exhibit 1 ". SECTION 3: An expenditure not to exceed $7,580.00 is hereby approved and any necessary budget transfer or appropriation for said purpose is hereby approved and will be included in a future Budget Amendment pursuant to F.S. 166.241(2) forthe purpose of receiving a credit in the amount of $7,580.00 from C&I Construction and Design and applying it to the cost for additional professional engineering service to be provided by Eckler Engineering, Inc. SECTION 4: The City Manager, or his designee, is hereby authorized to approve and initiate change orders not to exceed $65,000 per Section 6-147 of the City Code, and close the contract award including, but not limited to, making final payment within the terms and conditions of the contract and within the contracted price. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
