CITY COMMISSION MEETING
WEDNESDAY, NOVEMBER 9, 2016
CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of
Tamarac to order at 7.27 p.m. on Wednesday, November 9, 2016 in City Commission
Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Harry Dressler, Vice Mayor Diane Glasser, Commissioner Pamela
Bushnell, Commissioner Michelle J. Gomez, and Commissioner Debra Placko were in
attendance.
Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Mayor Dressler led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS: There were no Proclamations or
Presentations scheduled for this meeting.
2. CITY COMMISSION REPORTS:
a. Commissioner Bushnell: Commissioner Bushnell talked about the past eight years that she
has been on the Tamarac Commission. Commissioner Bushnell thanked the residents who
elected her in 2008; city staff and employees; her colleagues on the dais who have supported
her and her friends and family. Commissioner Bushnell talked about how naively she
approached this election and expressed her dismay about how it involved claims of racism
and the irresponsible blogs that were posted. Commissioner Bushnell said she was grateful
for the opportunity to serve that she has been given. Commissioner Bushnell congratulated
Marlon Bolton on being elected to the Commission.
b. Commissioner Gomez: Commissioner Gomez said tonight is about two special
Commissioners who have served Tamarac honorably, Commissioner Bushnell and Vice
Mayor Glasser. Commissioner Gomez noted that both Commission members will stay
involved in the City and thanked them for their service.
c. Vice Mayor Glasser: Vice Mayor Glasser said she is officially letting people know that she
is retiring next week. Vice Mayor Glasser stated that she and Commissioner Bushnell started
together in 2008 and they are leaving in 2016 together. Vice Mayor Glasser said this has
been a marvelous experience and she is leaving Tamarac in good hands with a good
Commission and good staff. Vice Mayor Glasser wished everyone a fond farewell and
thanked everyone for their support over the last eight years.
d. Commissioner Placko: Commissioner Placko said to Commissioner Bushnell and Vice
Mayor Glasser that she will continue to see them outside the doors of City Hall.
Commissioner Placko said several months ago she talked about children going hungry in
Tamarac and that we needed to do something to make sure they do not go hungry. At that
time we were able to collect non-perishable food to help people feed their families. Now the

holiday season is upon us and we are making baskets for Thanksgiving and Christmas.
Commissioner Placko said she called six residents in her community and said this is
something they need to do and in less than a week these residents showed up with mounds
of food. She and Commissioner Bushnell got together with the six individuals and put
together sixteen holiday baskets. Commissioner Placko said they will continue to collect more
baskets the week of November 14th and people can drop them off in the City Clerk's Office.
e. Mayor Dressler: Mayor Dressler talked about transition in politics and that people should
run for the welfare of our City. Mayor Dressler said it has been an honor to serve with
Commissioner Bushnell and an honor to have served with Vice Mayor Glasser. Mayor
Dressler said he has learned a lot from them and noted that they have both given their hearts
and souls and have served the City with distinction and positive energy. Mayor Dressler said
he cannot think of anyone who was more involved in the events of Tamarac than
Commissioner Bushnell. Commissioner Bushnell should be proud as we will not forget her
contributions and wished her well. Mayor Dressler said this has been a team effort to help
everyone in this City with no distinctions between people as we are a diverse community.
Mayor Dressler reminded everyone that you don't need a fancy title to serve your community.
Mayor Dressler said he hopes that the new Commissioners think similarly because when we
talk non -partisan we mean it. Vice Mayor Glasser has been one of those people who care
about her community. Mayor Dressler said he hopes to see Vice Mayor Glasser, Mona and
Percy on Tuesday mornings at Kings Point. Mayor Dressler said this Commission will go
through a transition just like we have in the past. Mayor Dressler recognized Commissioner
Elect Bolton and Commissioner Elect Fishman and welcomed them to the team and said we
work best when we work together as a team. Mayor Dressler said he hopes all the emotions
and issues of the campaign can be put aside and we can look forward to the swearing in of
both of the new Commissioners.
3. CITY ATTORNEY REPORT: City Attorney Goren said as the Commission knows in 2008
the County Charter Review Commission adopted several different ballot questions one of
which was related to the establishment of the County Ethics Code. There was a ballot
question that created the Ethics Commission for Broward County, the purpose of which was
to create a code for the County which it never had in the past. It was adopted by voters in
2010 after two years of arduous review and public comment and other input from the
community. The Ethics Commission created an Ethics Code for the Board of County
Commissioners. In 2010 the County Commission placed items on the ballot one of which
was to impose on cities and city elected officials that same Ethics Code that was applicable
to the County Commissioners. The Broward League of Cities then took on the task to review
the Ethics Code to find ways to improve it, make it better and make it more visible and
transparent. City Attorney Goren said he had the pleasure and honor of serving as Counsel
for the Broward League of Cities and with two Commissioners sitting on the dais this evening,
both of whom are leaving the dais this evening. Both Commissioner Bushnell and Vice Mayor
Glasser were dramatically involved with the Ethics Code revisions and were assigned by the
then President at that time to work with the Ethics Task Force. It was an arduous task for
several years working professional staff from his office, the County Commission staff and the
County Commissioners to review and offer suggestions/comments which resulted in a
revised Code that was adopted this past December. City Attorney Goren thanked
Commissioner Bushnell and Vice Mayor Glasser for their investment of time, personal
commitment as well as their personal knowledge and skill set in working towards that end.
City Attorney Goren thanked Commissioner Bushnell and Vice Mayor Glasser and said the

City thanks both of you as well because much of what you did was not intended to benefit just
the City of Tamarac. It was intended to benefit all the cities in Broward County. City Attorney
Goren talked about attending the many meetings with Commissioner Bushnell and Vice
Mayor Glasser throughout Broward County. City Attorney Goren said that it was his honor to
serve with both Commissioner Bushnell and Vice Mayor Glasser as your City Attorney for the
last eight years. City Attorney Goren said this City has seen some tumultuous times. Times
that were not otherwise defined by code books or by case decisions or by some kind of
scripted behavior that a lawyer can pick up off of a shelf and figure out what to do. There
were no answers to many of the questions that were imposed upon the City Commission and
for that he thanked Vice Mayor Glasser and Commissioner Bushnell for their investment in all
the things that went into finding the way to fill seats, including that of the Mayor.
Commissioner Bushnell served in that capacity for that express purpose during a very difficult
and strenuous time for everyone. City Attorney Goren again thanked Vice Mayor Glasser
and Commissioner Bushnell. This is an instance that the public should know about your
selfless investment of time to help the citizens of our City and this community.
City Attorney Goren said on the dais is a conflict waiver which has been done in the past.
The City Attorney's Office received a request for a conflict waiver from Weiss Serota Helfman
Cole & Bierman (WHS). WHS represents the City in various matters including the red light
camera appeal and the Resource Recovery Board litigation. Attorney Edward Guedes, a
member of WHS, has been retained to represent a private client in a lien foreclosure for less
than $500. If the Commission has no objection to waive the conflict for Mr. Guedes to perform
both functions City Attorney Goren said he will need a motion and second for permission to
grant the waiver. Commissioner Gomez seconded by Commissioner Placko moved to grant
the conflict waiver. Motion passed unanimously (5-0).
City Attorney Goren said the Zaveco Woodmont lawsuit is set for trial next week and
members of the City's staff have been subpoenaed to appear. City Attorney Goren said, for
the record, Tamarac is not a party to the lawsuit between Zaveco and Woodmont. City staff is
being subpoenaed because of their role as professional staff members of the City.
4. CITY MANAGER, REPORT: City Manager Cernech announced that the IT Department has
achieved 1st Place ranking in the 2016 Digital Cities Award. This award is based on cities with
a population of up to 75,000 and is a remarkable achievement as we competed with cities
such as Williamsburg, VA; Palo Alto, CA; Ithaca, NY and Carson City, NV. The award will be
presented at the National League of Cities Conference in Pittsburgh, PA.
City Manager Cernech said that we are now in the process of accepting applications for
Tamarac University. It is an 8 week program which will start on March 14t" and will focus on
the role of Local Government and Public Service. Applications are located at the back of the
Commission Chambers and online at www.Tamarac.org. The only requirement is that
individuals have to be a resident or business owner in Tamarac. Applications are due by
Friday, January 27, 2017.
Upcoming Events: The Veterans Day Ceremony will take place on Friday, November 11,
2016 at 10-30 a.m. at Veterans Park; the 36t"Annual Turkey Trot will take place beginning at
City Hall on Thursday, November 24t" at 7:30 a.m. Early registration ends November 13t" -
$25; late registration November 14t" to November 23d - $30 and race day $50. Veterans can
take $10 off the registration fee by mail in or in person registration only and must show proof.

You can also register on line at www.ACTIVE.COM- the Holiday Lighting Festival will take
place on Wednesday, December 7th at 6:00 p.m. at the Community Center; the Rudolph's
Winter Wonderland event will take place on Friday, December 9, 2016 from 6:00 p.m. to 8.00
p.m. at Tamarac Park located at 7501 N. University Drive.
City Manager Cernech reported that the conceptual plans and Step 1 of 2 of the design/build
RFP for +/- 10,000 square foot Fire Station 36, 7200 N. University Drive, is underway. The
Project is expected to be awarded in the Summer of 2017 and completed in the Fall of 2018.
City Manager Cernech said he wished to thank Vice Mayor Glasser for her services and
friendship over the last 8 years. City Manager Cernech said unfortunately we were not
prepared for a farewell for Commissioner Bushnell. However, there are some flowers on the
dais for you. City Manager Cernech said that Commissioner Bushnell served the City very
well during difficult times. You gave us 8 years of your life and you have accomplished quite a
bit. City Manager Cernech noted that it takes courage to run for office and that he appreciates
what Commissioner Bushnell has done for District 1. In those eight years you had a vision
about projects and as a result we now have three great neighborhoods in District 1. City
Manager Cernech wished Commissioner Bushnell the best moving forward.
5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following
individuals spoke: Pastor Patrick Jackson, 8517 NW 61st St. introduced himself to the
Commission and indicated that he would be opening a church in Tamarac and is looking
forward to working with the City. Dominic Gray, 7845 NW 78th Ave., advised the Commission
that the Woodmont Community Association will be donating baskets for Thanksgiving and will
also make some additional contributions for the holidays. With no one else wishing to speak,
Mayor Dressler closed Public Participation.
6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any
changes/additions to the Consent Agenda and City Manager Cernech said Item 6 (k) -
TR12879 - Election of a Vice Mayor has been amended to reflect the election of Debra
Placko as Vice Mayor with her term beginning on November 15, 2016 through November
2017. City Attorney Goren read TR12879 by title into the record. City Manager Cernech said
Item No. 10 (a) on Ordinance(s) — Second Reading has been revised based on Monday's
discussions. Specifically, Section 9-130(c)(2)(b) & (c) (page 5) were revised to change the
measurement for the horticultural material and building materials from six (6) inches in
diameter and six (6) feet in height/length, to four (4) feet in diameter and height/length to be
consistent with the Waste Management Contract. In addition NO changes were made to
exclude TVs or electronics from bulk trash pickup since it was confirmed that these items are
currently being picked up as bulk. City Attorney Goren read T02345 by title into the record.
Commissioner Bushnell seconded by Commissioner Gomez moved approval of the Consent
Agenda with TR12879 - Election of a Vice Mayor - as amended. Motion passed unanimously
(5-0).
a. Approval of the October 26, 2016 Regular Commission Meeting Minutes - APPROVED
b. TR12880 - Interfund Loan from the Stormwater Fund: A Resolution of the City Commission
of the City of Tamarac, Florida authorizing a not to exceed $6,000,000 Interim Interfund Loan
to finance the costs of the acquisition, construction, reconstruction and equipping of a city -
owned golf clubhouse and cart barn and establishing its intent to reimburse such capital

expenditures incurred with proceeds of a long-term taxable financing to repay such Interim
Interfund Loan; providing certain other matters in connection therewith; and providing an
effective date.

c. TR12871 - RFP 16-28R - Caporella Aquatic Center Waterslide Replacement: A Resolution
of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City
Officials to award RFP 16-28R and execute an Agreement with Sammet Pools, Inc., for the
Caporella Aquatic Center Waterslide Replacement Project for an amount not to exceed
$270,000; a contingency amount of $15,000 will be added to the project account for a total
budget of $285,000; authorizing an expenditure of $270,000 plus contingency of $15,000;
authorizing the appropriation of $6,750; providing for severability; and providing an effective
date.

d. TR12874 - RFP 16-29R Caporella Aquatic Center Main Pool and Activity Pool
Renovations: A Resolution of the City Commission of the City of Tamarac, Florida,
authorizing the appropriate City Officials to Award RFP 16-29R and execute an Agreement
with Sammet Pools, Inc., for the Caporella Aquatic Center Main Pool and Activity Pool
Renovations Project for an amount not to exceed $84,355; a contingency amount of $4,145
will be added to the project account for a total project budget of $88,500; authorizing an
expenditure of $84,355 plus contingency of $4,145; providing for conflicts; providing for
severability; and providing for an effective date.

e. TR12855 - Amendment 2 - Jeff Ellis Management for Pool Management Services: A
Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate
City Officials to execute Agreement Amendment #2 between the City of Tamarac and Jeff
Ellis Management, LLC, exercising the option to renew the Agreement to provide Swimming
Pool Management Services for the Caporella Aquatic Center, at a cost of $319,376.90
annually, plus shared revenues, for a two-year period effective January 1, 2017-December
31, 2018; approving funding from the appropriate accounts; providing for conflicts; providing
for severability; and providing an effective date.

f. TR12876 - Public Art - Sunset Point Park: A Resolution of the City Commission of the City
of Tamarac, Florida, approving the Public Art proposal, concept and development of a design
criteria package by Margi Nothard of Glavovic Studio Inc., and the execution of an agreement
attached hereto as Exhibit "1" and incorporated herein; to provide a work of art to be placed
at Sunset Point Park, in Tamarac, in the amount of $77,900, attached hereto as Exhibit "A"
and incorporated herein; providing for conflicts; providing for severability; and providing an
effective date.

g. TR12841 - Award of Bid No. 16-21 B for the Citywide Buffer Wall Project Phase IIA: A
Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 16-21 B
to and approving an Agreement with MBR Construction, Inc. for the construction of Citywide
Buffer Wall Project Phase IIA, in accordance with Bid No. 16-21 B for a contract amount of
$325,350.72; a contingency in an amount of $32,535.07 will be added to the project account,

for a total project budget of $357,885.79; authorizing an expenditure from the appropriate
accounts, authorizing an appropriation of $12,135.79; providing for conflicts; providing for

h. TR12873 - Approve First Amendment to the ILA among Participating Cities for Household
Hazardous Waste Disposal Services: A Resolution of the City Commission of the City of
Tamarac, Florida, to approve the First Amendment to the Interlocal Agreement among the
Cities of Coconut Creek, Coral Springs, Fort Lauderdale, Pompano Beach, and Tamarac for
Household Hazardous Waste Disposal Services; authorizing City Officials to execute
Amendment Number 1 to said Interlocal Agreement; providing for conflicts; providing for
severability; and providing for an effective date.

i. TR12875 -Temporary Staffing Services: A Resolution of the City Commission of the City of
Tamarac, Florida authorizing the appropriate City Officials to select, approve and award the
acquisition of Temporary Staffing Services on an as needed basis to temporarily fill budgeted
employee vacancies for all City departments and provide for a method to staff temporary
positions as a result of unanticipated or temporary departmental workload increases in an
amount not to exceed an aggregate total of $150,000.00, utilizing agreements awarded by
the State of Florida Department of Management Services, the South Florida Governmental
Purchasing Cooperative or other formally competed agreements by other Florida
governmental units, or national purchasing cooperatives, and to establish a process for
acquiring specialized temporary staffing needs, as well as establishing quotation procedures
when there are no available firms with competitively bid agreements, in the best interest of
the City; providing for conflicts, providing for severability; and providing for an effective date.

j. TR12878 - Grant Award: Stormwater Culvert & Headwall Improvements: A Resolution of
the City Commission of the City of Tamarac, Florida accepting a grant award in the amount of
$400,000 from the Florida Department of Environmental Protection; authorizing the
appropriate city officials to execute a project agreement between the Florida Department of
Environmental Protection and the City of Tamarac for grant funding in the amount of
$400,000 for the Tamarac Stormwater Culvert and Headwall Improvement Project; providing
for acceptance of the award and execution of documents, providing for conflicts; providing for
severability; and providing for an effective date.

City Commission of the City of Tamarac, Florida Amending Chapter 9 of the City's Code of
Ordinances, entitled "Health, Sanitation and Nuisances" by recodifying Article IV, Sections 9-
130 through 9-135 as Chapter 17, Article IV, to be entitled "Local Housing Assistance
Program"; creating a new Chapter 9, Article IV to be entitled "Residential and Nonresidential
Property Maintenance Standards, creating a new Section 9-130 entitled "Residential Property
Maintenance Standards"; creating a new Section 9-131 entitled Nonresidential Property
Maintenance Standards"; providing for definitions; providing for maintenance standards; and

moved approval of T02345 on Second Reading. Mayor Dressler said the Chair recognizes
the amendments to the Ordinance. Commissioner Gomez talked about people being evicted
and having their possessions put out in the street and asked if there was some way that this
could be regulated. Mayor Dressler said this is something that could be looked into by staff
and discussed at a future workshop. City Manager Cernech said when someone is evicted
and their belongings are put out on the street it is not a bulk pickup issue. Mayor Dressler
opened the Public Hearing and with no one wishing to speak, closed the Public Hearing.

b. T02351 - Amendment to the Westpoint Development of Regional Impact (DRI): An
Ordinance of the City Commission of the City of Tamarac, Florida, amending the
Development Order for the Westpoint Development of Regional Impact (DRI) generally
located in Section 7, Township 49 South, Range 41 East and approved by Ordinance No. 0-
89-44 adopted December 21, 1989, and thereafter amended by Ordinance No. 0-94-20
adopted November 9, 1994, and thereafter amended by Resolution No. R-2000-206 adopted
July 12, 2000, and thereafter amended by Ordinance No. 0-2000-33 adopted November 22,
2000, and thereafter amended by Ordinance No. 0-2004-14 adopted April 28, 2004, and
thereafter amended by Ordinance No. 0-2004-42 adopted December 22, 2004, reducing the
amount of approved commercial and office uses for the DRI; providing for recordation in

T02351 on Second Reading. Mayor Dressler opened the Public Hearing and the following
individual spoke: Brian Beckner, 10001 W. Commercial Blvd., Executive Pastor of the
Community Christian Church, asked for the second reading to be deferred as he was waiting
to get a copy of the Master Plan from Community Development and needed assurances that
the Church would be allowed to further develop the church property. Attorney Dennis
O'Shea, representing the requestor of the Amendment to the Westpoint Development of
Regional Impact (DRI), appeared. City Attorney Goren and Community Development Director

Calloway responded to Pastor Beckner's questions and concerns. With no one else wishing
to speak Mayor Dressler closed the Public Hearing. Motion passed unanimously (5-0).

c. T02352 - 2nd Budget Amendment: An Ordinance of the City Commission of the City of
Tamarac, Florida, amending ordinance 2016-05, which amended the City of Tamarac
Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial
Policies for the Fiscal Year 2016, by increasing the total revenues and expenditures by a total
of $2,306,745 as detailed in Exhibit "A" attached hereto; providing for conflicts; providing for
severability; providing for an effective date. City Attorney Goren read T02352 by title into the
record. Commissioner Placko seconded by Commissioner Gomez moved approval of
T02352 on Second Reading. Mayor Dressler opened the Public Hearing and with no one

11. QUASI-JUDICIAL HEARING(S):
a. TR12881 - Woodmont Country Club Phase 1 Clubhouse - Major Revised Site Plan: A
Resolution of the City Commission of the City of Tamarac, Florida, granting Major Revised
Site Plan approval (with conditions) to allow for the approval of Phase I of the Woodmont
Country Club Master Development Plan to allow for the development of a new 15,031 square
foot clubhouse with an ancillary 7,202 square foot cart barn with associated parking and pool;
for the subject property located at 7801 NW 80 Avenue, Tamarac, Florida (Parcel A of the
Woodmont Recreation Complex, according to the Plat thereof, as recorded in Plat Book 91,
Page 49, public records of Broward County, Florida) (Case No. 33-sp-14); providing for

announced that this item will be deferred to the December 14, 2016 Commission Meeting.
City Attorney Goren read TR12881 by title into the record. Commissioner Placko seconded
by Commissioner Bushnell moved to defer TR12881 to the December 14, 2016 Commission
Meeting. Motion passed unanimously (5-0).
ITEM DEFERRED TO THE DECEMER 14, 2016 COMMISSION MEETING
12. OTHER:
a. TR12862 - Declaration of the Westpoint Development of Regional Impact (DRI) as
Essentially Built Out A Resolution of the City Commission of the City of Tamarac, Florida,
determining that the Westpoint Development of Regional Impact is essentially built -out as
provided in Section 380.06(15)(g)3., Florida Statutes, providing for conflict; providing for
severability; and providing an effective date.
Mayor Dressler recognized State Senator Elect Perry Thurston. State Senator Elect Thurston
