R-2018 /! 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING CHANGE ORDER NUMBER 1 TO THE AGREEMENT WITH CC CONTROL CORPORATION UTILIZING PRICING FROM AN AGREEMENT OBTAINED THROUGH A FORMAL COMPETETIVE PROCESS BY THE CITY OF OAKLAND PARK, RFP NO. 022414 FOR THE LIFT STATIONS / WELLS SCADA IMPROVEMENTS PROJECT, FOR ADDITIONAL ITEMS OUTSIDE THE SCOPE OF THE PIGGY -BACK CONTRACT, IDENTIFIED DURING CONSTRUCTION, AT A COST NOT TO EXCEED $68,402.00; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE CHANGE ORDER NUMBER 1; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac owns, operates and maintains the water supply, treatment, and distribution systems along with the Wastewater Pump Stations; and WHEREAS, on March 22, 2017, the City Commission approved the award of a contract to CC Control Corporation utilizing pricing from an agreement obtained through a formal competitive process by the City of Oakland Park, RFP No. 022414 for the Lift Stations / Wells SCADA Improvements Project through Resolution No. R- 2017-22, a copy of said Resolution is incorporated herein by reference and on file in the office of the City Clerk; and Temp. Reso. #13167 September 12, 2018 Page 2 of 5 WHEREAS, at that time, the Director of Public Services chose to utilize available contracts awarded by other governmental entities for the Lift Stations / Wells SCADA Improvements Project, as provided by City Code Section 6-148 (d), which states that the purchasing officer may utilize contracts with other governmental agencies; and WHEREAS, during preparation of the SCADA Improvement Project, it was determined there were four (4) specific locations within the Water Treatment Plant site that were also utilizing the existing outdated Modicon PLC system components that were being replaced by the proposed SCADA improvements throughout the City of Tamarac Utility System; and WHEREAS, in order to provide a complete updated SCADA System, it is recommended that the Modicon Quantum PLC be removed and replaced with the new Allen-Bradley equipment being provided by the Lift Stations / Wells SCADA Improvements Project; and WHEREAS, CC Control Corporation has agreed to perform the additional work at a cost not to exceed $68,402.00 per the proposal, dated August 15, 2018, a copy of said proposal is hereto attached as "Exhibit 1 "; and WHEREAS, Public Services staff have reviewed said proposal and have determined that the pricing is competitive and acceptable; and WHEREAS, the cost of additional services attributed to this change order necessitates an additional expenditure in an amount not to exceed $68,402.00; and Temp. Reso. #13167 September 12, 2018 Page 3 of 5 WHEREAS, available funding exists in the project's contingency allowance (PO No. 200631) for said purpose, previously approved by City Commission via Resolution R-2017-22; and WHEREAS, Change Order Number 1 for additional items identified during the construction of the Lift Stations / Wells SCADA Improvements Project, in the amount not to exceed $68,402.00, is attached hereto as Exhibit 2; and WHEREAS, the Director of Public Services, the Director of Financial Services, and the Purchasing and Contracts Manager recommend the authorization of Change Order No. 1 to the contract for the Lift Stations / Wells SCADA Improvements Project in an amount not to exceed $68,402.00, and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve Change Order No. 1 to the contract for the Lift Stations / Wells SCADA Improvements Project and authorize an additional expenditure in an amount not to exceed $68,402.00 for said purpose. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. SECTION 2: The City Commission HEREBY approves Change Order No. 1 to the contract with CC Control Corporation, for the Lift Stations / Wells SCADA Improvements Project, to account for the costs of additional items that were not included in the piggy -back contract at a cost not to exceed $68,402.00, and authorizes the appropriate City Officials to accept and execute said Change Order in an amount not to exceed $68,402.00, a copy of Change Order No. 1 is hereto attached as "Exhibit 2". SECTION 3: An additional expenditure in an amount not to exceed $68,402.00 is HEREBY approved. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 1 Temp.
