No. 12093 September 28, 2011 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO, R-2011-jc20 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE REQUEST OF SIEGEL, LIPMAN, DUNAY, SHEPARD AND MISKEL, LLP ON BEHALF OF SPL HOLDINGS, LLC AND SPL SOUTH HOLDINGS, LLC TO AMEND THE NOTE ON THE SABAL PALM BY PRESTIGE PLAT AS RECORDED IN PLAT BOOK 178, PAGE 71 TO DECREASE DENSITY FROM 208 SINGLE FAMILY DETACHED UNITS AND 288 TOWNHOUSE UNITS (496 RESIDENTIAL UNITS) TO 434 SINGLE FAMILY UNITS (CASE NO. 1-P-11); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the plat for Sabal Palm by Prestige was approved by the City Commission on April 25, 2007 and recorded in the public records of Broward County in Plat Book 178, Page 71 on December 5, 2008 (attached hereto as Exhibit "1" incorporated herein and made a specific part thereof); and WHEREAS, infrastructure has been constructed on the property north of Commercial Boulevard known as Sabal Palm North but building permits have not been issued for residential dwelling units; and WHEREAS, the property within the Sabal Palm by Prestige plat was purchased by SPL Holdings, LLC and SPL South Holdings, LLC in May 2011 and the owner of the area known as Sabal Palm North wants to construct single family coach homes instead of townhomes; and Temp. Reso. No. 12093 September 28, 2011 Page 2 WHEREAS, a site plan has been submitted for review and approval which shows single family coach homes on the Sabal Palm North property; and WHEREAS, staff has reviewed this request and supports a decrease in density for the Sabal Palm by Prestige Plat; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Building Permit for the development that is the subject of the application; and WHEREAS, the Director of Community Development recommends approval of this Delegation Request; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the request of Siegel, Lipman, Dunay, Shepard and Miskel, LLP on behalf of SPL Holdings, LLC and SPL South Holdings, LLC to amend the note on the Sabal Palm by Prestige plat as recorded in Plat Book 178, Page 71 in an effort to decrease density from two - hundred, eight (208) single family detached units and two -hundred, eighty-eight (288) townhouse units (a total of 496 residential units) to a total of four hundred, thirty-four (434) single family units; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 u 1 n Temp. Reso, No. 12093 September 28, 2011 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: That the application to amend the note on the Sabal Palm by Prestige plat as recorded in Plat Book 178, Page 71 in an effort to decrease density from two -hundred, eight (208) single family detached units and two -hundred, eighty- eight (288) townhouse units (a total of 496 residential units) to a total of four hundred, thirty-four (434) single family units, is hereby approved. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution.
