R-2011- J� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING A REFUND OF $2,000.00 SUBMITTED BY SANDRA BRENNAN OF TIDAN PLAZA LIMITED, DESIGNATED AGENT FOR THE PROPERTY OWNER, TIDAN PLAZA LIMITED/JACK SOFER, FOR A SPECIAL EXCEPTION DEVELOPMENT APPLICATION FEE, COLLECTED FOR THE REBOUNDERZ FAMILY CENTER PROJECT (CASE NO. 20-MI- 11); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on August 8, 2011 Sandra Brennan, of Tidan Plaza Limited, Designated Agent for the property owner Tidan Plaza Limited/Jack Sofer, submitted a Special Exception development application to the Community Development Department with a check in the amount of $2,000.00 for the Rebounderz Family Center project; and WHEREAS, after the submittal of the Special Exception development application and after the submittal of the revised justification letter, (attached hereto as a part of Exhibit "'I", incorporated herein and made a specific part thereof) the Community Development Department staff later determined that this application was not needed for this project; and WHEREAS, the Community Development Department staff has determined that the Special Exception development application fee of $2,000.00 submitted by Sandra Brennan of Tidan Plaza Limited, Designated Agent for the property owner Tidan Plaza Limited/Jack Sofer, should be refunded since no staff time, research or resources were used to process this application; and Temp Reso #12079 August 31, 2011 Page 2 WHEREAS, the Director of Community Development recommends approval of the application fee refund; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize a refund in the amount of $2,000.00 submitted by Sandra Brennan of Tidan Plaza Limited, Designated Agent for the property owner Tidan Plaza Limited/Jack Safer, for the Special Exception development application fee, collected for the Rebounderz Family Center project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That the City Commission hereby authorizes the appropriate City Officials to refund the Special Exception development application fee for the Rebounderz Family Center project in the amount of $2,000.00 made payable to Tidan Plaza Limited 4060 Galt Ocean Drive, Fort Lauderdale, Florida 33308. SECTION 3: All resolutions or parts of resolutions in conflict herewith are 1 1 Temp Reso #12079 August 31, 2011 Page 3 hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. W. 57a' St., Tamarac, FI 33319, will only occupy 17,500 square feet of the premises as opposed to the originally stated 18,000 — 20,000 sq ft. This gymnasium will not be providing any amusement games as previously stated therefore, we would.like to request a refund from the City due to the fact that we no longer require a Special Exception by right of usage.
