R-2005- dd, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, FORMALLY REQUESTING THAT BROWARD COUNTY REIMBURSE THE CITY OF TAMARAC THROUGH THE BROWARD COUNTY LAND PRESERVATION PROGRAM FOR THE PURCHASE OF THE SHATHER PARCEL (AKA WATER'S EDGE PARK) IN THE AMOUNT OF $1,555,000.00 PLUS ALLOWABLE ACQUISITION COSTS; DIRECTING THE CITY CLERK TO PROVIDE COPIES TO THE MEMBERS OF THE BROWARD COUNTY COMMISSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is committed to expanding the City's recreational open space in order to comply with the Broward County Land Use Plan as well as achieve public recreation land goals; and WHEREAS, the Broward County Land Preservation Bond Program was established to acquire open space and create recreation opportunities throughout the County; and WHEREAS, on March 24, 2004, the City Commission of the City of Tamarac via resolution R-2004-59 authorized staff to pre -acquire the Shather Parcel (AKA Water's Edge Park) and seek reimbursement through the Broward County Land Preservation Program; and Temp. Reso. #10614 January 10, 2005 Page 2 of 4 WHEREAS, the City of Tamarac acquired the Shather Parcel Water's Edge Park) from Alex Shather as Trustee of the University Busin Park Trust, on May 18, 2004 at a purchase price of $1,555,000.00 plus additional acquisition costs; and WHEREAS, the City of Tamarac has submitted an application to Broward County Land Preservation Program seeking reimbursement for purchase and acquisition costs of the Shather Parcel (AKA Water's Edge Park); and WHEREAS, said application was reviewed and approved by the Preservation Advisory Board and forwarded to the County Commission for consideration of the City's request for reimbursement; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to formally request that Broward County reimburse the City of Tamarac through the Broward County Land Preservation Program for costs associated with the purchase of the Shather Parcel (AKA Water's Edge Park) in the amount of $1,555,000.00 plus allowable acquisition costs. Reso. #10614 January 10, 2005 Page 3 of 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac hereby formally requests that Broward County reimburse the City of Tamarac through the Broward County Land Preservation Program for the purchase of the Shather Parcel (AKA Water's Edge Park) in the amount of $1,555,000.00 plus allowable acquisition costs. SECTION 3: The City Clerk is hereby directed to provide copies of this resolution to the members of the Broward County Commission. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
