R-2005- I I -1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE A DELEGATION REQUEST TO AMEND THE NOTE ON THE "WESTPOINT SECTION 7 PLAT" FROM THE CURRENT RESTRICTION OF "COMMERCIAL" TO "COMMERCIAL" AND "CHURCH" TO ACCOMMODATE THE FUTURE CONSTRUCTION OF THE COMMUNITY CHRISTIAN CHURCH ON THE SUBJECT PROPERTY, SPECIFICALLY TRACT "D" OF THE "WESTPOINT SECTION 7 PLAT", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 162, PAGE 23 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED AT THE NORTHEAST CORNER OF SAWGRASS EXPRESSWAY AND COMMERCIAL BOULEVARD, EXTENDING WEST TO NOB HILL ROAD AND NORTH TO STATE STREET (CASE NO. 2-P-05); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has examined the application and staff recommendation dated February 17, 2005; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan for the development that is the subject of the application; and WHEREAS, the property owner desires to amend the note on the plat from the current restriction of "Commercial" to "Commercial" and "Church" to accommodate the future construction of the Community Christian Church on the subject property, specifically Temp Reso #10646 — February 17, 2005 Page 2 Tract "D" of he "Westpoint Section 7 Plat", according to the Plat thereof as recorded in Plat Book 162, Page 23 of the Public Records of Broward. County, Florida, located at the northeast corner of Sawgrass Expressway and Commercial Boulevard, extending west to Nob Hill Road and north to State Street (attached hereto as Attachment 1 "); and WHEREAS, the property owner is requesting approval of the Delegation Request to amend the current Plat note in order to accommodate the future construction of the Community Christian Church on the subject parcel (attached hereto as Attachment "2"); wire WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the Planning Board recommended approval on February 16, 2005; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this Delegation Request. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby approves the Delegation Request to amend the note on the "Westpoint Section 7 Plat" from the current restriction of 1 Temp Reso #10646 — February 17, 2005 Page 3 "Commercial" to "Commercial" and "Church" to accommodate future construction of the Community Christian Church on the subject property, specifically Tract "D" of the "Westpoint Section i Plat", according to the Plat thereof as recorded in Plat Book 162, Page 23 of the Public Records of Broward County, Florida, located at the northeast corner of Sawgrass Expressway and Commercial Boulevard, extending west to Nob Hill Road and north to State Street. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. Office use of 100,000 square feet is permitted on Tract C. Tract D is restricted to 200,,,000 square feet of commercial use. Commercial/retail uses are not permitted on Tracts A and B without the approval of Board of County Commissioners who shall review and address these uses for increased impacts."
