R-2005-131 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO REJECT ALL BIDS UNDER BID NO. 05-14B FOR THE FIRE STATION NO. 41 ROOF REPLACEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, bids were solicited for the purpose of securing a contractor to perform the replacement of the roof at Fire Station No. 41; and WHEREAS, a bid was received and opened on June 7, 2005 from one bidder, Murton Roofing Corporation, in the amount of $96,250.00; and WHEREAS, after review of the one bid submitted, it was determined that the bid price of $96,250.00 significantly exceeds the designated budget for this purpose; and WHEREAS, the Code of the City of Tamarac, section 6-149(5) allows the Purchasing Officer the authority, upon consultation with the affected department director(s), to recommend the rejection of all bids when the public interest will be served; and Temp Reso. #10750 June 13, 2005 Page 2 WHEREAS, it is the recommendation of the Director of Public Works and the Purchasing and Contracts Manager that all bids for the roof replacement of Fire Station No. 41 be rejected; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens of the City of Tamarac to reject all bids for the roof replacement of Fire Station No. 41. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City officials are HEREBY authorized to reject all bids under Bid No. 05-14B for the replacement of the roof at Fire Station No. 41. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or application, and to this end the provisions of this resolution are declared to be severable. 1 1 77 Temp Reso. #10750 June 13, 2005 Page 3 SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
