R-2005-171 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A PARKING WAIVER OF THIRTY-SIX (36) PARKING SPACES TO REDUCE THE NUMBER OF REQUIRED PARKING SPACES FROM TWO - HUNDRED TWENTY-FOUR (224) TO ONE - HUNDRED EIGHTY-EIGHT (188) PARKING SPACES FOR THE 7171 BUILDING, LOCATED AT 7171 NORTH UNIVERSITY DRIVE, SPECIFICALLY PARCEL "A" AND "B" OF THE "MELAUR MEDICAL PLAZA" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 146, PAGE 50 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO. 5-Z-05); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health and welfare of the citizens of the City; and WHEREAS, the 7171 Building desires to provide its medical office building with handicapped parking and its new tenant the placement of a hyperbaric chamber; and WHEREAS, adhering to the two -hundred twenty-four (224) parking spaces required by the City of Tamarac Code of Ordinances would not allow for the building to be used solely for medical office, ADA compliance, of the hyperbaric chamber needed for the new Temp Reso #10784 — September 7, 2005 Page 2 tenant; and WHEREAS, a hardship exists for the 7171 Building if the development is unable to provide medical office use, ADA compliance and placement of the new tenant hyperbaric chamber; and WHEREAS, the 7171 Building has filed an application for a Parking Waiver of thirty- six (36) required parking spaces to reduce the number of required parking spaces from two -hundred twenty-four (224) to one -hundred eighty-eight (188) parking spaces, in order to provide its medical offices with handicapped parking and its new tenant a hyperbaric chamber; and WHEREAS, the Planning Board held a public hearing on September 7, 2005, thereon and recommended approval of this application; and WHEREAS, the Director of Community Development has thoroughly reviewed and recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the parking waiver as requested in the application by the 7171 Building to reduce the number of required parking spaces from two -hundred twenty-four (224) to one -hundred (188) parking spaces in order for the 7171 Building to provide its medical offices with handicapped parking and its new tenant a hyperbaric chamber. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 C 1 Temp Reso #10784 — September 7, 2005 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the application by the 7171 Building requesting a parking waiver of thirty-six (36) spaces to reduce the number of required parking spaces from two - hundred twenty-four (224) to one -hundred eighty-eight (188) parking spaces, located at 7171 North University Drive, is HEREBY APPROVED, subject to the following condition: 1. The two (2) parking spaces being reduced for use by the hyperbaric chamber shall be voided upon the vacation of the premises by the tenant. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
