A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO APPROVE THE SALE OF
ALCOHOLIC BEVERAGES FOR SAINT
MALACHY CATHOLIC CHURCH DURING THE
OPERATION OF THE SAINT MALACHY
CATHOLIC CHURCH ANNUAL CARNIVAL
BEGINNING THURSDAY, OCTOBER 20, 2005
AND ENDING SUNDAY, OCTOBER 23, 2005
(CASE NO. 14-MI-05); PROVIDING FOR
CONDITIONS OF APPROVAL; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Saint Malachy Catholic Church is a non-profit organization which
annually conducts a carnival to benefit the Saint Malachy Catholic Church, Saint Malachy
Catholic School and other worthy causes; and
WHEREAS, the City of Tamarac received a request from Debbie Heuser of the 2005
Carnival Committee for the Saint Malachy Catholic Church (attached hereto as Exhibit "1 "),
requesting permission to sell/serve alcoholic beverages during the operation of the Saint
Malachy Catholic Church Annual Carnival beginning Thursday, October 20, 2005 and
ending Sunday, October 23, 2005; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to approve the sale of alcoholic beverages for Saint Malachy

Catholic Church during the operation of the Saint Malachy Catholic Church Annual Carnival
beginning Thursday, October 20, 2005 and ending Sunday, October 23, 2005.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission of the City of Tamarac HEREBY
APPROVES the sale of alcoholic beverages for Saint Malachy Catholic Church during the
operation of the Saint Malachy Catholic Church Annual Carnival beginning Thursday,
October 20, 2005 and ending Sunday, October 23, 2005 subject to the following
conditions:
1. That the selling of alcoholic beverages is subject to regulations of the State
of Florida Department of Regulations, Division of Alcoholic Beverages and
Tobacco.
2. That the sale of alcoholic beverages shall take place during the operation of
the Saint Malachy Catholic Church Annual Carnival event beginning
Thursday, October 20, 2005 through Sunday, October 23, 2005.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution

is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

Dear Mr. Miller,
We will be having our annual carnival at St. Malachy Catholic Church in October. The
dates and times will be:
Thursday, October 20t' 5:00 P.M. — 11:00 P.M.
Friday, October 2 1 " 5:00 p.m. — midnight
Saturday, October 22nd noon - midnight
Sunday, October 23`d 1:30 p.m. - 10:00 p.m.
As usual, this will take place on our parish grounds at 6200 N. University Dr. in Tamarac.
We have a new carnival company, Midwest Midways, who will be providing the rides.
We would like to request permission to sell/serve alcoholic beverages at this event. In
addition, we are requesting a waiver of license and/or permit fees as we have in the past.
