A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, REQUESTING A SUSPENSION OF THE
STATE GASOLINE TAX; DIRECTING CITY ADMINISTRATION
TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO
THE GOVERNOR, FLORIDA SENATE PRESIDENT, SPEAKER
OF THE FLORIDA HOUSE OF REPRESENTATIVES, THE CITY'S
STATE LEGISLATIVE REPRESENTATIVES, THE BROWARD
LEAGUE OF CITIES, THE FLORIDA LEAGUE OF CITIES AND
ANY OTHER INTERESTED PARTIES; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac ("City") is greatly
concerned about the recent increases in gasoline prices, and how the increase
in gasoline prices is affecting residents and businesses within the City, Broward
County, and the State of Florida; and
WHEREAS, according to the American Automobile Association's Daily
Fuel Gauge Report, the National Unleaded Average Price for a gallon of regular
gasoline has risen from $1.853 in September, 2004 to $2.7888 on September
20, 2005; and
WHEREAS, this significant increase in the price of gasoline results in
increased costs to residents, businesses, and consumers, and adversely impacts
the citizens and residents who were unable to budget for the sudden increase;
and
WHEREAS, the State of Florida has the authority to suspend the
collection of the State of Florida Gasoline Tax, and the City Commission
supports the suspension of the gasoline tax in order to provide consumers and
businesses with some relief from the increased costs; and
WHEREAS, the City Commission finds that the suspension of the State of
Florida Gasoline Tax for a period not to exceed sixty (60) days would be in the
best interest of the health, safety, and welfare of the citizens, residents, and
businesses of the City of Tamarac, Broward County, and the State of Florida.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1. That the foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct, and are hereby made a specific part of
this Resolution.
SECTION 2. The City Commission of the City of Tamarac urges Governor
Jeb Bush and members of the Florida Legislature to take all steps necessary to
suspend, for a period not to exceed sixty (60) days, the State of Florida Gasoline
Tax as authorized by the Florida Constitution and Florida Statutes in order to
provide residents and businesses within the State of Florida with some relief
from the increased fuel prices that have occurred over the last few months.
SECTION 3. City Administration is hereby directed to transmit a certified
copy of this Resolution to Governor Jeb Bush, Senate President Tom Lee,
House Speaker Allan G. Bense, the City's State Legislative Representatives, the
Broward League of Cities, the Florida League of Cities, and any other interested
governmental entities or agencies.
SECTION 4. All resolutions or parts of resolutions on in conflict herewith be
and the same are hereby repealed to the extent of such conflict.
SECTION 5. If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or

invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
SECTION 6. This Resolution shall become effective immediately upon its
passage and adoption.
