R-2005-_M A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A REQUEST FROM THE BIG BIKE RIDERS ASSOCIATION OF SOUTH FLORIDA FOR IN -KIND SUPPORT AND TO WAIVE ALL PARKS AND RECREATION FEES FOR THE BIG BIKE RIDERS ASSOCIATION OF SOUTH FLORIDA, INC. HOLIDAY FUNDRAISING EVENT TO BE HELD AT THE TAMARAC PARK ON SATURDAY, DECEMBER 10, 2005, FROM 9:00 A.M. TO 8:00 P.M.; PROVIDING FOR PROPER INSURANCE AND HOLD HARMLESS AGREEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Interim Director of Parks and Recreation has received a request from the Big Bike Riders Association of South Florida, Inc. to waive all Parks and Recreation fees, and for certain in -kind support services for their holiday fundraising event to be held at the Tamarac Park on Saturday, December 10, 2005, from 9:OOAM to 8:OOPM (attached as Exhibit 1); and WHEREAS, the Big Bike Riders Association of South Florida, Inc. is a non-profit organization and requests waiver of all fees; and WHEREAS, all proceeds from the event go to local charities benefiting children in the area. These charities are Joe DiMaggio Children's Hospital, Dan Marino Foundation, Chris Evert Children's Hospital, God's Little Acres, Children's Home Society, and SOS Children's Village; and WHEREAS, the Interim Director of Parks and Recreation recommends approval of Temp. Reso #10811 September 13, 2005 Page 2 the request to waive all Parks and Recreation fees and for the City of Tamarac to provide certain inkind support services for the Big Bike Riders Association of South Florida, Inc. holiday fundraising event to be held December 10, 2005; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve the request for waiver of all Parks and Recreation fees and to provide certain in -kind support services for the Big Bike Riders of South Florida, Inc. holiday fundraising event to be held December 10, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: I SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the request to waive all Parks and Recreation fees and to provide certain in -kind services as listed below for the Big Bike Riders of South Florida, Inc. holiday fundraising event to be held at the Tamarac Park on Saturday, December 10, 2005 from 9:00 a.m. to 8:00 p.m., is HEREBY APPROVED. • Waiver of Recreation Center, Multi -Purpose Center, and athletic field rental fees. • Staff logistical assistance during the event. • Use of Showmobile SECTION 3: That insurance coverage in a form and amount acceptable to the City's Risk Manager and an executed hold harmless agreement in a form acceptable to the City's Risk Manager be provided to the City before the event. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
