R-2005- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO PURCHASE PUMPS AND APPURTENANCES FROM SANDERS COMPANY, INC., A SOLE SOURCE DISTRIBUTOR OF SMITH & LOVELESS, INC., SUPPLIES, FOR THE MAINTENANCE AND REPLACEMENT OF WASTEWATER PUMP STATIONS; AUTHORIZING EXPENDITURES FOR SAID PURPOSES FROM SANDERS COMPANY, INC., FOR AN AMOUNT NOT TO EXCEED $65,000 FOR FISCAL YEAR 2006; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Utilities Department currently operates and maintains seventy-six (76) wastewater pump stations; and WHEREAS, twenty (20) of these stations utilize pumps and appurtenances manufactured by Smith & Loveless, Inc.; and WHEREAS, the compatibility of pumps and appurtenances with originally installed equipment is necessary due to unique physical constraints within the wastewater pump stations, requiring the use of specialized equipment only available through Smith & Loveless, Inc.'s sole regional distributor, Sanders Company, Inc. (a copy of said justification attached hereto as "Exhibit 1 "); and WHEREAS, the purchase of pumps from other manufacturers would require the City to perform expensive renovations of the pump stations; and Temp. Reso. #10854 November 14, 2005 Page 2 of 4 WHEREAS, standardization of pump equipment is desirable in order to maintain continuity of replacement parts; and WHEREAS, Sanders Company, Inc., is the sole regional distributor of compatible equipment with the original pumps and the City's specifications for above -grade pumps; 71TO WHEREAS, City of Tamarac Code § 6-151 grants the authority to waive competitive bid requirements for the purchase of supplies and services available from a sole source; and WHEREAS, the cost of said pumps and appurtenances from Sanders Company, Inc., is both fair and reasonable and is equal to or better than what would be extended to another customer with similar needs; and WHEREAS, available funds exist in the appropriate Utilities Capital Improvement Project and Operating budgets for said purpose; and WHEREAS, the Director of Utilities and the Purchasing and Contracts Manager recommend that the appropriate City Officials authorize the purchase of pumps and appurtenances from Sanders Company, Inc., a sole regional distributor of Smith & Loveless, Inc., supplies, for the repair and maintenance of wastewater pump stations in an amount not to exceed $65,000 for Fiscal Year 2006; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to purchase Smith & I I I Temp. Reso. #10854 November 14, 2005 Page 3 of 4 Loveless pumps and appurtenances from Sanders Company, Inc., as a sole regional distributor for said supplies, in a Fiscal Year 2006 amount not to not to exceed $65,000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: - The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The appropriate City Officials are hereby authorized to purchase pumps and appurtenances for the maintenance and repair of wastewater pump stations from Sanders Company, Inc., a sole regional distributor of Smith & Loveless supplies in an amount not to exceed $65,000. SECTION 3: - An expenditure for said purpose in an amount not to exceed $65,000 for Fiscal Year 2006 is hereby approved. SECTION 4: - All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
