R-2005-36 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE A DELEGATION REQUEST TO AMEND THE NOTE ON THE "UNIVERSITY HOSPITAL REPLAT", WHICH CURRENTLY RESTRICTS PARCELS 1 AND 2 TO 44,000 SQUARE FEET OF HOSPITAL USE AND PARCEL 3 TO A 90-SLEEPING ROOM ADULT LIVING FACILITY, IN ORDER TO CLARIFY THAT PARCEL 1 IS VACANT AND PARCEL 2 IS 44,000 SQUARE FEET OF EXISTING HOSPITAL USE AND TO ACCOMMODATE THE FUTURE CONSTRUCTION OF A 32,000 SQUARE FOOT MEDICAL OFFICE BUILDING ON THE SUBJECT PROPERTY, SPECIFICALLY THE "UNIVERSITY HOSPITAL REPLAT", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 158, PAGE 46 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED AT THE WEST SIDE OF NORTH UNIVERSITY DRIVE @ NW 73RD STREET (CASE NO. 1-P-05); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has examined the application and staff recommendation dated February 17, 2005; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan for the development that is the subject of the application; and WHEREAS, the property owner desires to amend the note on the plat which currently restricts Parcels 1 and 2 to 44,000 square feet of hospital use and Parcel 3 to a Temp Reso #10631 — February 17 05 PaIO2 90-sleeping room adult living facility, in order to accommodate the future constru 32,000 square foot Medical Office Building on the subject property, specifically "University Hospital Replat", according to the Plat thereof as recorded in Plat Book Page 46 of the Public Records of Broward County, Florida; located at the west si( North University Drive @ NW 73rd Street; and WHEREAS, the property owner is requesting approval of the Delegation Requ i of a The 158, Je of a ,st to amend the current Plat note in order to clarify that Parcel 1 is vacant and Parcel 2 is 44,000 square feet of existing hospital use and to accommodate the future constructi�n of a 32,000 square foot Medical Office Building on Parcel 3 (attached hereto as Attach(nent 1"); and WHEREAS, the Director of Community Development recommends approval;1:1and WHEREAS, the Planning Board recommended approval on February 16,2005�, and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to the best interests of the citizens and residents of the City of Tamarac to app Delegation Request. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby in this in and confirmed as being true and correct and are hereby made a specific part of this Resolotion. I I I Temp Reso #10631 — February 17, 2005 Page 3 SECTION 2: That the City Commission hereby approves the Delegation Request to amend the note on the "University Hospital Replat" which currently restricts Parcels 1 and 2 to 44,000 square feet of hospital use and Parcel 3 to a 90-sleeping room adult living facility, in order to clarify that Parcel 1 is vacant and Parcel 2 is 44,000 square feet of existing hospital use and to accommodate the future construction of a 32,000 square foot Medical Office Building on the subject property, specifically the "University Hospital Replat", according to the Plat thereof as recorded in Plat Book 158, Page 46 of the Public Records of Broward County, Florida; located at the west side of North University Drive @ NW 73 rd Street. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
