CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2005�
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO REJECT
ALL BIDS FOR BID NO. 05-05B FOR THE
PURCHASE OF A NEW TV VIDEO TRUCK &
UPGRADE OF EXISTING EQUIPMENT AND
AUTHORIZING THE RE -BID OF REQUIREMENTS
WITH REVISED SPECIFICATIONS, PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, bids were solicited for the purchase of a new TV video truck
and the upgrade of existing equipment for the Utilities Department; and
WHEREAS, bids were received on February 23, 2005, from the following
bidders:

Aries Industries, Inc.
Elixsi Corp. d/b/a Cues (Cues)
$195,000.00
$203,152,00
WHEREAS, as a part of the bid review process, on -site reviews of
equipment manufactured by both firms were provided for City personnel; and
WHEREAS, after the completion of the bid review, it was determined by
Utilities Department staff that both units would meet the City's functional needs;
and
WHEREAS, Utilities staff and the Purchasing & Contracts Manager
determined that some elements of the specifications were not clearly defined
enough to properly reflect the needs of the City; and

WHEREAS, City of Tamarac Code, §6-149(5), allows the Purchasing I
Officer the authority, upon consultation with the affected department director(s),
to recommend the rejection of all bids when the public interest will be served; and
WHEREAS, it is the recommendation of the Director of Utilities and the
Purchasing & Contracts Manager to reject all bids for Bid No. 05-05B for the
purchase of a new TV video truck, and upgrade of existing equipment and to
authorize the re -bid of the requirements with revised specifications; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
reject all bids for Bid No. 05-05B for the purchase of a new TV video truck and
the upgrade of existing equipment and to authorize the re -bid of the requirements I
with revised specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution upon adoption hereof.
SECTION 2: The appropriate City Officials are hereby authorized to reject
all bids for Bid No. 05-05B for the purchase of a TV video truck and the upgrade
of existing equipment and to re -bid the requirements with revised specifications.

SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other
provisions or applications of this Resolution that can be given effect without the
invalid provision or application, and to this end the provisions of this Resolution
are declared to be severable
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
