R2005-72 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING SAMUEL S. GOREN, GOREN, CHEROF, DOODY & EZROL, P.A. TO SERVE AS CITY ATTORNEY FOR THE CITY OF TAMARAC ON AN INTERIM BASIS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission took action during the April 13, 2005 regular Commission Meeting to eliminate the in-house City Attorney's Office in favor of outsourcing the City's attorney services; and WHEREAS, the City Commission has determined that the public interest is best served by securing a City Attorney to serve the City of Tamarac on an interim basis; and WHEREAS, the City Commission met in special meeting on April 20, 2005 to interview various law firms and deliberate the qualifications of each firm; and WHEREAS, pursuant to Article XI of the City Charter, the City Commission has determined that Samuel S. Goren, Goren, Cherof, Doody & Ezrol, P.A. is qualified to serve as City Attorney for the City of Tamarac on an interim basis; and Temp. Reso. #10697 Page 2 of 3 April 18, 2005 Revision #1 — April 19, 2005 9:25 a.m. Revision #2 — April 19, 2005 10:20 a.m. WHEREAS, Section 11.01 of the City Charter requires such appointment be made by the City Commission; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interests of the citizens and residents of the City of Tamarac to appoint Samuel S. Goren, Goren, Cherof, Doody & Ezrol, P.A. to serve as City Attorney for the City of Tamarac on an interim basis. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission hereby appoints Samuel S. Goren, Goren, Cherof, Doody & Ezrol, P.A. to serve as City Attorney for the City of Tamarac on an interim basis. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
