R-2005- -1 w A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA OPPOSING PROPOSED SENATE BILLS 1714 AND 2072 AND HOUSE BILL 1325 DIRECTED TOWARD PROHIBITING OR RESTRICTING A GOVERNMENTAL AUTHORITY FROM PROVIDING A COVERED COMMUNICATIONS SERVICE AS DEFINED THEREIN; DIRECTING THE CITY CLERK TO PROVIDE COPIES TO THE GOVERNOR, MEMBERS OF THE FLORIDA LEGISLATURE, FLORIDA LEAGUE OF CITIES, AND THE BROWARD LEAGUE OF CITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac's resident population is constantly growing and changing and will continue to request new, improved, and additional City programs and services; and WHEREAS, the City of Tamarac wishes to preserve its home rule authority to provide programs and services to its residents; and WHEREAS, telecommunications systems, including internet services and cable television services have become basic amenities for Tamarac households and will become increasingly more common as the population grows and technology changes; and Temp. Reso. #10692 4/11 /2005 Page 2 1 WHEREAS, the City of Tamarac desires to preserve its option to provide said services directly to its citizens in the event it determines it to be in the best interest of its citizens to do so; and WHEREAS, proposed Senate Bills 1714 and 2072 and House Bill 1325 seek to prohibit or restrict governmental authorities from providing telecommunications services such as cable and internet under most circumstances; and WHEREAS, the City Commission of the City of Tamarac determines it to be in the best interest of the citizens and residents of the City of Tamarac to oppose Senate Bills 1714 and 2072 and House Bill 1325 directed toward prohibiting or restricting a governmental authority from providing a covered communications service as defined therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 1 1 Temp. Reso. #10692 4/11 /2005 Page 3 SECTION 2: The City Commission of the City of Tamarac hereby opposes proposed Senate Bills 1714 and 2072 and House Bill 1325 directed toward prohibiting or restricting a governmental authority from providing a covered communications service as defined therein. SECTION 3: The City Clerk is hereby directed to provide copies of this resolution to Governor Jeb Bush, Tom Lee, President of the Florida Senate, Allan G. Bense, Speaker of the Florida House of Representatives, Senator Lee Constantine, Senator Michael S. "Mike" Bennett, Representative Frank Attkisson, Senator Walter Campbell, Representative John Seiler, Representative Mathew Meadows, Representative Ron Greenstein, Representative Ari Porth Abraham, the Florida League of Cities, and the Broward League of Cities. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
