R- 2005-1 -1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SEEK FEDERAL SURFACE TRANSPORTATION PROGRAM FUNDS VIA AN APPLICATION THROUGH THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION TO THE FLORIDA DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $137,000 FOR SIDEWALK INSTALLATION ALONG PINE ISLAND ROAD BETWEEN 67T" COURT AND 62ND STREET AND WOODLANDS BOULEVARD BETWEEN 59TH STREET AND COMMERCIAL BOULEVARD; AUTHORIZING A 10% MATCH IN CITY FUNDS; AUTHORIZING CITY OFFICIALS TO ACCEPT AND EXECUTE THE REQUIRED AGREEMENT UPON APPROVAL OF THE APPLICATION FOLLOWING LEGAL REVIEW; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to install sidewalks on Pine Island Road between 67t" Court and 62"d Street and Woodlands Boulevard between 59t" Street and Commercial Boulevard; and WHEREAS, Federal Surface Transportation Program (STP) funds are available for selected transportation enhancement activities; and WHEREAS, STP funds are granted to local governments through the State via an application through the Broward County Metropolitan Planning Organization (MPO) to the Florida Department of Transportation for Transportation Enhancement Projects, copy of said application hereto attached as Exhibit A; and WHEREAS, the City desires to submit an application for STP grant funds to provide for sidewalk installation; and Temp. Reso. 10693 April 27 2005 Page 2 WHEREAS, the City is willing to match the award with 10% in City funds upon approval of said application; and WHEREAS, the Assistant City Manager and the Director of Public Works recommend submission of the application and acceptance of the award in the event of approval; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to apply for STP funds via an application through the MPO to the Florida Department of Transportation and accept the award and execute the required agreement upon approval of said application. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS' clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this resolution. Section 2: The appropriate City Officials are HEREBY authorized to seek STP funds via a Year .2005 Transportation Enhancement application through the MPO to the Florida Department of Transportation for project costs in the amount of $137,000 for sidewalk installation on Pine Island Road between 67th Court and 62"d Street and Woodlands Boulevard between 59th Street and Commercial Boulevard. Section 3: The City HEREBY agrees to provide a match of 10% upon approval of the application and implementation of the project Section 4: The appropriate City Officials are HEREBY authorized to accept the award and execute the necessary documents upon approval of said application following legal review. Section 5: All resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. �I 1 1 n Temp. Reso. 10693 April 27 2005 Page 3 Section 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. Section 7: This Resolution shall become effective immediately upon its adoption. Project Description: Use additional sheets as necessary to respond to the following: (a) What type of work is being proposed? (g) Describe any related project work phases that are already complete or currently underway. (h) Other specific project information that should be considered. 3. (a) Describe the proposed method of performing (i.e. contract or in-house) and administering (i.e. local or state) each work phase of the project. If it is proposed that the project be administered by a governmental entity other than the Department of Transportation, the agency must be certified to administer Federal Aid projects in accordance with the department's Local Agency Program Manual (topic no. 525-010-300). (b) Describe any public (and private, if applicable) support of the proposed project. (Examples include: written endorsement, formal declaration, resolution, financial donations or other appropriate means). (c) Describe the proposed ownership and maintenance responsibilities for the project when it is completed. (d) Describe source of matching funds and any restrictions on availability. I further certify that the estimated costs included herein are reasonable and understand that significant increases in these costs could cause the project to be removed from the Florida Department of Transportation work program.
