R- 2005--1'6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SEEK FEDERAL SURFACE TRANSPORTATION PROGRAM FUNDS VIA AN APPLICATION THROUGH THE BROWARD COUNTY METROPOLITAN PLANNING ORGANIZATION TO THE FLORIDA DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $271,000 FOR MEDIAN ENHANCEMENTS ALONG NOB HILL ROAD BETWEEN SOUTHGATE BOULEVARD AND WESTWOOD DRIVE; AUTHORIZING A 10% MATCH IN CITY FUNDS; AUTHORIZING CITY OFFICIALS TO ACCEPT AND EXECUTE THE REQUIRED AGREEMENT UPON APPROVAL OF THE APPLICATION FOLLOWING LEGAL REVIEW; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to enhance the medians on Nab Hill Road between Southgate Boulevard and Westwood Drive; and WHEREAS, Federal Surface Transportation Program (STP) funds are available for selected transportation enhancement activities; and WHEREAS, STP funds are administered to local governments through the State via an application through the Broward County Metropolitan Planning Organization (MPO) to the Florida Department of Transportation for transportation enhancement projects, a partially completed copy of said application is hereto attached as Exhibit A; and Temp. Reso. 10694 April 27, 2005 Page 2 WHEREAS, the City maintains the medians on Nob Hill Road are in need of landscape and irrigation improvements between Southgate Boulevard and Westwood Drive and wishes to submit an application for STP funds to provide for enhancements; and WHEREAS, the City is willing to match the award with 10% in City funds upon approval of said application; and WHEREAS, the Assistant City Manager and the Director of Public Works recommend submission of the application and acceptance of the award in the event of approval; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to apply for STP funds via an application through the MPO to the Florida Department of Transportation and accept the award and execute the required agreement upon approval of said application. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS' clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this resolution. Section 2: The appropriate City Officials are HEREBY authorized to apply for STP funds via an application through the MPO to the Florida Department of Transportation for project costs in the amount of $271,000 for median enhancements Temp. Reso. 10694 April 27, 2005 Page 3 along Nob Hill Road between Southgate Boulevard and Westwood Drive; a copy of the partially completed application is attached hereto as "Exhibit A". Section 3: The City HEREBY agrees to provide a match of 10% in City funds upon approval of the application and implementation of the project. Section 4: The appropriate City Officials are HEREBY authorized to accept the award and execute the necessary documents upon approval of said application following legal review. Section 5: All resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. Section 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. 1 Temp.
