R-2005- 9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A SPECIAL EXCEPTION TO PERMIT THE OPERATION OF AN INSURANCE CLAIM SERVICE CENTER IN A B-3 (GENERAL BUSINESS DISTRICT) ZONING CATEGORY TO PROGRESSIVE INSURANCE COMPANY LOCATED AT 3710 WEST COMMERCIAL BOULEVARD, SPECIFICALLY TRACT "A" OF THE "INTERCITY AUTO PLAT OF TAMARAC", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 98, PAGE 27 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LESS THAT PART TAKEN THROUGH EMINENT DOMAIN BY ORDER OF TAKING FILED APRIL 14, 1978 IN OFFICIAL RECORDS BOOK 7518, PAGE 779 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO.13-Z-05); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of the City of Tamarac provides for the granting of a Special Exception to permit the operation of an insurance claim service center in a B-3 (General Business District) zoning category located at 3710 West Commercial Boulevard, specifically Tract "A" of the "Intercity Auto Plat of Tamarac", according to the Plat thereof as recorded in Plat Book 98, Page 27 of the Public Records of Broward County, Florida, Less that part taken through Eminent Domain by order of taking filed April 14, 1978 in Official Records Book 7518, Page 779 of the Public Records of Broward County, Florida; and Temp Reso #10685 — April 7, 2005 Revision No. 1 — April 15, 2005 Page 2 WHEREAS, Progressive Insurance Company is diversifying and expanding its operations with a new concept known as a full -service claim center; and WHEREAS, Progressive Insurance Company would like to operate its first full - service claim center in the City of Tamarac; and WHEREAS, the Planning Board held a public hearing on April 6, 2005 thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac find that approving the petition for special exception would be in keeping with the public health, safety and general welfare of the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant a Special Exception to permit the operation of an insurance claim service center in a B-3 (General Business District) zoning category located at 3710 West Commercial Boulevard, specifically Tract "A" of the "Intercity Auto Plat of Tamarac", according to the Plat thereof as recorded in Plat Book 98, Page 27 of the Public Records of Broward County, Florida, Less that part taken through Eminent Domain by order of taking filed April 14, 1978 in Official Records Book 7518, Page 779 of the Public Records of Broward County, Florida. Temp Reso #10685 — April 7, 2005 Revision No. 1 —April 15, 2005 Page 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the petition for a special exception to permit the operation of an insurance claim service center in a B-3 (General Business District) zoning category located at 3710 West Commercial Boulevard, specifically Tract "A" of the "Intercity Auto Plat of Tamarac", according to the Plat thereof as recorded in Plat Book 98, Page 27 of the Public Records of Broward County, Florida, Less that part taken through Eminent Domain by order of taking filed April 14, 1978 in Official Records Book 7518, Page 779 of the Public Records of Broward County, Florida, is HEREBY APPROVED, subject to the following conditions: 1. The applicant shall apply for and receive approvals of all appropriate fees associated with the special exception for the operation of an insurance claim service center. 2. The special exception is transferable administratively pursuant to compliance with City Codes, submitting documentation and payment of fees. 3. There shall be no storage of damaged vehicles visible from the abutting rights- Temp Reso #10685 — April 7, 2005 Revision No. 1 — April 15, 2005 Page 4 of -way (Commercial Boulevard). In addition, there shall be no damaged vehicles dropped off or parked in front of the site. 4. There shall be no outside storage of vehicle parts or accessories. 5. There shall be no vehicle repairs or maintenance services provided on -site. 6. Damaged vehicle assessments shall be processed within an enclosed facility and all damaged vehicles held in a secure holding area until such time they are transferred to another site for repair (within a 24-hour or next -business -day time frame). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
