R-2005- 93 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA SUPPORTING AMENDMENTS TO THE FLORIDA CONSTITUTION REQUIRING THE PERIODIC REVIEW AND APPROVAL OF ALL SALES TAX EXEMPTIONS AND EXCLUSIONS IN THE STATE OF FLORIDA; DIRECTING THE CITY CLERK TO PROVIDE COPIES TO THE GOVERNOR, MEMBERS OF THE FLORIDA LEGISLATURE, FLORIDA LEAGUE OF CITIES, AND THE BROWARD LEAGUE OF CITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida's tax structure depends significantly on sales tax revenues, which amount to approximately $18.3 billion annually; and WHEREAS, the State of Florida currently exempts more revenue than it collects, providing poorly categorized sales tax exemptions fraught with disparities for over 400 products and services, amounting to an annual loss of $22.7 billion in tax revenue; and WHEREAS, the State of Florida's sales tax exemptions have not been revised or reformed significantly since 1949; and WHEREAS, the State of Florida's municipalities rely on sales tax revenues to provide for the health, safety, and welfare of residents; with the proportionate share of this revenue source being a reliable resource; and Temp. Reso. #10716 May 10, 2005 Page 2 d WHEREAS, the inequities in the State of Florida's sales tax structure cause the State and municipalities to be more dependent on other revenue sources, such as the property tax; and WHEREAS, a group known as Floridians Against Inequities in Rates (FAIR) is pursuing three constitutional amendments to the 2006 ballot, that if approved, would sunset all current sales tax exemptions in July 2008 with the exception of tax exemptions for food, prescription drugs, health services, residential rent, electricity and heating — those which serve the greatest public interest; and WHEREAS, the City Commission of the City of Tamarac determines it to be in the best interest of the citizens and residents of the City of Tamarac to support amendments to the Florida Constitution requiring the periodic review and approval of all sales tax exemptions and exclusions in the State of Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 1 Temp. Reso. #10716 May 10, 2005 Page 3 SECTION 1: The foregoing "WHEREAS' clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac hereby supports amendments to the Florida Constitution requiring the periodic review and approval of all sales tax exemptions and exclusions in the State of Florida. SECTION 3: The City Clerk is hereby directed to provide copies of this resolution to Governor Jeb Bush, Tom Lee, President of the Florida Senate, Allan G. Bense, Speaker of the Florida House of Representatives, Senator Walter Campbell, Representative John Seiler, Representative Mathew Meadows, Representative Ron Greenstein, Representative Ari Abraham Porth, the Florida League of Cities, and the Broward League of Cities. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
