R-2004- /a7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A PARKING WAIVER OF FOUR (4) PARKING SPACES TO REDUCE THE NUMBER OF REQUIRED PARKING SPACES FROM SIXTY (60) TO FIFTY-SIX (56) PARKING SPACES FOR THE CVS PHARMACY @ TAMARAC MARKETPLACE, LOCATED AT THE SOUTHWEST CORNER OF MCNAB ROAD AND NOB HILL ROAD, SPECIFICALLY A PORTION OF TRACT "A" OF THE "TAMARAC MARKET PLACE" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 118, PAGE 20 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health and welfare of the citizens of the City; and WHEREAS, CVS Pharmacy @ Tamarac Marketplace desires to provide a covered drive-thru and sidewalk area for customers; and WHEREAS, adhering to the sixty (60) parking spaces required by the City of Tamarac Code of Ordinances would not allow for the construction of a covered drive-thru and sidewalk area; and Temp Reso #10431 — April 22, 2004 Revision No. 1 — May 3, 2005 Page 2 WHEREAS, a hardship exists for CVS Pharmacy @ Tamarac Marketplace if the development is unable to provide a covered drive-thru and sidewalk area; and WHEREAS, CVS Pharmacy @ Tamarac Marketplace has filed an application for a Parking Waiver of four (4) required parking spaces to reduce the number of required parking spaces from sixty (60) to fifty-six (56) parking spaces, in order to accommodate a covered drive-thru and sidewalk area for customers; and WHEREAS, the Planning Board held a public hearing on April 21, 2004, thereon and recommended approval of this application; and WHEREAS, the Director of Community Development has thoroughly reviewed and recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the parking waiver as requested in the application by CVS Pharmacy @ Tamarac Marketplace to reduce the number of required parking spaces from sixty (60) to fifty-six (56) parking spaces in order for the CVS Pharmacy to provide a covered drive-thru and sidewalk area for customers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 1 1 Temp Reso #10431 — April 22, 2004 Revision No. 1 — May 3, 2005 Page 3 SECTION 2: That the application by the CVS Pharmacy @ Tamarac Marketplace requesting a parking waiver of four (4) spaces to reduce the number of required parking spaces from sixty (60) to fifty-six (56) parking spaces, located at the southwest corner of McNab Road and Nob Hill Road, is HEREBY APPROVED, and such parking waiver would not be detrimental to the public safety, health and welfare of the citizens of the City of Tamarac. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: adoption.
