RESOLUTION NO. R-96 - L a
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, ACCEPTING A QUIT CLAIM DEED
FROM BROWARD COUNTY, FLORIDA OF COUNTY -
OWNED PROPERTY, LOCATED IN TAMARAC, FLORIDA;
ACQUIRED BY THE COUNTY BY VIRTUE OF THE
PROPERTY BEING DELINQUENT AD VALOREM TAX
PAYMENTS LANDS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, property legally described as:
Tax Deed #12031; Property I.D. #9111-01-0171; Ft.
Lauderdale Truck Farms; 11 -49-414-31 B; Beg SW Cor of SE
1/4, ELY 880, NLY 163.03 to POB, WLY 40.01, NLY 292.05,
ELY 40.01, SLY 292.05; To POB
located in the City of Tamarac, Florida has escheated to Broward County, Florida as a
result of delinquent ad valorem tax payments; and
WHEREAS, Fla. Stat. §197.592, requires land acquired by a county for delinquent
ad valorem tax payments to be conveyed to the municipality in which it is located, free of
any liens of record; and
WHEREAS, Broward County, Florida has recorded a Quit Claim Deed for the
transfer of the above described property to the City of Tamarac, Florida, a copy of the
recorded Quit Claim Deed is attached hereto as EXHIBIT A; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to accept the Quit
Claim Deed from Broward County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That the City Commission hereby accepts the Quit Claim Deed of the
property legally described as:
Tax Deed #12031; Property I.D. #9111-01-0171; Ft.
Lauderdale Truck Farms; 11-49-41 4-31 B; Beg SW Car of SE
1/4, ELY 880, NLY 163.03 to POB, WLY 40.01, NLY 292.05,
ELY 40.01, SLY 292.05; To POB
from Broward County, Florida.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by an court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its passage
and adoption.

QUIT CLAIM DEED
THIS DEED, made this J _ day of �q1a"Ar____� 1995, by BROWARD
COUNTY, a political subdivision of the State of Florida, 115 S. Andrews Avenue,
Ft. Lauderdale, FL 33301, and the CITY OF TAMARAC, a municipal corporation,
authorized and existing under the laws of the State of Florida, whose post office
address is: 7525 N.W. 88 Avenue, Tamarac, Florida 33321-2401.
That BROWARD COUNTY for and in consideration of the sum of TEN DOLLARS & 00/100
($10.00) to it in hand paid by.the CITY OF TAMARAC, the receipt whereof is hereby
acknowledged, has granted, bargained and sold to the CITY OF TAMARAC, the
following described lands, lying and being in Broward County, Florida, to -wit:
Property I.D. #'s and legal descriptions attached
hereto and made a part hereof as Exhibit "A".
SUBJECT TO ALL EXISTING PUBLIC PURPOSE UTILITY & GOVERNMENT EASEMENTS AND RIGHT
OF WAYS.

2 A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF BROWARD COUNTY, FLORIDA,
3 AUTHORIZING THE CONVEYANCE TO A BROWARD COUNTY
MUNICIPALITY OF COUNTY -OWNED PROPERTY WHICH
4 WAS ACQUIRED BY VIRTUE OF THE PROPERTY BEING
DELINQUENT TAX LANDS; AND PROVIDING FOR AN
5 EFFECTIVE DATE.

7 WHEREAS, Broward County acquired title to real property, which
8 is described in the proposed Quit Claim Deed attached hereto and
9 made a part hereof as -Exhibit $$A,° by virtue of delinquent ad
10 valorem tax payments in accordance with the law; and
11 WHEREAS, the County, at its discretion, has decided not to
12 sell or dedicate this land, or has attempted to sell this property; i
13 and
14 WHEREAS, the former owner of these lands has not filed a
i
15 verified application or petition with the Broward of County
16 Commissioners, seeking the restitution of this property in the
17 manner prescribed by Florida Statutes 197.592; and
18 WHEREAS, Florida Statutes 197.592 authorizes the Board to
19 convey the property which has not been previously sold or dedicated
20 by the Hoard of County Commissioners, or conveyed to the fee simple
21 title owner upon the owner making an application for its return, in
22 accordance with the conditions of that statute, to the governing
23 board of the municipality in which the lands are situated; and
24 WHEREAS, Florida Statutes additionally authorize hoards of
25 county commissioners to convey real estate owned by the county,
26 which property is not needed for county purposes, to municipalities
27 of the State of Florida at a private sale for such price, whether
28 nominal or otherwise, as the board may fix; NOW, THEREFORE,

30 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF BROWARD
31 COUNTY, FLORIDA:
32 Section 1. The recitals set forth in the preamble to this
33 Resolution are incorporated by reference herein.

1 Section 2. The conveyance of this property is hereby approved
2 for no consideration.
3 Section 3. This property, having been acquired as county
4 delinquent ad valorem tax lands, and not having been previously
5 sold or dedicated by the Board, and the former owner not having
6 requested by verified application a return of such property, the
7' conditions set forth in Section 197.592, Florida Statutes, for
8 conveying this property to the City are satisfied.
9 Section 4. The Chair of the Board of County commissioners is
10 hereby authorized to execute a Quit Claim Deed attached hereto as
11 Exhibit "A," and such attached documents as needed to effect the
12 conveyance.
13 This Resolution shall become effective upon its adoption.

The property escheated to the City is described as a portion of an existing forty
(40) foot canal running, North and South along the Eastern property line of the "The Villas
of Woodland Greens" a residential development, and running along the Western property
line of the "Woodland Place" residential development as indicated on "EXHIBIT A" and
legally described below. The canal is currently being maintained by Broward County
Water Management Division.
A portion of "Fort Lauderdale Truck Farms" lying in Section 11, Township 49,
0 Range 41, according to the Plat Thereof as recorded in Plat Book 4, at Page 31, of the
Public Records of Broward County, Florida, more particularly described as follows:
Beginning at The Southwest corner of the Southeast 1/4, Commence Easterly a
distance of 880 feet, thence Northerly a distance of 163.03 feet to the Point of Beginning,
thence Westerly a distance of 40.01 Feet, thence Northerly a distance of 292.05 feet,
thence Easterly a distance of 40.01 feet, thence Southerly a distance of 292.05 to the
Point of Beginning. (Said lands encompass .27 acres more or less.)
