R-96- a� A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA, APPROVING AND AUTHORIZING THE IMPLEMENTATION OF A BENEFITS PLAN FOR APPOINTED OFFICIALS AND EXECUTIVE, MANAGERIAUPROFESSIONAL AND ADMINISTRATIVE NON -BARGAINING EMPLOYEES EFFECTIVE OCTOBER 1, 1996; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Manager appointed a Benefits Review Committee, consisting of the Personnel Director, Risk Manager, Assistant City Manager, Director of Public Works, and Budget Administrator to review the City's Benefit Plan for non -bargaining employees and to redesign the Plan to be competitive, fair and equitable, and cost effective for employees and the City; and WHEREAS, the Benefits Committee and City Manager recommend the implementation of the proposed Benefit Plan for Appointed Officials, and Executive, Managerial/Professional and Administrative non -bargaining employees effective October 1, 1996, and WHEREAS, the implementation of the proposed Benefits Plan will assist the City I-] I . _-] 1-1 Temp. Reso. #7569 to attract and retain employees by providing a competitive package of benefits which is fair and cost effective for the City and its employees; and WHEREAS, funds are included in the Fiscal Year 1997 budget to cover the costs of the proposed Benefits Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION_1, That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission approves the Benefit Plan contained in Exhibit I and the City Manager is hereby authorized to implement the Benefit Plan outlined on the attached Exhibit I for Appointed Officials, and Executive, Managerial/Professional and Administrative non -bargaining employees effective October 1, 1996. SECTION-3- All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION4: If any clause, section, other part or application of this Resolution is held by a court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. '2 2 7 �J • BENEFIT PLAN Exhibit 1 The following benefit plan for Appointed Officials, and Executive, Managerial/Professional and Administrative full-time employees is effective October 1, 1996, except as noted. Benefit Options Appointed Officials, and Executive, Managerial/Professional and Administrative employees will receive a $1,550 Benefit Options package in calendar year 1997, or as established by the City Commission every calendar year. New employees will receive a pro -rated Benefit Option package after successfully completing their probationary period, where applicable. Vacation Vacation leave shall accrue at the following rate for each non -bargaining category: Appointed and Executive 0 - 5 years 17 days per year 6 - 10 years 20 days per year 10 + years 23 days per year Managerial/Professional 0 - 5 years 15 days per year 6 - 10 years 18 days per year 10 + years 21 days per year Administrative 0 - 5 years 12 days per year 6 - 10 years 15 days per year 10 + years 18 days per year All Above Categ ries Vacation leave may be accrued without limit for use only. Employees must use five (5) days of vacation leave in the fiscal year during which it is earned (after the first full year of employment) 1 /;1_1 �� _02- -.2 7 Exhibit I or it will be forfeited at the end of the fiscal year. Up to a maximum of 350 hours of accrued vacation leave will be paid upon termination of employment with the City. Any balance of vacation leave over the 350 hours has no cash value. In order to transition to the new vacation leave plan, a one-time payment shall be made to employees in the Executive and Managerial/Professional Categories as follows: Accrued vacation leave in excess of 350 hours on September 29, 1996 will be paid in October, 1996. Sick Leave Sick leave with pay shall be granted to Appointed Officials and to employees in the Executive, Managerial/Professional and Administrative job categories at the rate of seven (7) hours, or one (1) day, for each completed month of service and shall be accrued from year to year. Upon termination of employment, reimbursement will be made to Appointed Officials and Executive, Managerial/Professional and Administrative employees for twenty-five (25) percent of their accrued sick leave hours in excess of eighty-four (84) hours. The eighty-four (84) hours have no cash value. The previous program of sick leave buy back is eliminated effective October 1, 1996. 0 Longevity Appointed Officials and employees of record in the Executive, Managerial/Professional and Administrative job categories entitled to a longevity payment in December, 1996, in accordance with Resolution 88-272 and subsequent amendments, will receive their scheduled longevity lump sum payment in December, 1996 as scheduled. Effective the first pay -period in January, 1997, the longevity percentage applicable in 1996 to employees of record shall be added to their base pay. Employees of record who would be eligible for a longevity increment in calendar year 1997 based on Resolution 88-272 and subsequent amendments, will receive an adjustment in their base pay equivalent to their longevity increase effective on their anniversary date in 1997. Except as noted above, the schedule of longevity increases is eliminated on January 1, 1997. Personal Days Appointed Officials, and Executive, Managerial/Professional and Administrative employees will receive three (3) personal days annually on the first day of the fiscal year. Personal days must be used in the fiscal year earned or will be forfeited, and have no cash value. 2 � C - 9(al, -, , 2& �:, 2-7 ,e-9�-.242 7 • • Exhibit I On the initial fiscal year of employment, personal days will be awarded as follows regardless of probationary status: Date of Hire October 1 October 2 - February 1 February 2 - June 1 Life Insurance Personal Days Awarded 3 days 2 days 1 day Appointed Officials and Executive and Managerial/Professional employees will receive group term life insurance of $50,000 with the premium paid by the City. Administrative employees will receive group term life insurance of $25,000 with the premium paid by the City. Dental Insurance Appointed Officials, and Executive, Managerial/Professional and Administrative employees will receive dental insurance selected by the City with the premium paid by the City as follows effective January 1, 1997. Employee only 100% Employee plus one dependent 50% Employee plus family 50% Tuition Assistance Regular Executive, Managerial/Professional and Administrative employees may be reimbursed for tuition, up to the credit hour fee charged by Florida International University or Florida Atlantic University (highest of the two), up to $1,000 per fiscal year. Tuition reimbursement will be 100% of the registration and tuition fees, and charges for semester hours, up to the limits defined above, upon proof of receipt of a Grade C or better, or a passing grade (if pass/fail course). An eligible training or educational program is one that is directly related to the employee's current position or related to higher position in the City, and which shall improve the performance in a current position, or which constitutes preparation for promotion to a related higher level position in the City. The training or course must be pre -approved by the City Manager or Designee, and the Department Director. Employees who leave the City within one year of having received a tuition reimbursement payment will reimburse the City for the tuition reimbursement payment made in that year. 3 Z_ 5�_OZCZ) ,e s6 - a.z 7 • • Pension Plan Exhibit I Full-time Administrative employees participate in the City of Tamarac's Pension Plan. The City will contribute the actuarially determined amount to the Pension Plan, and the employee will contribute the mandatory contribution established by the Plan. Full-time Executive and Managerial/Professional employees may elect to become a member of the City of Tamarac's Pension Plan or may elect to join the 401(a) Money Purchase Retirement Plan. If the Pension Plan is selected by the employee, the City will contribute the actuarially determined contribution to the Pension Plan, and the employee will contribute the mandatory employee contribution established by the Plan. If the employee selects the 401(a) Money Purchase Retirement Plan, the City will contribute ten (10) percent of the employee participant's gross earnings with a mandatory contribution by the employee participant of five (5) percent. Disability Insurance The City is currently examining disability insurance plans. A recommendation for City Commission consideration of a disability insurance plan which includes a City contribution toward the premium will be presented if a plan is found which is feasible and cost effective. Appointed Officials Appointed Officials (City Manager and City Attorney) will participate in a 401(a) Money Purchase Retirement Plan, with the equivalent contributions from the City and the employee as applies to Executive employees. Appointed Officials shall receive deferred compensation paid by the City as approved by Resolution 88-272. In the event an Appointed Official has a separate agreement, contract or amendments by Commission action, benefits specifically described in that agreement, contract or amendments by Commission action shall supersede this resolution. !!
