R-96- U9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE OFFICIALS TO EXECUTE WORK ORDER NO. 3 TO BECOME PART OF AN AGREEMENT WITH CARR SMITH ASSOCIATES (APPROVED UNDER RESOLUTION NO. R-94-89 ON MAY 25, 1994), TO PROVIDE ENGINEERING AND RIGHT-OF-WAY ACQUISITION SERVICES FOR HIATUS ROAD FROM THE NORTH PROPERTY LINE OF THE WESTPOINT PROPERTY TO MCNAB ROAD, FOR $ 292,212.80 TO BE CHARGED TO ACCOUNT NO. 144-888-541-6FA AND $ 75,532.00 TO BE CHARGED TO HIATUS ROAD UTILITY IMPROVEMENT ACCOUNT NO. 432-888-536-675, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is the recommendation of the City Manager, Public Works Director, Community Development Director and City Engineer to enter into an agreement with Carr Smith Associates to provide engineering and right-of-way acquisition services for Hiatus Road from the north property line of the Westpoint property to McNab Road in Land Section 7; and WHEREAS, City Code Section 6-156 of the City of Tamarac allows the City Manager to approve individual and separate change orders to contracts provided each change order totals less than $10,000; and WHEREAS, funding for this project be approved from Account No. 144-888-541-6FA for Hiatus Road in the amount of $292,212.80, and from Account No. 432-888-536-675 for the Hiatus Road Utility Improvements in the amount of $75,532.00; and Temp. Reso. #7357 Revision #1 - 3/5/96 Revision #2 - 3/5/96 Revision #3 - 3/5/96 Revision #4 - 3/7/96 Revision #-5 3/8/96 WHEREAS, the City Commission of the City of Tamarac, Florida deem it to be in the best interest of the citizens and residents of the City of Tamarac to enter into an agreement with Carr Smith Associates to provide engineering and right-of-way acquisition services for the proposed design of Hiatus Road from the north property line of the Westpoint property to McNab Road in Land Section 7. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 2: The appropriate City officials are hereby authorized to execute Work Order No. 3, with Carr Smith Associates for Engineering Services, for Hiatus Road from the north property line of the Westpoint property to McNab Road in Land Section 7 attached hereto as Exhibit 1". SECTION 3: Funding for the Project is approved from Account No. 144-888-541-6FA for Hiatus Road in the amount of $292,212.80, and from Account No. 432-888-536-675 for the Hiatus Road Utility Improvements in the amount of $75,532.00. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 Temp.
