R-93- ,Qci A RESOLUTION ISSUING REVISED DI3VELOPMENT ORDER NO. 276-1 FOR LAND SECTION 6 PROJECT S (LOCATED WEST OF NORTHWEST 108 TERRACE • BETWEEN MCNAB ROAD AND SOUTHGATE BOULEVARD) 4 FOR A FTNAL SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10--2 THROUGH 10-29 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE NOTE. WHEREAS, pursuant to 'the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a :revised development order by the applicant for development, approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated June 9, 1993; and 18` WHEREAS, the City Council reviewed the revised develop-- 19 meat order and accompanying documents at a public meeting; and 2 WHEREAS, the City Council has determined that the appli- 2 cation is in compliance with all elements of the Comprehensive 22 flan, or will be in compliance prior to the issuance of a 23 Certificate of Occupancy for the development that is the subject of 24 the application. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 26 TAMARAC, FLORIDA: 23 SECTION 1: That the development described on the attached Development Review Status Sheet dated June 9, 1993 is Granted a revised development order to proceed subject to the following conditions: A. Construction is to be in complete compliance with ,the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year :from the date of: this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance lwith applicable regulations. Temp. The revised development order is assignable, but an s assignment does not discharge any assignee from strict compliance I tiith the order unless the City Council_ consents to modify any of 5 the original requirements. 6 D. Additional conditions established in order to issue he revised development order are set forth as follows: 1.. If County approval of two delegation requests to convert the 10 square footage note to a residential unit note and to change 11 the unit density notes is not received, the site plan is null 12 and void. 13 2. Subject to the developer installing an Ingress and Egress on 14 Southgate Boulevard. 15 3- Subject to submittal and approval of a Water and Sewer 16 Developer Agreement 17 SECTION 2: That the following documents are hereby 18 eiccepted and approved as a part. of this revised development order: 19 Water and Sewer Developer agreement 2 SECTION 3: Should any section or provision of this 2 revised development order be declared by a court of competent 22 jurisdiction to be invalid, the City Council shall determine if the 23 other portions of the order remain valid or whether the approval 24 .shall be null and void. 25 SECTION 4: This revised development order as condi 26 tioned shall become effective immediately upon its passage. 27 PASSED, ADOPTED AND APPROVED this day of S , �, , 1993. 28 29 30 31 ATTEST: CARD A.
