CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-93-/_Z/
A RESOLUTION GRANTING A TIME EXTENSION FOR
FINAL SITE PLAN APPROVAL FOR WOODMONT
GARDENS ACLF; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council has approved site plan
approval extensions on this project since 1988; and

WHEREAS, the Community Development Department and

Planning Commission recommend approval.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY

31 OF TAMARAC, FLORIDA:
35 SECTION 1: That the application for a one (1) year
26 extension for Phase I site plan and a four (4) year extension for
37 Phase II site plan for Woodmont Gardens is approved subject to the
18 following conditions:
39 A. Construction is to be in complete compliance with
20 the plans and specifications submitted by the developer to the City
2 of Tamarac as described in Section II of the Development Review
2 Status Sheet and approved engineering drawings.
23 B. Commencement of construction shall be no longer
21 than one year from December 19, 1993 for Phase I and four (4) years
25 from December 19, 1993 for Phase II. If the development does not
26 commence construction within one year, this approval is null and
27 void unless an extension has been granted in accordance with
28 applicable regulations.
29 C. The revised development order is assignable, but an

assignment does not discharge any assignee from strict compliance
31
with the order unless the City Council consents to modify any of
32.
the original requirements.

D. Additional conditions established in order to issue
the revised development order are set forth as follows:

That if, in the future, there were more stringent
requirements for approval of a site plan, that Woodmont
Gardens ACFL would modify their site plan to accomodate
those new regulations.

••SECTION 2: Should any section or provision of thi
revised development order be declared by a court of competen
jurisdiction to be invalid, the City Council shall determine if th
other portions of the order remain valid or whether the approva
shall be null and void.
SECTION 3: This revised development order as conditioned
shall become effective immediately upon its passage.
