RESOLUTION NO. R-93-113 _
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA OPPOSING REGULATION OF
WATER AND WASTEWATER SYSTEMS BY THE PUBLIC
SERVICE COMMISSION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
WHEREAS, many water and wastewater systems of the State of
Florida have been constructed and operated by local governments
within the State of Florida; and
WHEREAS, the staff of the Public Service Commission, without
application, 'has proposed legislation aimed at requiring the
Public Service Commission regulate water conservation and rates of
water and wastewater utilities along with control over territorial
disputes between water and wastewater systems owned or operated by
local government; and
WHEREAS, the regulation of water and wastewater systems by
the Public Service Commission would have severe negative impact
upon municipalities and counties which both operate utilities; and
WHEREAS, the Public Service Commission regulation would
negatively impact annual budgets of local governments and debt
service for bonds issued; and
WHEREAS, the records of water and wastewater utilities
controlled by the Public Service Commission have not been better,
than those which are owned and operated by local governments; and J
WHEREAS, there have been very few territorial disputes
regarding water and wastewater systems within the State of Florida
within recent years; and
WHEREAS, voluntary conservation for water and wastewater us
has been implemented and should be further explored; and
WHEREAS, local governments are governments which are closes
to the people and which can set rates, settle disputes, an
provide for conservation which most closely benefit the citizen

Of the local areas which they serve; and
WHEREAS, local government is directly responsible to the rate
payers of the local areas which they serve in that counties and
cities are by constitution controlled by individuals 'who are
directly elected;
WHEREAS, the legislators of the State of Florida should
foster local control of utilities which are owned and controlled
by government rather than requiring and additional step of
bureaucracy on the state level; and
WHEREAS, the City Council of the City of Tamarac, Florida
deems it to be in the best interests of the citizens and residents
of the City .of Tamarac to oppose regulation of water and
wastewater systems by the Public Service Commission,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
That the foregoing "WHEREAS" clauses are
hereby ratified and confirmed as being true and correct and are
hereby made a specific part of this Resolution.
SMITO 2: That the City Commission of the City of
Tamarac, Florida hereby goes on record as opposing any regulation
by Public Service Commission as to water and wastewater
systems
owned or operated by local governments within the State of
Florida.
FQT LQNL3.,_ That a copy of this Resolution shall be
forwarded to the Florida League of Cities, Broward County League
Of Cities, Senator Ken Jenne, Chairman of the Broward County
Legislative Delegation, Senator Peter M. Weinstein, Representative
Ben Graber, and Representative Debbie Wasserman -Shultz.

conflict.

SECTION 5: if any clause, section, other part -or
application of this Resolution is held by any court of competent
jurisdiction ,to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 6: This Resolution shall become effective
immediately upon its passage and adoption. d
