RESOLUTION NO. R--93-
A RESOLUTION ISSUING REV:I;D1_'" DEVELOPMENT
ORDER NO. 176-1. FOR lvl:II)','AY PLAZA PROJECT
LOCATED ON THE NORTHWEST (_'O ,INE,R OF UNIVERSITY'
DRIVE AND NORTHWEST 57 SI'REET FOR A REVISED
SITE PLAN PURSUANT `.CC) THE PROVISIONS OF
SECTIONS 10-2 THROUGH 10--29 OF THE TAMARAC
CODE; AND PROVIDING AN EFFECTIVE DATE._��
WHEREAS, pursuant to the 1.n.f3trurt__1.ons of the City
Council of Tamarac, Florida, a public nte(�t.inq has been advertised
in accordance with applicable law of t:.h(F date, time and place of
the meeting regarding the review of they application for a revised
development order by the applicant for development approval; and
WHEREAS, the City Council ha.3 C -imined and investigated
the application, staff and Plartn:i.ny Cotttnt:i..s: :art recommendations, and
the attached Development Review Status Sheet dated November 2,
1992; and
WHEREAS, 'the City Council .re!v:iewed the revised develop-
ment order and accompanying documents at:. a. public meeting; and
WHEREAS, 'the City Council has determined that the appli-
�ation, is in compliance with all elements of the Comprehensive
Plan, or will be in compliance p.:r:i or to the isEw ance of a
Certificate of Occupancy :for the de v-e:lop:inent that. is the subject of
the application.
NOW, THEREFORE, BE IT RESOLVED 13Y T11E COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the application :for approval of a
revised site plan for Midway Plaza,, prepared by Craven, Thompson
and Associates Inc., revised on January :14, 1993, reiflecti.ng the
proposed 4,100 square foot building, rev.ised. :Landscaping and a
change to the direction to on -site vehicular circulation near the
proposed restaurant is HEREBY APPROV:LD subject to the following
Conditions:
1 A. Construction is to be in comp'' ate compliance with
the plans and specifications submitted by the developer - to the City
of Tamarac as described .in Section :I :I c,i-- the Development Review
Status Sheet and approved engineering dr°awi' ng.s.

B. Commencement of c:onst:ructi,o»shill be no longer than
one year from the date of this app:roviEi.l... If: the development does
not commence construction within one yEN31',, this approval is null
and void unless an extension has beery chanted in accordance with
applicable regulations.
C. The revised development order is assignable, but an
assignment does not discharge any 1-170m strict comlili.ance
with the order unless the City Council c:orasents to modify, any of
the original requirements.
D. Additional conditions established. in order to issue
the revised development order are set f o-r.-t lY as follows:
1. This site plan approval_ .is n.ull and void if the amended
executed Water and Sewer Developers Agreement with the Lenders
signature is not received by the City of Tamarac within 30
days after City Council approl7a.1 of this revised- site plan.
SECTION 2: That the fol.lowincl documents is hereby
accepted as a part of this development ord.er,.

SECTION 3: Should any secti..oai. or provision of this
revised development order be declax-ed by a court of competent
jurisdiction to be invalid, the City- Cott.nc.i.l .shall determine if the
other portions of the order remain va-lid or whether the approval
shall be null and void.
SECTION 4: This revised development order as
conditioned shall. become effective imsned:iately upon :its passage.
