4 A RESOLUTION ISSUING REVISED DEVELOPMENT
ORDER NO. 099-2 FOR WOODMONT TRACT 56
S (AVALON AT WOODMONT) PROJECT LOCATED ON THE
NORTHWEST CORNER OF UNIVERSITY DRIVE AND
6 NORTHWEST 78 STREET FOR A FINAL SITE PLAN
PURSUANT TO THE PROVISIONS OF SECTIONS 10-2
THROUGH 10-29 OF THE TAMARAC CODE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City
Council of Tamarac, Florida, a public meeting has been advertised

in accordance with applicable law of the date, time and place of

the meeting regarding the review of the application for a revised

development order by the applicant for development approval; and
33
WHEREAS, the City Council has examined and investigated
34
35 the application, Staff and Planning Commission recommendations, and
36 the attached Development Review Status Sheet dated April 14, 1993;
17 and
is WHEREAS, the City Council reviewed the revised develop-
ment order and accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the appli-
cation is in compliance with all elements of the Comprehensive
22 Plan, or will be in compliance prior to the issuance of a
23 Certificate of Occupancy for the development that is the subject of
24 the application.
25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
26 TAMARAC, FLORIDA:
27 SECTION 1: That the development described on the
a attached Development Review Status Sheet dated April 14, 1993 is
29 granted a revised development order to proceed subject to the
30 following conditions:
33 A. Construction is to be in complete compliance with
31 the plans and specifications submitted by the developer to the City
of Tamarac as described in Section II of the Development Review
Status Sheet and approved engineering drawings.
` B. Commencement of construction shall be no longer
nan one year from the date of this approval. If the development
does not commence construction within one year, this approval is
null and void unless an extension has been granted in accordance
with applicable regulations.

C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance
with the order unless the City Council consents to modify any of
the original requirements.
D. Additional conditions established in order to issue
the revised development order are set forth as follows:
Under traffic concurrency review, the site is vested for
1.40,000 square feet of commercial use. A delegation request
has been filed to convert the square footage note to a
residential unit note. The County will have jurisdiction over
the conversion of vehicle trips. The applicant has also filed
as part of the delegation request an additional request to
vacate a portion of a right-of-way easement along University
Drive. If the delegation request is not approved by the County
the site plan will be null and void.
SECTION 2: That the following documents are hereby accepted
nd approved as a part of this revised development order:
SECTION 3: Should any section or provision of this revised
development order be declared by a court of competent jurisdiction
to be invalid, the City Council shall determine if the other
portions of the order remain valid or whether the approval shall be
null and void.
SECTION 4: This revised development order as conditioned
shall become effective immediately upon its passage.
