CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-93- Ca9
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE A STIPULATION
WITH MIDWAY INVESTMENTS, LTD., PERTAINING
TO AN AMENDED WATER AND SEWER DEVELOPERS
AGREEMENT FOR THE PROPOSED BOSTON CHICKEN
RESTAURANT; AND PROVIDING AN EFFECTIVE
DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute a Stipulation with Midway Invest-
ment, Ltd., granting a 90-day extension (from June 23, 1993) to
Midway Investments, Ltd., to execute an amended Water and Sewer
Developers Agreement for the proposed Boston Chicken
Restaurant, located on the northwest corner of University Drive
and Northwest 57 Street (5815 University Drive), a copy of said
Stipulation being attached hereto as "Exhibit 1"..
SECTION 2: This resolution shall become effective
immediately upon adoption. p�

WHEREAS, the Midway Investments, Ltd. revised final site plan has been submitted to the
City; and
WHEREAS, the site plan approval is eontigent upon the execution of an amendment to the
water and sewer developer's agreement, and
WHEREAS, the agent for the applicant has requested that the original developer's agreement
containing the lender's joinder suffice for the lender's signature on the amended developer's
agreement.
NOW therefore, be it stipulated and agreed by the parties:
That Midway Investments, Ltd. has 90 days from June 23,1"3 to secure the signature of the
lender on the amended developer's agreement
That 90 days after the Approval of this stipulation by the City Council of the City of Tamarac,
the site plan approval and the amended developer's agreement will become null and void if
the executed amended developer's agreement including the sigrutturo of the lender is not
supplied to the City.
That PSI/Midway, Inc. through its President, Alan J. Goldberg, is the authorized agent and
has the authority to legally bind Midway Investments, Ltd. to the terms of this stipulation.
That this stipulation is subject to approval by the City Council of the City of Tamarac via
