RESOLUTION NO. R-90- g
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE AN AMENDED
AGREEMENT WITH ROBERT K. SWARTHOUT, INC.,
TO UPDATE THE CITY'S LAND DEVELOPMENT
CODE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 28, 1989, the City Council
approved Resolution R-89-259 authorizing execution of an agreement
with Robert K. Swarthout, Inc., to update the City's Land Develop-
ment Code; and
WHEREAS, this agreement required that the City amend
the agreement in order to proceed with tasks beyond Tasks 1 and 2;
and
WHEREAS, the Director of Community Services has
recommended amendment of this agreement in order to accommodate
this.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute the amended agreement with Robert K.
Swarthout, Inc., to update the City's Land Development Code, a copy
of said agreement being attached hereto as "Exhibit 1".
SECTION 2: This Resolution shall become effective
upon adoption. dA-

Dear Ms. Carpenter -Craft:
Robert K Swarthout, Incorporated hereby agrees to amend its Planning Services Contract
with the City of Tamarac dated October 27,1989 and previously amended by letter from
Robert K Swarthout, Incorporated dated December 18, 1989.
The amendment which is the subject of this letter provides that Robert K Swarthout,
Incorporated will assist the City staff with the following development code -related work
items:
A. Text MoMeations Requh ed to Implement Comprehensive Plan
The City staff will be responsible for the following development code revisions
necessary to achieve consistency with the comprehensive plan. Robert K Swarthout,
Incorporated will provide review and comment advice as requested and subject to
time and budget limitations.
1. Establish criteria for land use plan amendments and site plans.
2. Establish zoning criteria for determining compatible uses.
3. Define "quality development."
4. Include incentives for quality development. Design flexibility and will be
considered as an incentive. Other incentives may also be considered.
5. Streamline review and permitting procedures.
6. Determine if an architectural review committee is needed and document
reasons for recommendation in a memorandum to staff.
7. Verify that code adequately addresses soils, natural resources and topography.
Document findings in memorandum to staff.
8. Provide specific language requiring adequate sites for community facilities,
schools and public utilities.

9. Verify that code does not limit ability to construct family housing. Document
reasons for findings in a memorandum to staff.
10. Establish criteria for land use plan amendments and rezonings which can be
used to assess whether a proposed use or district is consistent with City
character. Provide assessment of City character as basis for the criteria
11. Add language to the intent or purpose statements of the code providing for
protection of planned and existing neighborhoods for disruptive land uses and
nuisances.
12. Delete the A-5 zoning district.
13. Delete sub -stations as permitted uses.
14. Require preservation and mitigation on LAPC's; use Broward County's
regulations as a model.
15. Specify a twice per year land use plan amendment process within a whole new
land use plan amendment procedures section of the code.
16. Add standards requiring provision of bikepaths, bikeways and sidewalks.
17. Add standards requiring provision of bicycle storage areas in multifamily,
commercial and recreation areas.
18. Add language requiring submittal of building elevations with site plans;
provide review criteria and purpose statement.
19. Develop incentives for low and moderate income housing. Incentives to be
considered will include reduced impact fees and density bonuses.
20. Determine whether or not there is a need for revisions to the zoning code to
accommodate group homes and foster care facilities. Document reason in
memorandum to staff.
21. Prepare guidelines for the location of group homes and foster care facilities.
22. Amend landscape language to require native plant materials as follows: 20%
1990, 30% 1991; 40% 1992, and 50% 1993.
23. Increase the amount of required pervious surface and require storm water
retention system which contribute to aquifer recharge. Include these changes
in the site plan review language.
24. Regulate land clearance and site grading activity to control non -point
pollution and siltation of retention areas and waterways.

25. Improve buffers between uses and arterials; require noise reducing measures
such as berms, walls and landscaping.
26. Allow semi -impervious paving materials in parking lots to reduce
contaminants; allow turf blocks in employee parking and fire lanes.
27. Require site plan approval prior to site clearance and grading.
28. Require that 20% of plant material shall provide for habitat for native wildlife
and birds.
29. Require the preservation of 70% of any substantial native vegetation on a site;
permit relocation to other locations on site.
30. Develop criteria for the consideration of wildlife in site plan reviews; restrict
development activities which adversely affect endangered or threatened
wildlife.
31. Require that developers identify and preserve environmentally sensitive
lands or mitigate damage thereto.
32. Require provision of active recreation and open space in internal to residential
projects.
33. Incorporate site plan review standards for public access to public waterways
and canal maintenance areas.
B. Other LDR Tasks
1. Prepare a reorganization outline for the Land Development Code of the City of
Tamarac. Robert K. Swarthout, Incorporated will identify the appropriate
location for all existing and required sections of a Land Development Code.
2. Prepare a residential Planned Unit Development Ordinance. Robert K.
Swarthout, Incorporated will work in close cooperation with City staff to select
the best approach from various options available.
3. Prepare an industrial Planned Unit Development Ordinance. Robert K
Swarthout, Incorporated will work in close cooperation with City staff to select
the best approach from various options available.
4. Prepare standards for the granting of waivers for the following.
• landscape buffer areas
• parking (both substantive issues and number of spaces)
5. Prepare an issue paper which examines the advantages and disadvantages of
requiring a 50 foot right-of-way for public and private streets; a narrower right-
of-way is being considered in order to reduce the cost of construction and

maintenance. The issue paper will include construction standards for reduced
cross -sections. The consultant will rely on City staff for appropriate
construction standards. The issue paper will focus on residential areas.
6. Prepare an issue paper which assess the land uses and urban design character
of the City. Work in close cooperation with City staff. City staff will provide
substantial assistance with field surveys and documentation.
7. Provide consultation to the City staff relating to specific land uses to be
permitted in each zoning district. The City staff will be responsible for
developing permitted use lists. Robert K. Swarthout, Incorporated will suggest
use groupings and review and comment on City staff decisions.
8. Evaluate the desirability of condensing B Districts and establishing an office
zone and draft necessary language. Robert K. Swarthout, Incorporated will
review the various B Districts and related material and consult with the City
staff. If determined appropriate, the firm will recommend a restructuring of
the B Districts and/or the establishment of an office district. Specific district
language will be drafted by the firm and reviewed with the City staff.
9. Combine and coordinate all parking and loading regulations. Robert K.
Swarthout, Incorporated will revibw all parking and loading regulations for
the purpose of determining the best way to combine and coordinate them.
Existing regulations will be restructured in consultation with the City staff
10. Prepare accessory structure setback regulations and, if necessary, definitions.
Robert K. Swarthout, Incorporated will prepare a comprehensive accessory
structure setback and placement schedule. The firm will consult with the City
staff on specialized regulations for structures such as satellite dishes.
11. Prepare nonconforming use and variance regulations. Robert K. Swarthout,
Incorporated will research model ordinances and relevant case law, draft the
regulations and review them with City staff. Revisions will be made as
appropriate based on City staff comments.
12. Prepare mandatory findings language and other standards for land use
amendments, zoning amendments, site plans and special exceptions
(conditional approvals). In preparing such language, the firm will utilize its
past experience with similar provisions as well as City staff work on relevant
portions of Section A above. Regulatory approaches for selected special
exception (conditional approval uses) will be carefully researched, discussed
with the City staff and drafted accordingly.
13. Prepare overlay zones for flood hazard areas, sites with court -stipulated density
and other regulations, and developments of regional impacts. The firm will
draft language and review it with City staff. Appropriate revisions will be
made based on City staff review.

C. Meetinp and Hearinp
The consultant will meet with City staff on technical questions related to all tasks.
The consultant shall attend one public hearing on the LDR.
The fee for the firm's assistance on the above work items shall be based on hourly rates
plus direct expenses as set forth in Section III of the October 27,1989 Planning Services
Contract, except that work shall be limited so that the firm's total fee under this amendment
shall not exceed $30,000.
If this amendment meets with the City's approval, please have the appropriate officials sign
one copy of this letter and return it to our office.
