4 A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE A HOLD HARMLESS AGREEMENT
5 WITH MAINLANDS SECTION 6 CIVIC ASSOCIATION, INC.,
FOR INSTALLATION OF A BUS SHELTER ON MAINLANDS 6
6 LEASED PROPERTY; AND PROVIDING AN EFFECTIVE DATE.
3E IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
b SECTION 1: That the appropriate City officials are hereby
authorized to execute a Hold Harmless Agreement with Mainlands
p Section 6 Civic Association, Inc., for installation of a bus
s shelter on Mainlands 6 leased property, a copy of said Hold
7 Harmless Agreement being attached hereto as "Exhibit 1".
3 SECTION 2: That the City Clerk is hereby authorized and
6 directed to record said agreement in the public records of Broward
S County, Florida.
6 SECTION 3: This Resolution shall become effective upon
7 adoption.

HOLD HARMLESS AGREEMENT
This agreement entered into on the day of
1990 is made by and between the City of
Tamarac, a municipal corporation, hereinafter referred to as
the "CITY;" and Mainlands, Section 6 Civic Association Inc.
W I T N E S S E T H:
WHEREAS, the Mainlands Section 6 Civic Association Inc.
wishes to have a bus shelter reinstalled on its leased
property to benefit the residents.
WHEREAS, the City Council of the City of Tamarac has
determined that the execution of this Hold Harmless
Agreement is in the public interest.
NOW, THEREFORE, in consideration of the sum of one
dollar ($1.00) and other good and valuable consideration
received from Mainlands and in consideration of the mutual
covenants contained herein, the parties agree as follows:
SECTION 1 That Mainlands, Section 6 Association
shall hold the City harmless from any and all claims, causes
of action, damages, costs, expenses and attorney fees which
the City shall suffer by virtue of the defense of, or
response to, any claim being made against it in connection
with the positioning of the bus shelter on its property on
the original slab plus 3 feet (1 1/2' on each end) to be
installed by Sid Gold.
SECTION 2 The above provisions shall survive the
termination of this Agreement and shall pertain to any
occurrence during the term of this Agreement, even though
the claim may be made after the termination hereof.
SECTION - 3 That Mainlands Section 6 Civic
Association Inc. shall provide to the City Risk Manager all
necessary Certificates of Insurance in such form and amounts
as required by the Risk Manager.

SECTION 4 The Mainlands section 6 Civic
Association Inc. shall keep such policies of insurance in
full force and effect during the term of this Agreement and
shall provide to the City Risk Manager proof of payment of
the required premiums.
SECTION 5 The Mainlands Section 6 Civic
Association Inc. Risk Manager shall provide the City Risk
Manager the requisite document evidencing that the signatory
of Mainlands Section 6 Civic Association Inc. has the
authority to enter into this Agreement.
SECTION 6 This Agreement shall not be assigned
by Mainlands Section 6 Civic Association Inc. without
receiving City Council approval.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals on the day and year first above written.
