A RESOLUTION APPROVING AND ACCEPTING
TAMARAC UTILITIES WEST AS -BUILT WATER
AND SEWER UTILITY EASEMENTS OFFERED
T BY MIDWAY INVESTMENTS, LTD., FOR THE
MIDWAY PLAZA PROJECT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Tamarac Utilities West As -Built
Water and Sewer Utility easements offered by Midway Investments,
Ltd., for the Midway Plaza project is HEREBY APPROVED AND
ACCEPTED, a copy of said easement being attached hereto as
"Exhibit 1".
SECTION 2: That the appropriate City officials are
hereby authorized to execute said easements on behalf of the
City.
SECTION 3: That the City Clerk is hereby authorized
and directed to record said easements in the public records of
Broward County, Florida.
SECTION 4: This Resolution shall become effective upon
adoption. Olt,

FOR: MIDWAY PLAZA
AS -BUILT TILITY EASEMENTS ("Utility Easements") made this
,�&*4_ day of Getaber,-3988 by MIDWAY INVESTMENTS, LTD., a Florida
limited partnership ("Grantor"), and the CITY OF TAMARAC, a
Florida Municipal Corporation, having an address at 7525
Northwest 88th Avenue, Tamarac, Florida 33321 ("Grantee").
(Wherever used herein, the term "Grantor" and "Grantee" shall in-
clude the respective successors and assigns of the parties
hereto, whenever the context so admits or requires.)
WITNESSETH:
WHEREAS, Grantor is the owner of that certain real property
located in Broward County, Florida, more particularly described
in Exhibit "A" attached hereto (hereinafter referred to as
"Servient Estate"); and
WHEREAS, Grantor desires to grant unto Grantee certain non-
exclusive underground Utility Easements to use a portion of the
Servient Estate ("Easement Areas");
NOW, THEREFORE, in consideration of the sum of Ten Dollars
($10.00) and other good and valuable considerations paid by each
of the parties hereto to the other party, receipt of which is
hereby acknowledged by both parties, the parties hereto do hereby
grant and agree as follows:
1. Grantor hereby grants and conveys to Grantee, its suc-
cessors and assigns, the following non-exclusive underground
Utility Easements under the Easement Areas: (i) a 15-foot sani-
tary sewer easement over the area legally described upon
Exhibit "B-1" attached hereto; (ii) a 15-foot water line easement
over the area legally described upon Composite Exhibit "B-2" at-
tached hereto; (iii) a lift station easement over the area
legally described upon Exhibit "B-3" attached hereto; and (iv) a
15-foot water line easement described upon Exhibit "B-4" attached
hereto. The Utility Easements described above are for the pur-
pose of underground installation and maintenance of those utility
facilities described in the title to each Easement Area set forth
above. Notwithstanding the foregoing, the Grantee shall not have
the right to use any portion of the Easement Areas that may be
covered by buildings or other improvements thereon. Grantor fur-
ther grants to the Grantee the reasonable right to enter upon
other areas of the Servient Estate which are provided from time
to time for parking, open space or access, in order that Grantee
may gain access to the Easement Areas for the purpose of utiliz-
ing the Easement Areas for the purposes provided herein. The
rights provided herein to Grantee are subject to Grantee's obli-
gation to restore and replace any sod, pavement, improvements,
trees and plantings which may be destroyed or damaged as the
result of the exercise of Grantee's utility easement rights
provided for herein.
2. The Utility Easements created hereby are specifically
located under, and limited to the designated purposes and the
designated Easement Areas as set forth and described upon
Composite Exhibits "B-1" through "B-4," inclusive, attached
hereto.
3. Grantor reserves all rights not herein specifically
granted pursuant to these Utility Easements, including, but not
limited to, the right of free ingress and egress over a.id upon
the Easement Areas and to grant further easements under, over and
on the Easement Areas, provided that in no event shall any of the
rights herein reserved impede the Utility Easements herein
granted or the exercise of the rights of use thereunder.
4. The provisions of these Utility Easements shall be bind-
ing on the parties hereto and their respective successors and as-
signs as a covenant running with the binding upon the Easement
Areas.
5. These Utility Easements shall not be released or altered
without consent of the Grantee.
