RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL ACCEPTING
A "COVENANT RESTRICTING DENSITY" OFFERED BY
M.A...FORMAN, TRUSTEE FOR THE WATERSIDE
DEVELOPMENT.
WHEREAS, M.A. Forman, Trustee for the Waterside Development has
executed and presented to the City - a Covenant Restricting Density
on the project, and
WHEREAS, the City Attorney has reviewed said covenant and finds
it to be in order, and
WHEREAS, the City Council wishes to accept the recommendation of
the City Attorney by accepting said covenant,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

14 OF TAMARAC, FLORIDA:
15 SECTION l: That the "Covenant Restricting Density" offered by
M.A. Forman, Trustee for the Waterside Development is hereby accepted
16 subject to approval of plat by Broward County.

COVENANT RESTRICTING DENSITY
This indenture made this 20th day of June , 1978, by
the undersigned,
W I T N E S S E T H:
WHEREAS, M.A. Forman, Trustee, is the fee simple owner of the lands de-
scribed on Exhibit A attached hereto and made a part hereof; and
WHEREAS, the above referred land is being platted and otherwise developed
pursuant to R-2 zoning regulations and density as opposed to R-3 and
R-3-U zoning regulations and density as currently exists on the above
referred land; and
WHEREAS, the purpose of this covenant is to allow the fee simple owner
of the aforesaid described land to avail himself of the lower cash pay-
ment schedule relative to R-2 zoning requirements specifically, that
schedule found in Tamarac Ordinance 76-56 D(b);
NOW THEREFORE, M.A. Forman, Trustee, as owner of the lands on Exhibit A
attached hereto, convenants and agrees as follows:
The proposed plat covering the lands as described hereinafter
referred to as "Waterside" represents the maximum amount of
total units to be developed, said total being 138 in num-
ber and, Grantor covenants for himself, his heirs and assigns
that no additional structures other than those reflected herein -
above shall be developed on the aforedescribed land.
This covenant shall be recorded by the owner upon the approval of the
said site plan and plat by all governmental agencies having jurisdiction.
