CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- 7d' 9._
A RESOLUTION CONCERNING HOUSE BILL 400 AND
SENATE BILL 538 EXEMPTING VOLUNTEER HEALTH
CARE PERSONNEL FROM MALPRACTICE LIABILITY;
STRONGLY URGING REJECTION OF THIS PROPOSED
LEGISLATION BY THE MEMBERS OF THE BROWARD
COUNTY LEGISLATIVE DELEGATION, ALL APPRO-
PRIATE LEGISLATIVE COMMITTEES AND BOTH HOUSES
OF THE FLORIDA LEGISLATURE.
WHEREAS, House Bill 400 and Senate Bill 538 exempting volunteer
health care personnel from malpractice liability has been proposed
for consideration by the Florida Legislature, and
WHEREAS, this proposed legislation has been reviewed by,the
members of the City Council of the City of Tamarac, and
WHEREAS, it is the opinion of the City Council of the City of
Tamarac that the rights and remedies granted volunteer health
personnel in said bill are excessive and potentially dangerous
providing immunity from any civil damages resulting from acts or
omissions in the practice of medical treatment and diagnosis, and
WHEREAS, the wording of.the legislation proposed is overly broad
in effect, covering treatment and diagnosis without liability controls,
thereby inviting abuse and medical experimentation, and
WHEREAS, the Council of the City of Tamarac finds this proposed
legislation to be seriously compromising to the civil rights of
health consumers and not in the best interests of the citizens of
this municipality.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the City Council of the City of Tamarac strongly
opposes the intent of the proposed legislation and urges rejection
of the same.
SECTION 2: That a copy of this Resolution be forwarded to all
municipalities in Broward County, all members of the Broward County
Legislative Delegation, the Majority and Minority Leaders of the
Florida House, the Majority and Minority Leaders of the Florida
Senate, Governor Askew and all members of the Florida Cabinet.
