R-2000-179 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ACCEPT THE DEDICATION OF CERTAIN RETENTION AREAS AND EXECUTE A QUIT CLAIM DEED WITH LENNAR LAND PARTNERS AND LENNAR HOMES, INC. FOR THE GRANVILLE AT KINGS POINT PROJECT; AUTHORIZING AND DIRECTING THE CITY CLERK TO RECORD SAID QUIT CLAIM DEED IN THE PUBLIC RECORD OF BROWARD COUNTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the site plan for the Granville at Kings Point Project located on Granville Drive was approved by City Resolution, No. R-99-24, on May 25, 1994; and WHEREAS, development of the Granville at Kings Point Project requires construction of retention areas "1" through 'A" attached hereto as Exhibit "A"; and WHEREAS, these retention areas are contiguous to the City's canal system and would become a part of the public waterway system upon approval of this resolution; and WHEREAS, a Quit Claim Deed, attached hereto as Exhibit "B", is required to be executed for these retention areas to become part of the public waterway system; and WHEREAS, it is the recommendation of the Director of Public Works that this dedication of retention areas shown in Exhibit "A" be accepted and the Quit Claim Deed as shown in Exhibit "B" to be executed for t.,. Reso. # 8786 Revision 1 — June 2, 2000 Page 2 of 3 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept the dedication of the drainage retention areas and execute a Quit Claim Deed from Lennar Land Partners and Lennar Homes, Inc., for the Granville at Kings Point Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: The appropriate City Officials are hereby authorized to accept the dedication of retention areas 1" through 'A" and execute a Quit Claim Deed, attached hereto as Exhibit "B" from Lennar Land Partners and Lennar Homes, Inc. for the Granville at Kings Point Project located on Granville Drive. Section 3: The City Clerk is hereby authorized and directed to record said Quit Claim Deed in the public record of Broward County. Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not effect the validity of the remaining portions or applications of this Resolution.
