R-2000-185 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING CERTAIN STREETS TO BE ADDED TO PHASE II -A OF THE SEVEN YEAR COMPREHENSIVE STREET IMPROVEMENT PROGRAM TO BE MILLED AND RESURFACED; APPROVING CHANGE ORDER #1 TO THE AGREEMENT WITH WEEKLEY ASPHALT PAVING INC. IN AN AMOUNT NOT TO EXCEED $174,812.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 22, 1998, the City Commission of the City of Tamarac approved the Seven Year Comprehensive Street Improvement Program through Resolution No. R97- 247: and WHEREAS, the City entered into an agreement with Weekley Asphalt Paving, Inc. to resurface approximately 30 miles of streets under Phase II -A of the Seven Year Comprehensive Street Improvement Program as authorized by Resolution # R 99-277; and WHEREAS, the recent completion of stormwater improvements in the Woodlands area allowed certain streets to be ready for resurfacing; and WHEREAS, the City is desirous of restoring local failures at the edge of pavement in certain streets with valley gutter prior to resurfacing, where appropriate; and WHEREAS, Weekley Asphalt Paving agreed to adding the said streets to the contract and to performing the additional gutter restoration at a cost not to exceed $174,812.00, as defined in Change Order #1, attached hereto as "Exhibit 1 "; and WHEREAS, available funds exist in the Road Resurfacing Program budget for said purpose; and WHEREAS, it is the recommendation of the Public Works Director, Temp. Reso. #9063 Page 2 June 19, 2000 Purchasing/Contracts Manager and Acting City Engineer to add additional streets and cexecute Change Order #1 with Weekley Asphalt Paving Inc, as described in "Exhibit 1 "; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute Change Order #1 with Weekley Asphalt Paving Inc in an amount not to exceed $174,812,00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing WHEREAS clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The list of streets to be milled and resurfaced, identified in "Exhibit 1", is HEREBY APPROVED. SECTION 3: The appropriate City Officials are HEREBY AUTHORIZED to execute Change Order #1 with Weekley Asphalt Paving Inc for resurfacing additional streets and restoring valley gutter, a copy of said change order is being hereto attached as "Exhibit 1 ". SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are HEREBY REPEALED to the extent of such conflict. SECTION 5: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable. The repair shall include: • Removing existing damaged gutter, • Grading and leveling of the gutter base as necessary to adjust to new asphalt level • Compaction of the gutter base to a density of at least 95% of the maximum density, as determined by the Modified Proctor Test, • Disposal of excavated material, • Placement of Class I concrete valley gutter (24" wide) in accordance with FDOT Specifications 520 (FDOT Standard Specifications for Road and Bridge Construction). The finished surface shall be flush with the existing asphalt. It shall be placed and finished in a manner that provides for continuity of the longitudinal and cross slopes of the existing roads. Such streets could not be paved before the stormwater improvements are completed. Those streets, identified in Table 1, are being added to the open- ended contract with Weekely Asphalt Paving. The City is desirous of restoring local failures at the edge of pavement in certain streets with valley gutter.
