A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO SUBMIT AN
APPLICATION TO THE FLORIDA DEPARTMENT OF
AGRICULTURE AND CONSUMER SERVICES FOR AN
URBAN AND COMMUNITY FORESTRY GRANT IN THE
AMOUNT OF $10,000 FOR THE REFORESTATION OF
MCNAB PARK; PROVIDING FOR A MAINTENANCE
MEMORANDUM OF AGREEMENT BETWEEN THE CITY
AND THE DEPARTMENT OF AGRICULTURE IN THE
EVENT THE AWARD IS ACCEPTED; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac realizes that trees provide
many benefits to residents including energy conservation, wildlife habitat, decreased
stormwater runoff and cleaner air; and
WHEREAS, the City of Tamarac realizes the importance of restoring and expanding
the tree canopy within the City; and
WHEREAS, McNab Park has been invaded by exotic species which must be cleared
and should be reforested with native species; and
WHEREAS, the Department of Agriculture and Consumer Services through the Urban
and Community Forestry Grant Program provides funds to municipalities for the expansion
of open space and forest cover; and
WHEREAS, should the application be approved and award accepted, the City agrees
to maintain the trees which are the subject of this application on an ongoing basis; and

WHEREAS, the application process requires that the City of Tamarac indicated that it
will maintain the trees and agrees to, upon approval of the application and acceptance of
the award, execute a Maintenance Memorandum of Agreement with the Department of
Agriculture; and
WHEREAS, the City Manager and the Director of Parks and Recreation recommend
filing of the application attached hereto as Exhibit A; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the residents to submit an application to the Florida Department of Agriculture
and Consumer Services Urban and Community Forestry Grant Program in the amount of
$10,000 for the expansion of open space within the City through the reforestation of McNab
Park.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this resolution.
Section 2: The appropriate City officials are hereby authorized to submit the Urban
and Community Forestry Grant Application attached hereto as Exhibit A and made a part
hereof.
Section 3: It is hereby agreed that the City will maintain the trees on an ongoing basis
and will enter into a maintenance memorandum of agreement, a sample of which is included
on page 60 of the State of Florida Request for Proposal (attached hereto as "Exhibit B"), with
the Department of Agriculture and Consumer Affairs should the application be approved and
award accepted.

Section 4: All resolutions in conflict herewith are hereby repealed to the extent of such
conflict.
Section 5: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or in application,
it shall not affect the validity of the remaining portion or applications of this Resolution.
Section 6: This Resolution shall become effective immediately upon its adoption.

GENERAL CONDITIONS
SEALED PROPOSALS: All proposal sheets and this original acknowledgment form must be
executed and submitted in a sealed envelope. (DO NOT INCLUDE MORE THAN ONE PROPOSAL
PER ENVELOPE.) The face of the envelope shall contain, in addition to the above address, the date
and time of the proposal opening and the proposal number, Proposal prices not submitted on attached
proposal price sheets when required shall be rejected. All proposals are subject to the conditions
specified herein. Those which do not comply with these conditions are subject to rejection.
1. EXECUTION OF PROPOSAL: Proposal must contain a.manual signature of authorized
representative in the space provided above. Proposal must be typed or printed in ink. Use of
erasable ink is not permitted. All corrections made by proposer to his proposal price must be
initialed. The company name and SPURS vendor number shall appear on each page of the bid
as required. Complete ordering instructions must be submitted with the proposal. If you are not a
registered vendor with the Department of Management Services. contact State Purchasing, 4050

2. NO PROPOSAL SUBMITTED: If not submitting a proposal, respond by returning
only this proposer acknowledgment form, marking it "NO PROPOSAL" and explain the reason in
the space provided above. Failure to respond to a procurement solicitation without giving justifiable
reason for such failure, non-conformance to contract conditions, or other pertinent factors deemed
reasonable and valid shall be cause for removal of the supplier's name from the proposal mailing
list. NOTE: To quality as a respondent, proposer must submit a "NO PROPOSAL", and it must
be received no later than the stated proposal opening date and hour.
3. PROPOSAL OPENING: Shall be public, on the date, location and the time specified on
the acknowledgment form. It is the proposer's responsibility to assure that his proposal is delivered
at the proper time and place of the proposal opening. Proposals which for any reason are not so
delivered, will not be considered. Offers by telegram or telephone are not acceptable. A proposal
may not be altered after opening of price proposals. NOTE: Proposal tabulations will be furnished
upon written request with an enclosed, sell addressed, stamped envelope and payment of a
predetermined fee. Proposal files may be examined during normal working hours by appointment.
Proposal tabulations will not be provided by telephone.
4. PRICES, TERMS AND PAYMENT: Firm prices shall be proposed and include all
services rendered to the purchaser,
(a) TAXES: The State of Florida does not pay Federal Excise and Sales taxes on direct
purchases of services. See tax exemption number on face of purchase
order. This exemption does not apply to purchases of services in the performance of contracts
for the improvement of state-owned real property as defined in Chapter 192. F. S.
(b) DISCOUNTS: Cash discounts for prompt payment shall not be considered
in determining the lowest net Cost for proposal evaluation purposes.
(C) MISTAKES: Proposers are expected to examine the conditions, scope of work, proposal
prices, extensions, and all instructions pertaining to the services involved. Failure to do so
will be at the proposer's risk. Unit prices bid will govern in award.
(d) INVOICING AND PAYMENT- The contractor shall be paid upon submission
of properly certified invoices to the purchaser at the prices stipulated on the contract
at the time the order is placed, after delivery and acceptance of goods, less deductions
if any, as provided. Invoices shall contain the contract number, purchase order
number and the contractor's SPURS vendor number. An original and three
(3) copies of the invoice shall be submitted.The final payment shall not be made until after the
contract is complete unless the State has agreed otherwise. Invoices for lees or other
compensation for services or expenses submitted in aeoordanoe with the rates at or below
those specified in Sections 112.061 and 287,058, F.S.INTEREST PENALTIES: Payment
shall be made in accordance with Section 215,422, F.S., which states the
contractor's rights and the State agency's responsibilities concerning interest
penalties and time limits for payment of invoices. VENDOR RESPONSE SYSTEM: To access
an interactive Voice Response System for vendor payment inquiry, Vendors may call (850)
413.7269 between 7 a.m. and 6 p.m. Monday through Friday to check on the status of payments
by State agencies. The system can accommodate English and Spanish speaking callers.
VENDOR OMBUDSMAN: Vendors providing goods and services to an agency should be aware
of the following time frames. Upon receipt, an agency has five (5) working days to inspect and approve
the goods and services, unless the bid specifications, purchase order or contract specifies
otherwise. An agency has 20 days to deliver a request for payment (voucher) to the Department
of Banking and Finance. The 20 days are measured from the latter of the date the invoice is
received or the goods and services are received, inspected and approved. If a payment is not
available within 40 days, a separate interest penalty set by the Comptroller pursuant to Section
55.03 F.S., will be due and payable, in addition to the invoice amount, to the vendor. To obtain
the applicable interest rate, contact the agency purchasing office. The interest penalty provision
applies after a 35 day time period to health care providers. as defined by rule. Interest penalties
of less than one (1) dollar will not be enforced unless the vendor requests payment. Invoices
which have to be returned to a vendor because of vendor preparation errors will result in a
delay in the payment. The invoice payment requirements do not start until a property completed
invoice is provided to the agency. A Vendor Ombudsman has been established within the
Department of Banking and Finance. The duties of this individual include acting as an advocate
of vendors who may be experiencing problems In obtaining timely payment(s) from a State
agency The Vendor Ombudsman may be contacted a (850) 488.2924 or by calling the Slate
Comptroller's Hotline, 1-800.848.3792. State Purchasing shall review the conditions and
circumstances surrounding non-payment, and unless there is a bona fide dispute, State
Purchasing may, in writing, authorize the contract supplier to reject and return purchase orders
from said agency until such time as the agency complies with the provisions of Section 215.422, F.S.
(e) ANNUAL APPROPRIATIONS: The State of Florida's performance and obligation to
pay under this contract is contingent upon an annual appropriation by the Legislature.
5. CONFLICT OF INTEREST: The award hereunder is subject to the provisions of Chapter
112, F.S. Proposers must disclose with their proposal the name of any officer, director, or agent
who is also an employee of the State of Florida, or any of its agencies. Further, all proposers must
disclose the name of any State employee who owns, directly or indirectly, an interest of five (5%) or
more in the proposer's firm or any of its branches. In accordance with Chapter 287, FS., no
person or firm receiving a contract that has not been procured pursuant to Section 287.057(2) or
(3), F.S., to perform a feasibility study of the potential implementation of a subsequent contract,
participating in the drafting of a request for proposals, or developing a program for future
implementation shall be eligible to contract with the agency for any Contracts dealing with that
specific subject matter: and proposers must disclose with their proposal any such conflict of interest.

Urban and Community Forestry (U&CF) grant funds
provided through the U.S.D.A. Forest Service are
administered in each of the fifty states through the office of
the State Forester.
The State Foresters provide national leadership for the
implementation of U&CF programs at the state level. The
National Association of State Foresters works closely with
members of Congress, national conservation organizations
and its federal partner, the U.S.D.A. Forest Service, to
provide for adequate urban and community forestry funding,
a responsible national U&CF policy and progressive action
to manage and replant our nation's community forests.

CHANGES IN THE URBAN AND COMMUNITY FORESTRY (U&CF) GRANT PROGRAM
FOR FY 2000.
1. In RFP/DF-00/01-01 the Florida Department of Agriculture and Consumer Services
recommends that proposers not expect to receive a fully -executed memorandum of
agreement and authorization to begin the project before March of 2001 and schedule
proposed projects accordingly.
2. For 2000,35 percent ($174,270) of the total grant funds will be allocated for demonstration
tree planting.
3. A total of $497,918 in Urban and Community Forestry Grant funds will be available
for 2000 ($159,306 for Population Zone #1, $159,306 for Population Zone #2, $159,306
for Population Zone #3 and $20,000 for statewide projects).
4. The maximum allowable assessment for in -kind matching costs for general labor (non-
professional) is $10.00 per hour.
5. Successful proposers will have until September 30, 2002 to complete the projects.
6. All products (brochures, signs, videos, reports, etc.) Funded by a U&CF grant must display
the following statement:
"Funding for this project provided by the USDA Forest Service
through the Florida Division of Forestry's Urban and Community
Forestry Grant Program."
7. Proposer workshops (4) will be held in Tallahassee, Gainesville, Okeechobee and Ft.
Lauderdale.

1.1 INTRODUCTION. The growth of our national population and
the accompanying development of urban centers and the
surrounding rural areas has resulted in the continual loss of
natural areas and tree cover.. Trees provide many benefits to
people living in cities and towns including energy
conservation through shade, wildlife habitat, decreased
stormwater runoff, cleaner air, production of oxygen, removal
of carbon dioxide and increased property values. It is
through these and other benefits that trees contribute to the
health, safety and welfare of people living in cities and
towns. Studies have shown that in our cities more trees are
removed than are planted and that the average lifespan of a
tree in inner city areas is only seven years.
1.2 STATEMENT OF PURPOSE. The purpose of Florida's U&CF
Grant Program is to provide financial assistance to local
governments, Native American Tribal Governments, volunteer
groups, nonprofit organizations and educational institutions
to cost -share enhanced urban and community forestry programs
and improve the environment within the State of Florida. The
State of Florida has been allocated $497,918 for federal
Fiscal Year 2000. The primary purpose of the U&CF grant
program is not beautification through tree planting, but to
develop and enhance Urban and Community Forestry programs.
Total funding available for demonstration or site specific
tree planting prolects is limited to 35% of available funds
174 270 and tree planting projects are limited to a maximum
award of $10 , 000 per _proposer.

(2) "Proposal" means an Urban and Community
Forestry Grant Proposal Form and its required
attachments and supporting documentation not
to exceed a total of 30 one-sided pages,
including maps and plans.
(3) "Center Manager" or "District Manager" means
the Division of Forestry administrative
official, or his/her designee responsible for
all forestry activities within a multi -county
administrative unit, pursuant to Florida
Statute 589.30.
(4) "Chief Executive Officer" means the chief
administrative employee of a local government,
nonprofit organization or educational
institution.
(5) "Commissioner" means the Commissioner of
Agriculture for the State of Florida.
(6) "Department" or "FDACS" means the Florida
Department of Agriculture and Consumer
Services, an agency of the State of Florida.
(7) "U&CF Grant Coordinator" means the Division of
Forestry employee designated by the State
Forester to coordinate implementation of the
grant program.
(8) "U&CF Subcommittee" means the subcommittee
assigned by the State Forester to score and
rank the qualifying proposals.
(9) "Local Government" means a county government,
a municipality (an incorporated city, town, or
village), a school board district or an
independent special district.
(10) "Nonprofit Organization" means an organization
which has filed an application with the
Secretary of State of Florida for nonprofit
corporate status pursuant to Section 617,
Florida Statutes, and has been issued a
federal employer identification number by the
Internal Revenue Service.
(11) 11RFP11 means Request For Proposal.

(b) A resolution or letter approving the
proposal and authorizing the Chief
Executive Officer of the proposer to
execute agreements and documents
associated with the grant request must be
submitted as part of the proposal.
(c) A budget detailing all costs of the
project must be submitted with the
proposal.
(d) Signing and sealing of tree planting
plans (site plans) submitted for
consideration under this grant program
shall be in accordance with Section
481.329(7), Florida Statutes (Landscape
Architecture).
(2) By September 15, 2000, the U&CF Grant
Coordinator shall forward to the U&CF
Subcommittee all qualifying proposals for
their evaluation and prioritization.
(3) The U&CF Grant Coordinator shall maintain a
file of all qualifying proposals received. A
permanent log shall be maintained to track
proposal status.
1.7 PRIORITIZED LIST OF ALL PROPOSALS. The U&CF Subcommittee
shall develop a prioritized list of all proposals which the
U&CF Grant Coordinator has determined to be complete.
(1) The U&CF Subcommittee shall evaluate each
proposal based upon how well the proposal meets the
purpose of the grant program (see 1.2 STATEMENT OF
PURPOSE). Total possible score is 115 points.
(See RFP SPECIFICATIONS: MINIMUM DEPARTMENTAL
REQUIREMENTS, Section I.E., titled Proposal Evaluation
Criteria). Scoring of proposals is based upon the
following prioritized and weighted attributes:
(a) Urban Forestry Program Development -
20 points
(b) Demonstrated Need - 20 points
(c) Previous U&CF Grant Status - 15, 8
or 0 points
(d) Well Defined Goals and Objectives -

fully executed within a period of sixty (60) days
of receipt. Failure to comply with this schedule
may result in the grant offer being withdrawn.
(2) Proposers should be aware that they may not receive
a fully -executed grant memorandum of agreement
before March of 2001 and should schedule their
projects accordingly.
(3) The Grant Memorandum of Agreement prepared between
the Department and the Proposer shall stipulate:
(a) What is to be accomplished with the grant.
(b) The schedule and payment terms.
(c) The schedule and content of progress reports.
(d) Any penalties or actions that the Department
will take in the event of noncompliance.
(e) The methods to be used by the Department to
determine compliance with the terms of the
grant agreement.
(f) Maintenance responsibilities for trees planted
as part of the grant program.
2.1 REVIEW OF PROJECTS IN PROGRESS AND UPON COMPLETION. The
Department shall ensure that the terms of the agreements
executed under these guidelines are enforced.
(1) The U&CF Grant Coordinator or his designee shall
review the projects prior to final acceptance by
the Department.
(2) All projects must be completed by September 30,
2002.

B. Tree Inventories - for the development of a local tree
inventory/hazardous tree inventory on non-federal public
properties. (Includes parks, rights -of way and preserves).
This can include the purchase of hardware, software and
field data recorders.
C. Management plans - for the development of a management
plan for the protection, preservation or maintenance of
urban trees on non-federal public properties.
D. Master plans - for the development of a local master
plan, which addresses existing trees and proposed
additions to the vegetative canopy on public properties.
E. In-house training - for the development of (or
improvement of) an in-house Urban and Community Forestry
training package.
F. Staffing - for the employment of an urban forestry
professional, technician or consultant. The U&CF grant
is to help local governments get programs started and is
not meant to be a continual funding source for staffing.
Staffing is limited to three grant years of funding from
the U&CF grant unless the project has statewide impact.
G. Student internships - for the employment of a student
intern in Urban Forestry or a student from a related
field of study for the development of or improvement of
an Urban and Community Forestry Program.
H. Equipment - for the purchase of any related equipment
which will improve an existing Urban and Community
Forestry Program. (ex: water wagons or water trucks, tree
spades, green house equipment, shovels, hoses, etc.)
Category 2. Demonstration or Site Specific -Projects
Qualified Applicants: Local Governments, Native -American
Tribal Governments, Nonprofit Organizations and Educational
Institutions.
This category is typified by the actual implementation of
examples of applied urban forestry principles. Highest
priority will be given to the application of techniques which
are highly visible and demonstrate correct urban forestry
principles. Species diversity, native species and site
limitations should be considered when planning a project.
Total grants in category 2A (site specific tree planting
projects) will not exceed 35% of available state funds. All
plant materials must meet the Division of Plant Industry's
standards for a Florida Grade #1 specimen or be of equivalent

Invasive Species may not be planted as any
part of this grant program; on the internet at
(www.fleppc.org).
f. Maximum allowable cost per tree or palm is
$250.00 for purchase and planting.
g. Written approval is required (as part of
the proposal) from the Florida Department of
Transportation for planting and maintenance on
the state right-of-way.
h. Successful proposers will not be reimbursed
for the purchase of multi -stemmed trees with
the exception of the following species: Green
Buttonwood, Silver Buttonwood, Yaupon Holly
Crape Myrtle, and Chickasaw Plum.
i. A maximum of ten (10) dollars per tree may
be spent on planting materials and/or
supplemental watering during the 60 day row -
in period only.
j. Up to ten (10) percent of the grant award
may be spent on those approved sited site -
preparation costs directly related to the tree
planting.
k. Successful applicants may rent equipment
with which to plant the trees or palms. The
maximum allowance is ten (10) percent of the
grant award.
1. Proposals must include: (1) a detailed
planting plan (site plan) which shows the
location of the trees/palms, existing
structures, and site limitations such as
underground utilities and overhead wires (2) a
location map, and (3) a minimum of three color
photographs (prints only) of the planting
site.
B. Demonstration tree protection proiects - for the
development and installation of a demonstration tree
protection project. Funds are for the purchase of
materials, rental equipment, labor for installation and
associated interpretive (educational) materials. The
maximum grant award for demonstration tree planting is
$10,000.00

(leaflets, newsletters, handbooks, videos) for distribution to
the general public, or to cost -share seminars, training
sessions and workshops on Urban and Community Forestry topics.
The emphasis here is on informing and training the general
public, volunteer groL.ps, technicians, tree workers, etc.
(i.e., Urban and Community Forestry technology transfer). A
resolution or letter signed by the chief executive officer of
the proposer is required which states that they concur with
the proposal packet and will sign a Grant Memorandum of
Agreement if awarded a Grant. (This resolution or letter must
be submitted as part of the proposal' packet). The maximum
grant award for this category is $5,000. Grant funds may not
be used for personnel costs in this category.
Subcategories:
A. Educational programs - for the exhibition, purchase or
development of materials for the benefit of public
education in Urban and Community Forestry.
B. Arbor Day Programs - for the development, planning,
advertising and organizing of a local Arbor Day Program.
C. Workshops Training Sessions Conferences Seminars - for
the support and organization of public programs which
benefit Urban and Community Forestry. Costs may cover
mailing, speaker's travel expenses, audio/visual
equipment rental and related expenses.
D. Youth ro rams - for the development and production
of Urban and Community Forestry Programs which will
involve/benefit young people, K through college level.
E. Public service materials (PSA development) - for the
development of or purchase of public service programs,
videos, or slide shows which educate the public in
principles of Urban and Community Forestry. These may
include expenditures for film, paper, production costs,
equipment rental or other accessories (excluding the
purchase of camera or other video equipment).
F. Volunteer trainin - for the development, production
and presentation of an Urban and Community Forestry
Training Program to interested volunteer individuals or
organizations.
G. Brochures - for the purchase of existing technical
brochures or the design, development, production or
mailing of an educational or informational brochure
stressing the importance of any aspect of Urban and
Community Forestry and the principles involved. Those
desiring brochures are encouraged to utilize existing
brochures, if brochures exist, and apply for funding for

f. A 50:50 match is required (50% grant: 50%
proposer). The local match must be in non-federal
dollars or contributions of materials and/or
services.
2. Other Special Requirements
a. Upon award of a grant, successful
proposers must solicit and document two
or more verbal quotes for all
purchases/expenditures over $1,000.00 and
less than $5,500.00. A minimum of three
written quotes or a formal bid process is
required for all purchases/ expenditures
over $5,500.00 and less than 15,000.
Sealed bids are required for all
purchases over $15,000. Justification
must be provided for a sole source award
or for an award to a vendor other than
the vendor submitting the lowest bid or
quote.
b. Category 2 proposals must be for planting
trees on non-federal public land or

C. Grants are for projects not currently
budgeted, and may not be used to replace
existing commitments.
d. No overhead costs will be paid by grant
funds. Overhead costs, up to 5% of the
total project cost (match + award), can
be used as part of the local match.
e. Successful proposers will be required to
sign a Grant Agreement (contract) prior
to initiation of work on the Droiect.
Projects in which grant funds are used to

Maintenance Agreement.

and explains clearly all project costs (including
matching costs and/or services).
6. Method of Reimbursement
Pursuant to Florida Statutes Section 216.181
paragraph 14(b) advance payment may be made upon
written request. The amount which shall be advanced
shall not exceed the cash needs of the grant
recipient for the initial 3 months of the
agreement. Thereafter, quarterly disbursements
will be made on a reimbursement basis. Upon receipt
by the Division of Forestry of a reimbursement
summary sheet with all required attachments
including invoices and/or receipts, and canceled
checks, payrolls, log sheets, etc., the FDACS will
submit the claim for payment. No more than 75
percent of the grant amount will be paid to the
Grantee prior to Certification of Acceptance by the
Department. The final payment shall not be made
until Certification of Acceptance is received from
the U&CF Grant Coordinator. Upon receipt in the
Tallahassee State Office of the reimbursement
summary sheet and copies of invoices and checks
paid, the Department will place the claim in line
for payment. Payment shall be made in accordance
with Section 215.422, Florida Statutes, which
states the contractor's rights and the state
agency's responsibility concerning interest
penalties and time limits for payment of invoices.

ANY WORK PERFORMED ON THE PROJECT AND/OR ANY

Highest score will be given to proposals which provide
documentation indicating that the proposer (applicant) is
progressing in its capacity to build a sustained program
and/or address urban and community forestry needs.
2. Demonstrated Need - 2O__points
Highest score will be given to proposals which
demonstrate an economic need for cost -share dollars and
impact large numbers of people.
3. Previous U&CF Grant Status -
15 points will be given to proposers that have not been
previously awarded an U&CF grant. 8_points will be given
to proposers that received only one grant previously.
Proposers that have received two or more grants will
receive 0 points.
4. Well -Defined Goals and Objectives - 18 points
Highest score will be given to proposals that clearly
state goals and objectives that will expand/compliment
existing U&CF efforts. These goals should reflect the
purpose of the program identified in Section 1.2 on
pages 7 and 8.
5. Environmental Value - 15 points
Highest score will be given to proposals which clearly
demonstrate and explain multiple environmental benefits.
6. Cost Effectiveness _ 12 points
Proposals that clearly demonstrate maximum results and
the efficient use of grant dollars will score highest.

The Department shall consider the employment by any Contractor
of Unauthorized aliens a violation of section 274(a) of the
immigration and Naturalization Act. If the Contractor
knowingly employs Unauthorized aliens, such violation shall be
caused for unilateral cancellation of this contract.
2. Audits
The Contractor shall maintain books, records and documents
directly pertinent to the performance under this contract in
accordance with generally accepted accounting principles
consistently applied. The DACS, the State or their authorized
representatives shall have access to such records for audit
purposes during the term of the contract and for three years
following the contract termination date or date of final
payment, which ever is later. If an audit, litigation or
other action involving the records is started before the end
of the three year period, the records must be retained until
all issues arising out of the action are resolved, or until
the end of the three year period, whichever is later.
In accordance with federal laws and regulations, the
Contractor agrees to comply with audit requirements, as
applicable, to the Office of management and Budget (OMB)
Circular A-133. Any contract resulting from a bid developed
for any division where federal funds are distributed, shall be
in compliance with these circulars. Copies of the latest
versions of the referenced circulars are available for review
by proposers at the Department's Purchasing Office.

Vendors providing goods and services to an agency should be aware of the
following time frames. Upon receipt, an agency has five (5) working days to
inspect and approve the goods and service, unless the bid specifications,
purchase order or contract specifies otherwise. An agency has 20 days to
deliver a request for payment (voucher) to the Department of Banking and
Finance. The 20 days are measured from the latter of the date the invoice is
received or the goods or services are received, inspected and approved.
If a payment is not available within 40 days, a separate interest penalty of
.02740 percent per day will be due and payable, in addition to the invoice
amount, to the vendor. Payments to health care providers for hospital, medical
or other health care services, shall be made not more than 35 days from the
date eligibility for payment is determined, and the daily interest rate is .03333
percent. Interest penalties of less than one (1) dollar will not be enforced
unless the vendor requests payment. Invoices which have to be returned to a
vendor because of vendor preparation errors will result in a delay in the
payment. The invoice payment requirements do not start until a properly
completed invoice is provided to the agency.
A Vendor Ombudsman has been established within the Department of Banking
and Finance. The duties of this individual include acting as an advocate for
vendors who may be experiencing problems in obtaining timely payments(s)
from a state agency. The Vendor Ombudsman may be contacted at (850)488-

DRUG -FREE WORKPLACE PROGRAM - BIDDER CERTIFICATION
IDENTICAL TIE BIDS - Preference shall be given to businesses with drug- free workplace
programs. Whenever two or more bids which are equal with respect to price, quality, and
service are received by the State or by any political subdivision for the procurement of
commodities or contractual services, a bid received from a business that certifies that it has
implemented a drug -free workplace program shall be given preference in the award process.
Established procedures for processing tie bids will be followed if none of the tied vendors have
a drug -free workplace program. In order to have a drug -free workplace program, a business
shall:
1) Publish a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the workplace
and specifying the actions that will be taken against employees for violations of such
prohibition.
2) Inform employees about the dangers of drug abuse in the workplace, the business's
policy of maintaining a drug -free workplace, any available drug counseling,
rehabilitation, and employee assistance programs, and the penalties that may be
imposed upon employees for drug abuse violations.
3) Give each employee engoged in providing the commodities or contractual services that
are under bid a copy of the statement specified in subsection (1)
4) In the statement specified in subsection (1), notify the employees that, as a condition
of working on the Conuno(lities or contractual services that are under bid, the
employee will abide by the terms of the statement and will notify the employer of any
conviction of, or plea of guilty or nolo contendere to, any violation of chapter 893 or
of any controlled substance law of the United States or any state, for a violation
occurring in the workplace no later than five (5) days after such conviction.
5) Impose a sanction on, or require the satisfactory participation in a drug abuse
assistance or rehabilitation program if such is available in the employee's community,

Urban and Community Forestry Grant Proposal
The City of Hometown, Florida located in central Florida, has
a population of 150,000 according to the 1990 census.
Hometown, Florida grew rapidly in the early 1970's and very
little of the existing tree canopy was left after the development.
Fortunately, the city had the foresight to start a tree planting
campaign in 1988. The goal of the tree planting program is to
plant all current planting spaces (5,000) by the year 2001.
The city has successfully utilized the volunteer services of
local Rotarians, Boy Scouts, Girl Scouts and garden clubs to plant
more than 10,000 trees along public right of ways and in parks
since 1988. The City applied and received a SBA Tree Planting
Grant for $20,000 in 1991 and planted 200 trees in a downtown
business area. The city has already maintained these trees for 3
years, however, continued maintenance such as pruning, weeding,
fertilization and watering is still needed. The city is committed
to continuing the success of the tree planting program and has
been a Tree City USA since 1985 and has received the Tree City USA
Growth Award each of the last 4 years. Unfortunately, the city
currently lacks the resources to continue this large-scale tree
planting campaign due to costs associated with maintenance of the
newly planted trees.
The City of Hometown would like to start a citizen forester
program entitled "Partners In Green" to allow the city to continue
its tree planting campaign. There are many benefits to
developing a citizen forester program:
1.. Developing public support for our urban forestry program.
2. Educating the public in proper tree care.
3. Better care of, young trees resulting in decreased
maintenance costs now and later.

WHEREAS, trees are an important part of our community: and
WHEREAS, the City of Hometown wants to maintain its newly

WHEREAS, the City of Hometown desires to apply for an Urban and
Community Forestry Grant which would provide monies in which to
help fund the citizen forester program; and
WHEREAS, the City of Hometown wishes to enter into an
Urban and Community Forestry Grant Memorandum of
Agreement between the City of Hometown, Florida and the
Florida Department of Agriculture and Consumer Services;
NOW, THEREFORE, BE IT RESOLVED by the City Council of

This agreement, made and entered into this the day of
, 20 by and between the STATE OF FLORIDA DEPARTMENT OF
AGRICULTURE AND CONSUMER SERVICES, an agency of the State of Florida,
hereinafter called the "Department" and ,
hereinafter called the Entity (Subrecipient).
WITNESSETH
WHEREAS, the Department desires to increase the application of the
principles of urban and community forestry by granting funds to the
Entity (Subrecipient)for the purpose as outlined in grant application
Number , included herein as Exhibit A and by reference
made a part hereof:
WHEREAS, the Department and the Entity (Subrecipient) are of the
opinion that the citizens of the state would benefit from the
implementation of urban and community forestry projects that improve our
communities through the proper care of trees and related plant materials;
WHEREAS, the Department has awarded the Entity (Subrecipient)an
urban forestry grant for the specific project set forth in the U&CF Grant
Application Number , hereinafter the "project";
WHEREAS, the Entity (Subrecipient) by Resolution No. ,
dated , has indicated its support of the grant
application and authorized its officers to execute this Agreement on its
behalf;
WHEREAS, the parties hereto mutually recognize the benefits of such
a project as described in the U&CF Grant application and the need for
entering into an agreement designating and setting forth the
responsibilities of each party;
NOW THEREFORE, for and in consideration of the mutual benefits that
flow each to the other, the parties covenant and agree as follows:
1. Failure by the Entity (Subrecipient) to sign and return this
agreement by shall constitute forfeiture of the
award.
2. The effective date of this agreement is 20
3. The Entity (Subrecipient)shall complete the project by September
30, 2002 as set forth in the Urban and Community Forestry Grant
Application Number approved by the Department on
during which time the grant shall continue in effect.
The criteria for the project is set forth therein. The final date by
which such criteria must be met for completion of this agreement is
September 30, 2002.
The project to be performed by the Entity (Subrecipient) shall be subject
to periodic inspections by the Department. The Entity (Subrecipient)
shall not change or deviate from the project without written approval by
the Department.
4. The Entity (Subrecipient) has estimated the project cost to be
$ as shown on the grant application budget sheet attached as
Exhibit B. The Department agrees to reimburse to the Entity
(Subrecipient)the total sum of $ or fifty percent. (50t) of the
final approved project costs, whichever is less (the "Grant Amount"). The

business with any public entity in excess of the
threshold amount provided in Section 287.017, for
Demonstrated or Site Specific Projects, for a period of
36 months from the date of being placed on the convicted
vendor list.
5. The Entity (Subrecipient) agrees to maintain plant materials
established as a part of the project for a period of three years and
enter into an agreement which designates and sets forth the duties and
responsibilities of the parties in maintaining the project.
6. The Entity (Subrecipient) agrees to submit to the Department
an interim report on project accomplishments by , 20
and a final report summarizing project accomplishments as a prerequisite
to final acceptance by the Department. Failure to submit a required
report or submission of an unsatisfactory report is sufficient grounds
for termination of this agreement according to the provisions of Section
7(b). The Entity (Subrecipient) upon project completion shall submit a
news release to local newspaper media highlighting the successes of the
project.
7. This Agreement may be terminated under any one of the following
conditions:
(a) By the Department, unilaterally, for refusal by the Entity
(Subrecipient) to allow public access to all documents, papers,
letters, or other material subject to Chapter 119, F.S. and
made or received by the Entity (Subrecipient) in conjunction
with this Agreement.
(b) By the Department, if the Entity (Subrecipient) fails to
perform its duties under this Agreement, following thirty
(30)calendar days written notice by the Department.
(c) By either party following sixty (60) calendar days written
notice.
(d) By both parties following the complete execution by both
parties of an agreement to terminate this Agreement.
(e) Notice to Entity (subrecipient) : The Department shall consider
the employment by any entity (subrecipient) of unauthorized
aliens a violation of section 274A(e) of the Immigration and
Nationalization Act. Such violation shall be cause for
unilateral cancellation of this agreement.
8. Notwithstanding any provision of this Agreement to the contrary
but subject to Subparagraph 7(b), in the event this Agreement is
terminated before the Department has paid the Entity (Subrecipient) the
entire Grant Amount, then the Department agrees to pay the Entity
(Subrecipient) the entire Grant amount, if the project has been
completed. If the project has not been completed, the Department shall
pay to the Entity (Subrecipient) a percentage of the Grant amount equal
to the percentage of the project's completion.
9. Extension of a contract for contractual services shall be in
writing for a single period only not to exceed six (6) months and shall
be subject to the same terms and conditions set forth in the initial
contract. There shall be only one extension of a contract unless the
failure to meet the criteria set forth in the contract for completion of
the contract is due to events beyond the control of the Contractor. If
initially competitively procured, contracts for contractual services may
be renewed on a yearly basis for no more than two (2) years, or for a
period no longer than the original contract, whichever period is longer.

(a) The Department and the Comptroller before disbursing any funds
must independently ensure that the proposed expenditure is in
accordance with all legal and regulatory requirements and that
this contract specifically prohibits the use of funds for the
purpose of lobbying the Legislature, the Department, the
Judicial Branch, or any state agency.
(b) If the Entity (Subrecipient) is a local government agency,
nonprofit organization, or not -for -profit organization it
shall: (I) for amounts $25,000 or less, have its head attest
that it has complied with grant provisions, (ii) for amounts
greater than $25,000 but not more than $100,000 have a grant-.
specific audit performed in accordance with the rules of the
Auditor General or have a statement prepared by an independent
certified public accountant which attests that the grant
provisions have been complied with,(iii) for amounts greater
than $100,000, have a grant -specific audit performed in
accordance with the rules of the Auditor General, and (iv) have
such audits, statements, or attestations filed with the
Department and the Auditor General.
18. If this agreement contains federal funding in excess of
$100,000, the Entity (subrecipient) must, prior to agreement execution,
complete the Certification Regarding Lobbying form. If a Disclosure of
Lobbying Activities, Standard Form LLL, is required, it may be obtained
from the Department. All disclosure forms as required by the
Certification Lobbying form must be completed and returned to the
Department.
19. The undersigned Entity (Subrecipient) receiving federal
financial assistance under this agreement hereby acknowledges and agrees
that it will comply with the applicable provisions of the latest version
of Office and Management Budget Circular No. A-133 - Revised June 24-,
1997 (Audits. of States, Local Governments, and Non-profit Organizations).
Copies of the latest version of the above which would relate to the
undersigned Entity (Subrecipient)are available for review at the
following address:

If the undersigned Entity (Subrecipient) expends $300,000 or more in

Circular No. A-133 (Audits of State, Local Governments, and Non-profit

WHEREAS, the Department desires to increase the general level of knowledge of the
principles of urban and community forestry by granting funds to the Entity(Subrecipient) for the
establishment of a demonstration tree planting project as outlined in the Urban and Community
Forestry grant application Number and Grant Memorandum of Agreement (the "Grant
Agreement") attached hereto as Exhibit "I" and by reference made a part hereof;
WHEREAS, the Department has awarded the Entity (Subrecipient) an urban and community
forestry grant for the improvements to the project property more particularly set forth in the Grant
Agreement;
WHEREAS, the Entity (Subrecipient) agreed in the Grant Agreement to maintain the project
(as described in the Grant Application);
WHEREAS, the parties hereto recognize the need for entering into an agreement designating
and setting forth the responsibilities of each party in maintaining the project; and
WHEREAS, the Entity (Subrecipient) by Resolution desires to enter into this Agreement and
authorizes its officers to do so.
NOW THEREFORE, for and in consideration of the mutual benefits that flow each to the
other herein and in Exhibit "I", the Grant Memorandum of Agreement, the parties covenant and
agree as follows:
1. The Entity (Subrecipient) shall maintain the project in a responsible manner and with due
care in accordance with the below listed "Project Standards" for the property at the following
location:
Specifically, the Entity (Subrecipient) accepts the below listed responsibilities and duties:
(a). All planting stock or replacement must be Florida Grade # 1 or better.
(b). Proper watering and proper fertilization of all trees/plants.
(c). Keeping trees/plants as free as practicable from disease and harmful insects;
(d). Proper mulching of trees and/or planting beds;
(e). Keeping the premises free of weeds;
(f). Mowing and/or cutting grasses to the proper length;
(g). Proper pruning of all trees which includes; (I) removing dead or disease parts
of trees or (ii) pruning such parts thereof which present a hazard;
(h). Removing and replacing dead or diseased trees/plants in their entirety, or
removing and replacing those that fall below original Project Standards.

7. This Agreement may not be assigned or transferred by the Entity (Subrecipient), in whole
or in part without the expressed written consent of the Department.
$. This Agreement shall be governed by and construed in accordance with the laws of the
State of Florida.
9. All notices, demands, requests or other instruments shall be given by depositing the same
in the U.S. Mail, postage prepaid, registered or certified with return receipt requested, or by telex
(FAX) or telegram:
(a) If to the Department, addressed to Grants Coordinator, Forest Management
Bureau, 3125 Conner Boulevard, Tallahassee, Florida 32399-1650 or at such
other address the Department may from time to time designate by written
notice to the Entity (Subrecipient); and
(b) If to the Entity (Subrecipient) addressed to:
or at such other address as the Entity (Subrecipient from time to time
designates by written notice to the Department.
All time limits provided hereunder shall run from the date of receipt of all mailed notices,
demands, requests and other instruments, or from the. date telexed or faxed.
10. Time is of the essence of this agreement.
11. This contract, which disburses grants and aids appropriations, is subject to the
requirements of Section 216.347, Florida Statutes, and the Entity (Subrecipient) is therefore not
allowed to expend any funds received through this contract for the purpose of lobbying the Florida
Legislature, the Department, the Judicial Branch, or any other state agency.
This contract, which disburses grants and aids appropriations, is subject to the requirements
of Section 216.349, Florida Statutes, which are:
(a) The Department and the Comptroller before disbursing any funds must
independently ensure that the proposed expenditure is in accordance with all legal
and regulatory requirements and that this contract specifically prohibits the use of
funds for the purpose of lobbying the Legislature, the Department, the Judicial
Branch or any state agency.
(b) If the Entity (Subrecipient) is a local government agency, non-profit organization,
or not -for -profit organization it shall: (I) for amounts $25,000 or less, have its head
attest that it has complied with grant provisions, (ii) for amounts greater than
$25,000 but not more than $100,000 have a grant -specific audit performed in
accordance with the rules of the Auditor General or have a statement prepared by an
independent certified public accountant which attests that the grant provisions have
been complied with, (iii) for amounts greater than $100,000 have a grant -specific
audit performed in accordance with the rules of the Auditor General, and (iv) have
such audits, statements, or attestations filed with the Department and the Auditor
General.

EXHIBIT C
PLANTING AND MAINTENANCE GUIDELINES
A) Planting
Site factors which influence long-term survivability should be considered: overhead and
underground utilities, sidewalks, sign conflicts, traffic visibility, light poles, right-of-way or
site improvements, size of planting space/site, etc.
All planting stock or replacement stock must be Florida Grade #1 or better.
All synthetic or non -biodegradable material such as nylon rope, synthetic wrap, treated
burlap, etc. must be removed from the root ball before planting. All biodegradable material
should be removed from the upper 1/3 of the root ball. Precautions should be taken to
eliminate any material from extending above the soil surface where it can act as a wick and
dry the surrounding soil.
If trees are planted with wire baskets around the root ball, it is recommended that the top
two tiers of wire be cut and removed after the root ball is set in the planting hole.
The planting hole should be at least 3-5 times the diameter of the root ball (where possible)
and the same depth as the root ball.
Position the tree or palm in the center of the planting hole with the top of the root ball even
with the surrounding soil surface.
Backfill with soil from the planting site if it is not contaminated. All large rocks should be
removed. When the hole is half full, slowly water to saturate the soil and remove air
pockets, then continue to fill the hole with soil. It is not recommended that large amounts
of organic matter be incorporated into the backfill. Rake the soil evenly around the entire
planting area.
Water thoroughly to remove air pockets, secure the soil around the roots, and provide
nourishment.
B) Mulchin
Mulch an area at least three times the diameter of the root ball to a dept of 2-4" with wood
chips, bark mulch, shredded mulch, leaves or pine needles. Keep the mulch several inches
way from the tree or palm trunk.
Replenish mulch as it decomposes maintaining a 24" layer over the life of the project.

SEALED PROPOSALS: All proposal sheets and this original acknowledgment form must be
executed and submitted in a sealed envelope. (DO NOT INCLUDE MORE THAN ONE PROPOSAL
PER ENVELOPE.) The face of the envelope shall contain, in addition to the above address, the date
and time of the proposal opening and the proposal number. Proposal prices not submitted on attached
proposal price sheets when required shall be rejected. All proposals are subject to the conditions
specified herein. Those which do not comply with these Conditions are subject to rejection.
1. EXECUTION OF PROPOSAL: Proposal must contain a manual signature of authorized
representative in the space provided above. Proposal must be typed or printed in ink. Use of
erasable ink is not permitted. All corrections made by proposer to his proposal price must be
initialed. The company name and SPURS vendor number shall appear on each page of the bid
as required. Complete ordering instructions must be submitted with the proposal. If you are not a

2. NO PROPOSAL SUBMITTED: If not submitting a proposal, respond by returning
only this proposer acknowledgment form, marking it "NO PROPOSAL" and explain the reason in
the space provided above. Failure to respond to a procurement solicitation without giving justifiable
reason for such failure, non-conformance to contract conditions, or other pertinent factors deemed
reasonable and valid shall be cause for removal of the supplier's name from the proposal mailing
list. NOTE: To qualify as a respondent, proposer must submit a "NO PROPOSAL", and it must
be received no later than the stated proposal opening date and hour.
3. PROPOSAL OPENING: Shall be public, on the date, location and the time specified on
the acknowledgment form. It is the proposer's responsibility to assure that his proposal is delivered
at the proper time and place of the proposal opening. Proposals which for any reason are not so
delivered, will not be considered. Offers by telegram or telephone are not acceptable. A proposal
may not be altered after opening of price proposals. NOTE: Proposal tabulations will be furnished
upon written request with an enclosed, self addressed, stamped envelope and payment of a
predetermined fee. Proposal files may be examined during normal working hours by appointment.
Proposal tabulations will not be provided by telephone.
4. PRICES, TERMS AND PAYMENT: Firm prices shall be proposed and include all
services rendered to the purchaser.
(a) TAXES: The State of Florida does not pay Federal Excise and Sales taxes on direct
purchases of services. See tax exemption number on face of purchase
order. This exemption does not apply to purchases of services in the performance of contracts
for the improvement of state-owned real property as defined in Chapter 192, F. S.
(b) DISCOUNTS: Cash discounts for prompt payment shall not be considered
in determining the lowest net cost for proposal evaluation purposes.
(C) MISTAKES: Proposers are expected to examine the conditions, scope of work, proposal
prices, extensions, and all instructions pertaining to the services involved. Failure to do so
will be at the proposer's risk. Unit prices bid will govern in award.
(d) INVOICING AND PAYMENT: The contractor shall be paid upon submission
of properly certified invoices to the purchaser at the prices stipulated on the contract
at the time the order is placed, after delivery and acceptance of goods, less deductions
if any, as provided. Invoices shall Contain the Contract number, purchase order
number and the Contractor's SPURS vendor number. An original and three
(3) copies of the invoice shall be submitted.The final payment shall not be made until after the
Contract is complete unless the State has agreed otherwise. Invoices for fees or other
compensation for services or expenses submitted in accordance with the rates at or below
those specified in Sections 112,061 and 287,058, F.S.INTEREST PENALTIES: Payment
shall be made in accordance with Section 215.422, F.S., which states the
contractor's rights and the State agency's responsibilities concerning interest
penalties and time limits for payment of invoices. VENDOR RESPONSE SYSTEM: To access
an interactive Voice Response System for vendor payment inquiry, Vendors may call (850)
413.7269 between 7 a.m. and 6 p.m. Monday through Friday to check on the status of payments
by State agencies. The system can accommodate English and Spanish speaking callers.
VENDOR OMBUDSMAN: Vendors providing goods and services to an agency should be aware
of the following time frames. Upon receipt, an agency has five (5) working days to inspect and approve
the goods and services, unless the bid specifications, purchase order or contract specifies
otherwise. An agency has 20 days to deliver a request for payment (voucher) to the Department
of Banking and Finance. The 20 days are measured from the latter of the date the invoice is
received or the goods and services are received, inspected and approved. If a payment is not
available within 40 days, a separate interest penalty set by the Comptroller pursuant to Section
55.03 F.S., will be due and payable, in addition to the invoice amount, to the vendor. To obtain
the applicable interest rate, contact the agency purchasing office. The interest penalty provision
applies after a 35 day time period to health care providers, as defined by rule. Interest penalties
of less than one (1) dollar will not be enforced unless the vendor requests payment. Invoices
which have to be returned to a vendor because of vendor preparation errors will result in a
delay in the payment. The invoice payment requirements do not start until a properly completed
invoice is provided to the agency. A Vendor Ombudsman has been established within the
Department of Banking and Finance, The duties of this individual include acting as an advocate
of vendors who may be experiencing problems in obtaining timely payment(s) from a State
agency. The Vendor Ombudsman may be contacted a (850) 488.2924 or by calling the State
Comptroller's Hotline, 1-800-848-3792. State Purchasing shall review the conditions and
Circumstances surrounding non-payment, and unless there is a bona fide dispute, State
Purchasing may, in writing, authorize the contract supplier to reject and return purchase orders
from said agency until such time as the agency complies with the provisions of Section 215.422, F.S.
(e) ANNUAL APPROPRIATIONS: The State of Florida's performance and obligation to
pay under this contract is contingent upon an annual appropriation by the Legislature.
5. CONFLICT OF INTEREST: The award hereunder is subject to the provisions of Chapter
112, F.S. Proposers must disclose with their proposal the name of any officer, director, or agent
who is also an employee of the State of Florida, or any of its agencies. Further, all proposers must
disclose the name of any State employee who owns, directly or indirectly, an interest of five (5%) or
more in the proposer's firm or any of its branches. In accordance with Chapter 287, FS., no
person or firm receiving a contract that has not been procured pursuant to Section 287,0$7(2) or
(3). F.S., to perform a feasibility study of the potential implementation of a subsequent contract,
participating in the drafting of a request for proposals, or developing a program for future
implementation shall be eligible to contract with the agency for any contracts dealing with that
specific subject matter; and proposers must disclose with their proposal any such conflict of interest.

City of Tamarac McNab Park Reforestation Project
Project Description
The City of Tamarac, located in Broward County, has a current population of
52,413 (University of Florida, 1999). According to the most recent census data
(1990) per capita income is 20% below the County average. Tamarac was
incorporated in 1963. As the City developed, natural area and tree cover were
lost in the process. Tamarac is an area of the County severely impacted by the
recent citrus canker epidemic, which has further destroyed the City's tree
canopy.
Tamarac has taken an aggressive approach to tree care and conservation and
has aligned itself with Broward County's Tree Preservation Ordinance. The City
has developed a Master Landscape Plan and new development emphasizes the
concept of "right tree - right place" along with a preference for native species.
The City has attained Tree City USA status and is publishing a Homeowner's
Guide to Proper Tree Care, in order to enhance the community forestry program.
Recent amendments to the City's Comprehensive Plan further solidify the City's
commitment to restoration of the tree canopy by providing for clearing of exotic
species and replacement with native trees and plants as part of the site planning
process.
In 1999 the Broward County Commission established the Natural Lands
Acquisition Program to foster the preservation of resources and open space.
The initial phase of the program evaluated areas and created an inventory of
undeveloped/unprotected lands. In October of 1999 the City of Tamarac
purchased an eight -acre parcel, included on the County's inventory list of
unprotected lands and identified as prime for conservation. The parcel is
adjacent to a nine -acre wetland area, which is presently undergoing restoration.
Past practices including drainage of the parcel have led to invasion by exotics,
primarily Maleluca and Brazilian Pepper, which now constitute 85% of the
vegetation on site. This intrusion has destroyed the native trees, plants and
wildlife habitat.
The City's adopted standard for public park land and open space is 2.3 acres per
1,000 population. The City's current inventory is approximately 70 acres short.
Preservation of this site as open space to be restored as a passive park will help
the City fulfill this objective. The park will be available to all 52,413 Tamarac
residents as well as any visitors to the City. The conceptual site plan shows the
first phase of park improvements. The City anticipates that it will begin
construction of these Phase 1 elements during the later part of FY2001.
Tamarac has budgeted resources to provide for clearing the land of debris and
exotics. Funding is being sought through this application to provide for
reforestation of the park, thus allowing the City to replace the exotics with native
species. If funding is approved, the City will purchase and plant Sable Palm,
Pigeon Plum, Wild Tamarind, Live Oak and Laurel Oak as depicted on the
attached conceptual site plan. Among the factors considered in selecting the
species of trees for this particular project are their ability to thrive in various soil

situations, their shade characteristics and the fact that they are all native species.
The objectives and benefits of this project include:
• Planting trees will expand the forest cover, which will in turn restore the
wildlife habitat thus attracting birds and small animals to the park.
• Removal of the exotics and replacement with native trees will serve to
further protect the adjoining wetland area from reinvasion by exotics.
• The park is located in a high aquifer recharge area and the project will
serve to increase the pervious nature of the site and decrease stormwater
runoff.
• The park is immediately adjacent to a residential area to the north and the
Sawgrass Expressway borders both the residential area and the park on
the west. Reforestation of the park will help to offset the impact of
automobile exhaust on the area.
• The proposed project, along with the education kiosk depicted on the
conceptual site plan will serve to further educate residents as to the
impact of open space and forest cover on our environment, why the
species on site were selected and the benefits of urban tree preservation.
The City of Tamarac Parks Division of the Parks and Recreation Department will
be responsible for maintenance. The City has a certified arborist on staff who will
monitor and inspect the project. While the RFP requests a three year
maintenance plan, the City will accept responsibility for maintenance of the
project on an ongoing, perpetual basis in accordance with the Planting and
Maintenance Guidelines as outlined in the RFP. A copy of the Planting and
Maintenance Guidelines is attached to this proposal.
Summary
The City of Tamarac is proud of the strides it has made in developing its Urban
Forestry Program. Activities such as the development of the City's Master
Landscape Plan, publication of a Homeowner's Guide to Proper Tree Care, and
Tree City USA designation have all contributed to resident awareness, and
established development standards, relative to tree preservation.
There has been tremendous community support and input relative to the
development of the proposed project (see resolution and letters of endorsement
attached). Preservation of this site as open space will bring the City closer to its
objective of providing 2.3 acres of open space for every 1,000 residents. A
$10,000 grant will allow the City to both clear the site and reforest the park by
planting 53 native trees, thus furthering its Comprehensive Plan objective to clear
exotics and replace with native species. This project will further Tamarac's goal
to expand the tree canopy, help to offset the additional loss caused by the recent
citrus canker epidemic, serve as a demonstration project for visitors to the park,
further improve air quality, improve the pervious nature of a high aquifer recharge
area and decrease stormwater runoff. The education kiosk depicted on the
conceptual site plan will provide residents with an overview of the project area,
thus enhancing the City's goal of ensuring that residents understand the
importance of urban tree preservation.

PLANTING AND MAINTENANCE GUIDELINES
A) Planting
Site factors which influence long-term survivability should be considered: overhead and
underground utilities, sidewalks, sign conflicts, traffic visibility, light poles, right-of-way or
site improvements, size of planting space/site, etc.
All planting stock or replacement stock must be Florida Grade #1 or better.
All synthetic or non -biodegradable material such as nylon rope, synthetic wrap, treated
burlap, etc. must be removed from the root ball before planting. All biodegradable material
should be removed from the upper 1/3 of the root ball. Precautions should be taken to
eliminate any material from extending above the soil surface where it can act as a wick and
dry the surrounding soil.
If trees are planted with wire baskets around the root ball, it is recommended that the top
two tiers of wire be cut and removed after the root ball is set in the planting hole.
The planting hole should be at least 3-5 times the diameter of the root ball (where possible)
and the same depth as the root ball.
Position the tree or palm in the center of the planting hole with the top of the root ball even
with the surrounding soil surface.
Backfill with soil from the planting site if it is not contaminated. All large rocks should be
removed. When the hole is half full, slowly water to saturate the soil and remove air
pockets, then continue to fill the hole with soil. It is not recommended that large amounts
of organic matter be incorporated into the backfill. Rake the soil evenly around the entire
planting area.
Water thoroughly to remove air pockets, secure the soil around the roots, and provide
nourishment.
B) Mulching
Mulch an area at least three times the diameter of the root ball to a dept of 24" with wood
chips, bark mulch, shredded mulch, leaves or pine needles. Keep the mulch several inches
way from the tree or palm trunk.
Replenish mulch as it decomposes maintaining a 24" layer over the life of the project.

DRUG -FREE WORKPLACE PROGRAM - BIDDER CERTIFICATION
IDENTICAL TIE BIDS - Preference shall be given to businesses with drug- free workplace
programs. Whenever two or more bids which are equal with respect to price, quality, and
service are received by the State or by any political subdivision for the procurement of
commodities or contractual services, a bid received from a business that certifies that it has
implemented a drug -free workplace program shall be given preference in the award process.
Established procedures for processing tie bids will be followed if none of the tied vendors have
a drug -free workplace program. In order to have a drug -free workplace program, a business
shall:
1) Publish a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the workplace
and specifying the actions that will be taken against employees for violations of such
prohibition.
2) Inform employees about the dangers of drug abuse in the workplace, the business's
policy of maintaining a drug -free workplace, any available drug counseling,
rehabilitation, and employee assistance programs, and the penalties that may be
imposed upon employees for drug abuse violations.
3) Give each employee engaged in providing the commodities or contractual services that
are under bid a copy of the statement specified in subsection (1)
4) In the statement specified in subsection (1), notify the employees that, as a condition
of working on the commodities or contractual services that are under bid, the
employee will abide by the terms of the statement and will notify the employer of any

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO SUBMIT AN
APPLICATION TO THE FLORIDA DEPARTMENT OF
AGRICULTURE AND CONSUMER SERVICES FOR AN
URBAN AND COMMUNITY FORESTRY GRANT IN THE
AMOUNT OF $10,000 FOR THE REFORESTATION OF
MCNAB PARK; PROVIDING FOR A MAINTENANCE
MEMORANDUM OF AGREEMENT BETWEEN THE CITY
AND THE DEPARTMENT OF AGRICULTURE IN THE
EVENT THE AWARD IS ACCEPTED; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac realizes that trees provide
many benefits to residents including energy conservation, wildlife habitat, decreased
stormwater runoff and cleaner air; and
WHEREAS, the City of Tamarac realizes the importance of restoring and expanding
the tree canopy within the City; and
WHEREAS, McNab Park has been invaded by exotic species which must be cleared
and should be reforested with native species; and
WHEREAS, the Department of Agriculture and Consumer Services through the Urban
and Community Forestry Grant Program provides funds to municipalities for the expansion
of open space and forest cover; and
WHEREAS, should the application be approved and award accepted, the City agrees
to maintain the trees which are the subject of this application on an ongoing basis; and

WHEREAS, the application process requires that the City of Tamarac indicated that it
will maintain the trees and agrees to, upon approval of the application and acceptance of
the award, execute a Maintenance Memorandum of Agreement with the Department of
Agriculture; and
WHEREAS, the City Manager and the Director of Parks and Recreation recommend
filing of the application attached hereto as Exhibit A; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the residents to submit an application to the Florida Department of Agriculture
and Consumer Services Urban and Community Forestry Grant Program in the amount of
$10,000 for the expansion of open space within the City through the reforestation of McNab
Park.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this resolution.
Section 2: The appropriate City officials are hereby authorized to submit the Urban
and Community Forestry Grant Application attached hereto as Exhibit A and made a part
hereof.
Section 3: It is hereby agreed that the City will maintain the trees on an ongoing basis
and will enter into a maintenance memorandum of agreement, a sample of which is included
on page 60 of the State of Florida Request for Proposal (attached hereto as "Exhibit B"), with
the Department of Agriculture and Consumer Affairs should the application be approved and
award accepted.

Section 4: All resolutions in conflict herewith are hereby repealed to the extent of such
conflict.
Section 5: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or in application,
it shall not affect the validity of the remaining portion or applications of this Resolution.
Section 6: This Resolution shall become effective immediately upon its adoption.
