R-2000-,?AD A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, REQUESTING THE STATE OF FLORIDA DEPARTMENT OF JUVENILE JUSTICE TO NOT RESTRICT THE TYPES OF JUVENILE OFFENDERS IT WILL ACCEPT DURING CERTAIN WEEKNIGHT AND WEEKEND HOURS; REQUESTING THE BROWARD COUNTY LEGISLATIVE DELEGATION WORK TOWARD ENSURING THAT SUFFICIENT FUNDING BE APPROPRIATED DURING THE 2001 LEGISLATIVE SESSION TO FULLY FUND OPERATIONS AT THE JUVENILE INTERVENTION FACILITY EFFECTIVE JULY 1, 2001; DIRECTING THE CITY CLERK TO SEND A COPY OF THIS RESOLUTION TO THE BROWARD COUNTY LEGISLATIVE DELEGATION, THE FLORIDA DEPARTMENT OF JUVENILE JUSTICE AND BROWARD COUNTY SHERIFF KEN JENNE FOR CONSIDERATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Department of Juvenile Justice ("Department") operates the Juvenile Intervention Facility ("Facility") which receives youths taken into custody for alleged delinquent offenses and conducts intake, assessment and placement decisions accordingly; and WHEREAS, insufficient funding has resulted in restrictions placed on the type of juvenile offenders accepted at the Facility during certain weeknight and weekend hours; and WHEREAS, insufficient funding may restrict timely and adequate services that were previously available to juvenile offenders in an effort to identify problems that contribute to their delinquent behavior; and WHEREAS, sufficient funding for the Department and the Facility should be appropriated during the 2001 Legislative session to ensure fully funded operations; and Temp. Reso # 9116 -- August 14, 2000 Page 2 WHEREAS, the valuable time and resources of law enforcement officers may now be spent attempting to identify and locate parents or guardians of juvenile offenders, and transporting such offenders home, instead of addressing other law enforcement issues; and WHEREAS, the restrictions on accepting juvenile offenders at the Facility may limit intake, assessment and detention placement decisions to short telephone calls to the Facility by law enforcement officers and may result in serious placement errors which could endanger the safety and security of the public; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to request the State of Florida Department of Juvenile Justice to not restrict the types of juvenile offenders it will accept during certain weeknight and weekend hours, and that the Broward County legislative Delegation work toward ensuring that sufficient funding be appropriated during the 2001 Legislative Session to fully fund operations at the Juvenile Intervention Facility effective July 1, 2001. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The State of Florida Department of Juvenile Justice not restrict the types of juvenile offenders it will accept during certain weeknight and weekend hours. 1 Temp. Reso # 9116 — August 14, 2000 Page 3 1 Section 3: The Broward County Legislative Delegation work toward ensuring that sufficient funding be appropriated during the 2001 Legislative Session to fully fund operations at the Juvenile Intervention Facility effective July 1, 2001. Section 4: The City Clerk is directed to send a copy of this resolution to the Broward County Legislative Delegation, the Florida Department of Juvenile Justice and Broward County Sheriff Ken Jenne for consideration. Section 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution.
