A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A SITE
AGREEMENT BETWEEN THE CITY OF TAMARAC AND THE
HUMAN SERVICES NETWORK, INC., D/B/A BROWARD
MEALS ON WHEELS FOR USE OF A MEETING ROOM IN
THE TAMARAC COMMUNITY CENTER, LOCATED AT 8601
WEST COMMERCIAL BOULEVARD, TAMARAC, FOR THE
CONGREGATE NUTRITION PROGRAM SPONSORED BY
BROWARD MEALS ON WHEELS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac and Broward Meals on Wheels share the concern
for the nutritional welfare of Broward County's senior residents; and
WHEREAS, the City of Tamarac has suitable space for use as a meal site for the
Broward Meals on Wheels Nutrition Program and desires to make such space available for
the program; and
WHEREAS, the Director of Parks and Recreation and the City Manager
recommend approval of the Site Agreement between the Human Services Network, Inc.,
D/B/A Broward Meals on Wheels and the City of Tamarac; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to execute a Site Agreement with the Human Services Network,
Inc., D/B/A Broward Meals on Wheels for use of a meeting room in the Tamarac
Community Center, located at 8601 West Commercial Boulevard, Tamarac, for the
congregate Nutrition Program sponsored by Broward Meals on Wheels.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: That the appropriate City Officials are hereby authorized to execute the
Site Agreement between the City of Tamarac and the Human Services Network, Inc.,
D/B/A Broward Meals on Wheels, for use of a Meeting Room in the Tamarac Community
Center, located at 8601 West Commercial Boulevard, Tamarac, for the congregate
Nutrition Program sponsored by Broward Meals on Wheels, a copy of said Site Agreement,
attached hereto as "Exhibit A".
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SITE AGREEMENT
On Behalf of
Broward Meals On Wheels
Agreement made and entered into this SAG day of IDCA'CA " , 2000, in Fort Lauderdale, Broward County,
by and between the Human Services Network, Inc., d/b/a Broward Meals On Wheels of Broward County, hereinafter
called "BMOW' and City of Tamarac hereinafter called "Host Agency".
WITNESSETH:
WHEREAS, BMOW is the sponsoring agency of the Nutrition Program providing meals through the
provisions of the Older American's Act, for Broward Counly's senior residents; and
WHEREAS, Host Agency sharing the concern for the nutritional welfare of Broward County's senior
residents and having space suitable for use as a meal site for the Nutrition Program and
desiring to make available said space to the program.
BE IT THEREFORE mutually agreed as follows:
That the Host Agency has agreed that BMOW will provide meals at the facility located at Tamarac Community
Center, 8601 W. Commercial Blvd., Tamarac, FI 33321 for the eligible participants of the Nutrition program.
2. That BMOW represents and assures that this location will not be used by BMOW and its participants for any
purpose other than those associated with the services required by the Nutrition Program.
3. That BMOW is sensitive to the vulnerability of the elderly population and therefore does not allow outside
groups/organizations to make presentations to the participants of the Nutrition Program unless an in-service
Agreement has been signed.
.4. That the Host Agency shall be responsible for the following:
a. Procure and carry, at its own expense, premises liability insurance up to $1,000,000.00.
b. Donating space that is adequate, safe and environmentally comfortable and providing adequate time for the
proper serving of the meals. The established hours of the Nutrition Service are 10.00 am -1.00 pm and the
space designated for the Nutrition Service is located in the Tamarac Community Center, and occupies 700
sq. ft.
C. Providing for removal and disposal of garbage.
d. Provides assurance that all sanitation needs and requirements as set forth by the State of Florida
Department of Elder Affairs (DoEA) will be met.
e. All incidents or accidents occurring outside the designated space and/or established hours will be the
responsibility of the Host Agency.
The coordination of activities so as not to interfere with the Nutrition Program serving time.
g. Understanding that the supplies delivered [cups, plastic waft, or other supplies] are for the meal service only
and not the personal use of the Host Agency;

h. Acknowledging that the policies and procedures established by BMOW must be followed by each Site
Administrator in order to comply with the Older American's Act requirements. They are itemized below:
(1) All persons aged sixty (60) and over regardless of residency are eligible to participate in the Nutrition
Program.
(ii) Rosters must accurately reflect the actual eligible participants receiving services and the numbers of
meals served must total the numbers of meals received and signed for on BMOW s caterers invoices.
(iii) Intakes and nutrition screening forms will be completed for each participant and sent to BMOW offices
along with rosters.
(iv) The contribution box must be made visible to all participants/caregivers.
(v) The contributions must be counted on a daily basis and returned to BMOW using bank bag supplied
by BMOW.
(vi) That all clients and/or caregivers are informed of the BMOW services provided to your facility.
(vii) That all BMOW staff and volunteers must wear BMOW badges during meal services. No other
volunteer will be allowed to assist.
(viii) That no BMOW staff or volunteer is to administer any more first aid than a band aid.
(ix) Space will be provided for BMOW to display signs as required by the Older American's Act during
the meal service.
The payment of any charges, costs or fees incurred in the fort of utilities (including water, air, heat, electricity
or other utilities), garbage pickup and day to day maintenance of the premises;
The payment for any repairs or maintenance, deemed necessary by any governmental agency including but
not limited to, health department, fire inspections and building inspection;
k. The identification of BMOW as a service provider in written brochures and publicity materials when the
meal/Nutrition Program is mentioned.
The advance notification to BMOW of their schedule of Holidays and any other days the facility will not be
available for the program.
m. Coordinating their own transportation needs with Broward County Social Services Transportation.
5. That BMOW shall be responsible for the following:
a. Assuring that all food service and dietary standards imposed by the Administrative Code for the State of
Florida and the DoEA Programs and Services Manual are followed.
b. Assuring that each daily meal provided will meet the one third Recommended Dietary Allowance (1/3 RDA)
requirement for people over age fifty-one (51).
C. Assuring that the service area will be inspected by the Nutritionist and that it meets current Food Service
Establishment Inspection criteria using the monitoring fort designated by the DoEA.

d. Providing Nutrition Education in a manner appropriate to the participants attending the Center on a monthly
basis.
e. Providing a staff person (called a Site Administrator) to supervise the Nutrition Program and to recruit
volunteers to assist in the meal service.
Providing training for the Site Administrator and each recruited volunteer on food safety, food handling and/or
work place safety.
6. BMOW staff Nutritionist is available for consultation with staff, participants and caregivers to discuss the
participant's diet in relation to the meal provided by BMOW at the facility.
7. BMOW shall indemnify and hold harmless the Host Agency, its elected and appointed officials, employees, and
agents from any and all claims, suits, actions, damages, liability, and expenses (including attomeys' fees) brought
in connection with the food services provided by BMOW, including, but not limited to the handling, preparation,
serving and consumption of food originating from BMOW, excepting such damage attributable to the negligence
or misconduct of the Host Agency or its elected or appointed officials and employees. The above provisions shalt
survive the termination of this Agreement, even though the claim may be made after the termination hereof.
Nothing contained herein is intended nor shall be construed to waive City's rights and immunities under the
common law or Florida Statutes 768.28, as amended from time to time.
8. That SMOW will provide an allocation of meals per day in accordance with its budget and the current needs of the
facility. Should this need change, it is the responsibility of the Host Agency to contact BMOW and discuss such
needs.
9 The BMOW further agrees to procure and carry, at its own expense, indemnity insurance against all such food
related liability in the sum of $1,000,000.00.
(a) The City of Tamarac shall be listed as an additional insured.
(b) The insurance carrier shall be rated at least A-V.
(c) In the occurrence of coverage termination, the City shall be given 30 days notice.
(d) The insurance shall be in a form and content that is acceptable to the City's Risk Manager.
10. Notices. All notices, requests, demands and other communications hereunder shall be in writing and shall be
deemed given if personally delivered or mailed, certified mail, return receipt requested, or sent by overnight carrier

This agreement shall be governed by the laws of the State of Florida as are now and hereinafter in force. The
venue for actions arising out of this Agreement is fixed in Broward County, Florida.
The term of this Agreement shall be for a period of one year from the date it is completely executed by both
parties. The Agreement shall be automatically renewed on a year to year basis if not terminated as stated herein.
Either party has the right to terminate this agreement upon sixty (60) days written notice at any time during the term of this
Agreement.

survive the termination of this Agreement, even though the claim may be made after the termination hereof.
Nothing contained herein is intended nor shall be construed to waive City s rights and immunities under the
common law or Florida Statutes 768.28, as amended from time to time.
8. That BMOW will provide an allocation of meals per day in accordance with its budget and the current needs of the
facility. Should this need change, it is the responsibility of the Host Agency to contact BMOW and discuss such
needs.
9 The BMOW further agrees to procure and carry, at its own expense, indemnity insurance against all such food
related liability in the sum of $1,000,000.00.
(a) The City of Tamarac shall be listed as an additional insured.
(b) The insurance carrier shall be rated at least A-V.
(c) In the occurrence of coverage termination, the City shall be given 30 days notice.
(d) The insurance shall be in a form and content that is acceptable to the City's Risk Manager,

deemed given if personally delivered or mailed, certified mail, return receipt requested, or sent by overnight carrier

This agreement shall be governed by the laws of the State of Florida as are now and hereinafter in force. The
venue for actions arising out of this Agreement Is fixed in Broward County, Florida.
The term of this Agreement shall be for a period of one year from the date it is completely executed by both
parties. The Agreement shall be automatically renewed on a year to year basis if not terminated as stated herein.
Either parry has the right to terminate this agreement upon sixty (60) days written notice at any time during the term of this
Agreement.
