A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO CONVEY REAL PROPERTY TO
ADVANCE BUSINESS ASSOCIATES, SUBJECT
TO THE RECORDATION OF THE FIFTEEN
FOOT (15') PUBLIC UTILITY EASEMENT, AS
CONSIDERATION FOR REAL PROPERTY
RECEIVED FROM JINDA LWIN TO SECURE
LAND FOR THE ULTIMATE CONSTRUCTION OF
HIATUS ROAD; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida, has constructed
Hiatus Road through Land Section Seven (7); and
WHEREAS, one (1) of the primary parcels within the proposed road right-of-way
was owned by Jinda Lwin; and
WHEREAS, Jinda Lwin conveyed a portion of the property to the City of Tamarac for
the construction of Hiatus Road at no cost to the City; and
WHEREAS, subsequent to the conveyance of this property to the City, the actual
alignment of Hiatus Road changed causing a portion of the Lwin property to no longer be
needed; and
WHEREAS, this property is too small to be developed and would not serve a
legitimate public purpose if kept by the City; and

WHEREAS, it serve a legitimate public purpose to return the unused portion of
property to the original owner or rightful successor, as such property would again become
taxable property; and
WHEREAS, Advance Business Associates is the rightful successor of the Lwin
property; and
WHEREAS, the City of Tamarac conveys Real Property (attached hereto as Exhibit
"A"), subject to the recordation of the fifteen foot (15') Public Utility Easement (attached
hereto as Exhibit "B"), to Advance Business Associates, as consideration for Jinda Lwin's
conveyance to the City of Tamarac and pursuant to Jinda Lwin's authorization letter
[attached hereto as Exhibit "C(1)]"; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to convey Real Property to Advanced Business Associates,
subject to the recordation of the fifteen foot (15') Public Utility Easement, as consideration
for Real Property received from Jinda Lwin to secure land for the ultimate construction of
Hiatus Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.

SECTION 2: That the City Commission hereby approves the conveyance of
Real Property to Advance Business Associates, subject to the recordation of the fifteen
foot (15') Public Utility Easement, as consideration for Real Property received from Jinda
Lwin to secure land for the ultimate construction of Hiatus Road.
SECTION 3: That the appropriate City Officials of the City of Tamarac,
Florida, are hereby authorized to grant such conveyance to Advance Business Associates
and authorizes the appropriate City Officials to execute any documents necessary to
finalize the conveyance (attached hereto as Exhibit "1 ").
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

the CITY OF TAMARAC, a municipal corporation organized and

WHEREAS, Grantor is the owner of that certain real property
located in Broward County, Florida, more particularly described in
EXHIBIT "A" attached hereto, (hereinafter referred to as "Servient
Estate"); and
WHEREAS, Grantor desires to grant unto Grantee a perpetual
non-exclusive easement to use a portion of the Servient estate for
the installation and maintenance of public utilities;
NOW, THEREFORE, in consideration of the sum of Ten ($10.00)
dollars and other good and valuable considerations paid by each of

1. Grantor hereby grants and conveys to Grantee, its
successors and assigns, a perpetual non-exclusive
easement over and upon the servient estate, a legal
description of which is attached hereto as EXHIBIT "A",
for the installation and maintenance of public
utilities.
2. Grantor reserves all rights not herein granted pursuant
to this easement, including but not limited to, the
right of free ingress and egress under, over and upon
the servient estate and to grant further easements
under, over and upon the servient estate; provided
that, in no event, shall any of the rights herein
reserved to Grantor impede the easement herein granted
or the exercise of the rights of use thereunder.
3. The provisions of this easement shall be binding on the
parties hexezo and the respective successors and
assigns as a covenant running with and binding upon the
servient estate.
4. This easement shall not be released or amended without
consent of the Grantee as evidenced by a document
signed with the same formalities as this document.
S. Grantee shall record this document in the Public
Records of Broward County, Florida.
