RESOLUTION NO. R-97- I8vP-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A RELEASE
OF AGE RESTRICTION OF PERMANENT RESIDENTS FOR
GREENVIEW APARTMENTS, TRACT A OF GREENVIEW
APARTMENTS, ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 132, PAGE 22 OF THE PUBLIC
RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED
AT 10014 NOB HILL ROAD NORTH, TAMARAC, FLORIDA,
RELEASING THE AGE RESTRICTING COVENANT DATED
DECEMBER 22, 1976; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, in 1976, Leadership Housing, Inc., executed a Covenant in favor of the
City of Tamarac, restricting permanent residents who are less than 16 years old from
Greenview Apartments, Tract A of GREENVIEW APARTMENTS, according to the plat
thereof as recorded in Plat Book 132, Page 22 of the public records of Broward County,
Florida, located at 10014 Nob Hill Road North, Tamarac, Florida; and
WHEREAS, the age -restricting Covenant dated December 22, 1976, (a copy of
which is attached hereto as Exhibit "B") was recorded on February 1, 1977 in O.R. Book
6892, page 923, of the Public Records of Broward County, Florida; and
WHEREAS, said Covenant is to expire after fifty-eight (58) years; and
WHEREAS, Mr. Marcus Ellner and Mr. Austin Tupler purchased Greenview
Apartments from the Federal Deposit Insurance Corporation (FDIC); and

WHEREAS, the Federal Deposit Insurance Corporation as Receiver for Flagler
Federal Savings and Loan Association of Miami ("FDIC') believes the Covenant in favor
of the City of Tamarac, restricting permanent residents who are less than sixteen (16)
years of age, is unlawful and unenforceable pursuant to the Federal Fair Housing
Amendment Act of 1988, Pub. L. No. 100-430, 102 Stat. 1619 (1988); and
WHEREAS, the Federal Fair Housing Amendment Act of 1988, Pub. L. No. 100-
430, 102 Stat. 1619 (1988), amending 42 U.S.C. §§3601, et. seq. states that it is unlawful
to discriminate by refusing to rent because of familial status [as defined in 42 U.S.C.,
§3601(k)]; and
WHEREAS, the FDIC and its predecessor, the RTC, have been in possession of the
Greenview Apartments for five (5) years and have never refused tenancy because of age
levels; and
WHEREAS, the FDIC has not marketed or advertised age restrictions and currently
has tenants under sixteen (16) years of age; and
WHEREAS, this restriction has not been enforced by the FDIC, the City of
Tamarac, or any owner of the Apartments; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac that the City of
Tamarac releases the Greenview Apartments, located at 10014 Nob Hill Road North,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the appropriate City officials are hereby authorized to
execute the Release of Age Restriction of Permanent Residents (a copy of which is
attached hereto as Exhibit "A").
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
