CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97- / 95
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ACCEPT A CONVEYANCE
OF REAL PROPERTY AND A PUBLIC
UTILITY EASEMENT FROM SAM BUTTERS
TO SECURE LAND FOR THE ULTIMATE
CONSTRUCTION OF HIATUS ROAD;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, the City Commission of the City of Tamarac, Florida, wishes to
construct Hiatus Road through Land Section Seven (7); and
WHEREAS, one (1) of the primary parcels within the proposed road right-of-way is
owned by Sam Butters; and
WHEREAS, Sam Butters has agreed to convey real property and a public utility
easement to the City of Tamarac to aid in the completion of Hiatus Road; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to accept a
conveyance of real property and a public utility easement from Sam Butters to secure land
for the ultimate construction of Hiatus Road.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the conveyance of
real property and public utility easement from Sam Butters.
SECTION 3: That the appropriate officials of the City of Tamarac, Florida, are
hereby authorized to accept such conveyance and dedication from Sam Butters and
authorizes the appropriate City Officials to execute any documents necessary to finalize
the conveyance and dedication.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 6:
