CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE AN
AGREEMENT WITH THE BROWARD SHERIFF'S OFFICE
GOVERNING THE USAGE OF A GRANT PURCHASED
VEHICLE; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac was awarded a Community Law Enforcement
Block Grant from the United States Department of Justice; and
WHEREAS, a portion of these funds were allocated for the purchase of a vehicle
to be utilized by the Broward Sheriffs Office for crime prevention activities; and
WHEREAS, Resolution Number R-97-179, a copy being hereto attached as Exhibit
"1 ", authorized the purchase of said vehicle; and
WHEREAS, a Memorandum of Understanding has been negotiated between the
City and the Broward Sheriffs Office which transfers title and defines operating, repair and
replacement costs; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac that said vehicle be
transferred and that the Memorandum of Understanding be executed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses ARE HEREBY ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: That the appropriate City Officials are hereby authorized to
execute an agreement with the Broward Sheriffs Office governing vehicle ownership,
usage, maintenance expenses and liability, a copy of said Agreement being hereto
attached as Exhibit "2."
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.

RESOLUTION NO. R-9772
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE
OF A VEHICLE FOR THE BROWARD SHERIFF'S OFFICE
FOR CRIME PREVENTION PURPOSES; AUTHORIZING AN
EXPENDITURE OF GRANT FUNDS IN AN AMOUNT NOT TO
EXCEED $25,000; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO NEGOTIATE AN AGREEMENT WITH THE
BROWARD SHERIFF"S OFFICE; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac was awarded a Community Law Enforcement
Block Grant from the United States Department of Justice in the amount $41,752 for crime
prevention and community oriented police activities; and
WHEREAS, funding for the purchase of a vehicle was included in the Department
of Justice Grant in order enhance the ability of the Broward Sheriffs Office to provide crime
prevention activities, outreach and community oriented policing services to the residents
of the City; and
WHEREAS, City of Tamarac Code, §6-155, grants the Purchasing Officer the
authority to waive purchasing procedures and purchase from contracts with other
governmental agencies; and
WHEREAS, the State of Florida has issued a contract for Automobiles and Light
Trucks; and

WHEREAS, the Purchasing/Contracts Manager, Public Works Operations Manager,
and Broward Sheriffs Office have reviewed the State of Florida bid award and have
determined that it would be in the best interests of the City to utilize the State Bid for the
purchase of this vehicle; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to utilize the State
of Florida Bid for the purchase of this grant vehicle.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: Authorizing the use of the State of Florida Bid, for the purchase
of a grant vehicle for use by the Broward Sheriffs Office, a copy of said bid award being
hereto attached as Exhibit 1".
SECTION 3: Authorizing an expenditure of funds within the Grant Fund in
an amount not to exceed $25,000 from the account entitled "Law Enforcement Block
Grant".
SECTION 4: That the appropriate City Officials are hereby authorized to

MEMORANDUM OF UNDERSTANDING
'this Memorandum of Understanding is entered into on
1997, between the City of Tamarac ("City") and the Broward Sheriffs Qffice, ("BSc for
the purpose of setting forth terms for the use of a City vehicle obtained through a U.S.
Department of Justice Grant.
Pursuant to Resolution R96-162, the City was authorized to apply to the U.S.
Department of Justice for grant funds through the Local Law Enforcement Block Grants
Program.
Pursuant to the Local Law Enforcement Block Grants Program, the City has
received a grant from the U.S_ Department of Justice for funds to purchase a vehicle
(Make/Model Ch a zer) (VIN # VK 3246 ) for the purpose of crime prevention.
The City and BSO understand and agree to the following terms for use of the
vehicle:
1. Title to the vehicle shall be transferred to BSO.
2. The vehicle shall not be assigned outside of BSO District VI I.
3. All operating, repair costs and replacement costs shall be the sole
responsibility of BSO.
4. The vehicle shall only be used in a manner consistent with the U.S.
Departmerit of Justice Grant, namely for crime prevention purposes.
Indemnification: BSO shall indemnify and hold harmless the City, its elected
and appointed officials, employees, and agents from any and all claims, suits, actions,
damages, liability, and expenses (including attorneys' fees) in connection with loss of life.
bodily or personal injury, or property damage, including loss of use thereof, directly or,
indirectly caused by, resulting from, arising out of or occurring in connection with the use
of this vehicle or defect of the vehicle or property damage solely attributable to the defect.
The above provisions shall survive the termination of this Agreement and shall pertain to
any occurrence during the term of this Agreement, even though the claim may be made
after the termination hereof.
Nothing contained herein is intended nor shall be construed to waive CITY's rights
and immunities under the common law or Florida Statutes 768.28, as amended from time
to time.
This Memorandum of Understanding constitutes the entire agreement between the
City and BSO.
IN WITNESS WHEREOF, the parties have made and executed this Agreement on
the respective dates under each signature. CITY OF TAMARAC, through its Mayor and
Broward Sheriffs Office, signing by and through Ron Cochran sheriff
duly authorized to execute same.
