RESOLUTION NO. R-97-�
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
FOR THE VACATION OF A PORTION OF
THE EIGHTY-THREE (83') FOOT
INGRESS/EGRESS EASEMENT,
SPECIFICALLY LOTS 4 THRU 10,
INCLUSIVE, BLOCK 12, OF THE "LYONS
COMMERCIAL SUBDIVISION NO. 3"
ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 76, PAGE 31 OF
THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA, FOR BUDGET MINI -
STORAGE AND FIRSTMED, INC.; CASE NO.
11-P-97; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the eighty-three (83') foot ingress/egress easement described in Exhibit
"A" (attached hereto) was dedicated to the public on July 10, 1972 at the time of the initial
recordation of the Plat; and
WHEREAS, the property owners, BMS of Broward, Inc. and FirstMed, Inc., has
requested the vacation of a portion of the eighty-three (83') foot ingress/egress easement,
specifically Lots 4 thru 10, inclusive, Block 12 of the "Lyons Commercial Subdivision No.
3", according to the Plat thereof, as recorded in Plat Book 76, Page 31 of the Public
Records of Broward County, Florida; in order to expand their existing facility; and
WHEREAS, the City Engineer and all franchised Utility Companies have been

contacted and all have stated no objection to the vacation of the ingress/egress easement;
and
WHEREAS, the Planning Commission recommended approval on September 3,
1997; and
WHEREAS, the Director of Community Development recommends approval of this
request; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to vacate a portion
of the eighty-three (83') foot ingress/egress easement, specifically Lots 4 thru 10, inclusive,
Block 12, of the "Lyons Commercial Subdivision No. 3" Plat.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
S-ECTI(0N_'L: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: The vacation of a portion of the eighty-three (83') foot
ingress/egress easement, specifically Lots 4 thru 10, inclusive, Block 12, of the "Lyons
Commercial Subdivision No. 3", according to the Plat thereof, as recorded in Plat Book 76,
Page 31 of the Public Records of Broward County, Florida; Case No. 11-P-97; is hereby
approved.

SECTION 3 All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
