A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ACCEPT AND EXECUTE AN
OFFER TO SELL REAL PROPERTY BY LOUISE
WEISZ, AS TRUSTEE OF THE REVOCABLE
LIVING TRUST OF LOUISE WEISZ DATED
MARCH 5, 1990, TO THE CITY OF TAMARAC IN
THE AMOUNT OF SIXTY -THOUSAND THREE -
HUNDRED FIFTY-EIGHT DOLLARS AND
TWENTY-FIVE CENTS ($60,358.25) FOR THE
CITY TO PURCHASE THE CANAL RIGHT-OF-
WAY AND CANAL MAINTENANCE EASEMENT
TOTALING 37,114 SQUARE FEET TO SECURE
LAND FOR THE ULTIMATE CONSTRUCTION OF
HIATUS ROAD; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida, wishes to
construct Hiatus Road through Land Section Seven (7); and
WHEREAS, one (1) of the primary parcels is within the proposed Canal Right -of -
Way and Canal Maintenance Easement (attached hereto as Exhibit "A") needed for said
construction and is owned by Louise Weisz, as trustee of the Revocable Living Trust of
Louise Weisz dated March 5, 1990; and
WHEREAS, said lands have been offered to the City in lieu of the City's threatened
eminent domain action, by the landowner under certain terms and conditions; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac authorize the
appropriate City Officials to accept and execute an offer to sell real property by Louise
Weisz, as trustee of the Revocable Living Trust of Louise Weisz dated March 5, 1990, and
the City of Tamarac in the amount of Sixty -Thousand Three -Hundred Fifty -Eight Dollars
and Twenty -Five Cents ($60,358.25) for the City to purchase the Canal Right -of -Way and
Canal Maintenance Easement totaling 37,114 square feet to secure land for the ultimate
construction of Hiatus Road through Land Section Seven (7).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION-1 -1 The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby accepts the offer to sell the
said lands by Louise Weisz, as Trustee of the Revocable Living Trust of Louise Weisz
dated March 5, 1990 and authorizes the appropriate City officials to close the purchase
pursuant to the following terms and conditions:
(a) The seller will convey the Canal Right -of -Way, totaling 27,659 square feet,
in fee to the City for the purchase price of Forty -Eight Thousand Four -
Hundred Three Dollars and Twenty -Five Cents ($48,403.25).

(b) The seller will convey the Canal Maintenance Easement, totaling 9,455
square feet, for the purchase price of Nine -Thousand Four -Hundred Fifty -
Five ($9,455.00) Dollars.
(c) The seller shall receive the sum of Two -Thousand Five -Hundred ($2,500.00)
Dollars as reimbursement for her attorney's fees.
(d) The seller shall be entitled to receive a credit for water retention upon
development of the remaining lands equal to the area of the Canal Right -of -
Way.
(e) The City agrees to a modification of the location of the Canal Maintenance
Easement if upon development of the remaining lands the canal needs to be
enlarged to accommodate additional water retention demands.
(f) The seller shall not be responsible for any closing costs, the same to be
the responsibility of the City.
SECTION 3: That the appropriate officials of the City of Tamarac, Florida,
are hereby authorized to accept and execute an offer to sell real property by Louise Weisz,
as Trustee of the Revocable Living Trust of Louise Weisz dated March 5, 1990, and the
City of Tamarac in the amount of Sixty -Thousand Three -Hundred Fifty -Eight Dollars and
Twenty -Five Cents ($60,358.25) for the City to purchase the Canal Right -of Way and Canal
Maintenance Easement totaling 37,114 square feet to secure land for the ultimate
construction of Hiatus Road through Land Section Seven (7).

SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.
