CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97- ( C
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, AUTHORIZING
THE SETTLEMENT OF THE LIABILITY CLAIM OF
CATHALINE AND DARRYL RICHARDSON FOR
$37,500; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FQB 6N EFFECTIME DATE.
WHEREAS, on April 30, 1995, Cathaline Richardson, a T-ball coach, was injured when the
aluminum bleachers she was sitting on at Tamarac Park, field #4 collapsed; and
WHEREAS, her left foot was caught under the bleachers and she sustained injuries to her
back, shoulder and neck; and
WHEREAS, the City and Mr. and Mrs. Richardson recently attended Mediation proceedings
with their respective legal counsel and were able to amicably arrive at a fair and reasonable
settlement; and
WHEREAS; Mr. and Mrs. Richardson could be awarded substantially more if this case
proceeded to trial in addition to legal fees the City would incur; and
WHEREAS; Bruce Johnson, the City's defense counsel recommends the settlement of the
Cathaline and Darryl Richardson claim for $37,500; and
WHEREAS, the Risk Manager, the City Attorney and the City Manager recommend the
settlement of the Cathaline and Darryl Richardson claim for $37,500; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best
interests of the citizens and residents of the City of Tamarac to settle the bodily injury liability claim
of Cathaline Richardson and her husband, Darryl Richardson for $37,500.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF

TAMARAC, FLORIDA:
SECTION The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and is hereby made a specific part of this Resolution.
SECTION 2: The City Commission of the City of Tamarac, approves a $37,500
settlement with Cathaline and Darryl Richardson for all claims against the City in return for a full release.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect
the validity of the remaining portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its passage and
adoption.
