RESOLUTION NO. R-97- U
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
APPROVING A SPECIAL EXCEPTION TO
PERMIT THE OPERATION OF A TRUCK
RENTAL BUSINESS AS AN ACCESSORY USE
IN THE B-3 ZONING CATEGORY TO THE
UNIVERSITY TEXACO STATION LOCATED AT
6900 NORTH UNIVERSITY DRIVE;
SPECIFICALLY ADJACENT TO THE
NORTHWEST CORNER OF "MCNAB PLAZA
PLAT', ACCORDING TO THE PLAT THEREOF
AS RECORDED IN PLAT BOOK 91, PAGE 17
OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA; CASE NO. 6-Z-97;
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac approves the granting of a special
exception to permit the operation of a truck rental business as an accessory use in the B-3
Zoning Category to the University Texaco Station located at 6900 North University Drive;
specifically adjacent to the northwest corner of "McNab Plaza Plat", according to the Plat
thereof as recorded in Plat Book 91, Page 17 of the Public Records of Broward County, Florida;
and
WHEREAS, the Planning Commission held a public hearing on March 19, 1997, thereon
and has recommended denial of this application; and
WHEREAS, the Director of Community Development recommends approval of this
application; and
WHEREAS, the City Commission of the City of Tamarac finds that approving the petition
for special exception would be in keeping with the public health, safety, and general welfare of

the City of Tamarac; and
WHEREAS, the City Commission has examined and investigated the application and
staff recommendation dated April 23, 1997; and
WHEREAS, the City Commission reviewed the Special Exception request and
accompanying documents at a public meeting; and
WHEREAS, the City Commission has determined that the application is in compliance
with all elements of the Comprehensive Plan, or will be in compliance prior to issuance of a
certificate of occupancy for the development; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interests of the citizens and residents of the City of Tamarac to approve this special
exception to permit the operation of a truck rental business as an accessory use in the B-3
Zoning Category to the University Texaco Station located at 6900 North University Drive;
specifically adjacent to the northwest corner of "McNab Plaza Plat", according to the Plat
thereof as recorded in Plat Book 91, Page 17 of the Public Records of Broward County, Florida;
Case No. 6-Z-97.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECIIQN 1' The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the Petition for a special exception to permit the operation of
a truck rental business as an accessory use in the B-3 Zoning Category to the University

Texaco Station located at 6900 North University Drive; specifically adjacent to the northwest
corner of "McNab Plaza Plat", according to the Plat thereof as recorded in Plat Book 91, Page
17 of the Public Records of Broward County, Florida; Case No. 6-Z-97, is HEREBY
APPROVED, subject to the following conditions:
1. Apply for and receive approvals of all appropriate Occupational Licenses and pay
all applicable fees for the operation of a truck rental business with a maximum of twenty (20)
trucks and twenty (20) trailers/hitches. The Occupational License fees will be calculated
pursuant to Section 12-37 of the City Code.
2. Apply for and receive approval of a Minor Revised Site Plan for the following:
a. The construction of an eight (8') foot high concrete block wall with a stucco
finish or precast concrete wall with a gray tone finish to complement existing
building color and an opaque metal or wood gate in lieu of the previously
approved fence.
b. To increase the parking area to allow a designated (paved and striped)
parking area for the proposed location of the commercial vehicles and trailer
hitches.
3. Apply for and receive approvals for all appropriate City permits (Engineering and
Building) and any other applicable permits required by any other jurisdictional agency.
4. Construct the wall, pave the parking area and install the required previously
approved landscape material.
5. Ensure the entire site conforms to the City's Code of Ordinances (i.e.,
landscaping, signage, maintenance of buildings and walls, etc...).
6. Call in all inspections and receive final approvals from all applicable

departments/agencies.
7. There shall be no storage of commercial vehicles visible from the abutting rights -
of -way (University Drive and McNab Road). In addition, there shall be no trucks or trailers
parked outside the walled area.
8. There shall be no outside storage of automobile parts or accessories.
9. There shall be no vehicle repair visible from the abutting rights -of -way in the area
where the commercial vehicles will be stored.
10. There shall be no more than a twenty-four (24') foot gate opening to the area
where the commercial vehicles will be stored. All of the gate openings will remain closed during
non -business hours.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part
or application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
