CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-97- C{ 7
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING CHANGE ORDER NO.2 AT
A COST OF $10,665 TO THE CONTRACT WITH ATLANTIC
COASTAL CONSTRUCTION ENTITLED "CONCESSION STAND"
FUNDED FROM THE PARKS AND RECREATION IMPACT FEES
FUND; AUTHORIZING THE APPROPRIATE CITY OFFICIALS
TO EXECUTE CHANGE ORDER NO.2 BETWEEN THE CITY OF
TAMARAC AND ATLANTIC COASTAL CONSTRUCTION;
PROVIDING FOR CONFLICTS; PROVIDING FOR
-SEVERABILITY: AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac awarded Bid Number 96-18 on December 11, 1996 to
Atlantic Coastal Construction for the demolition of an existing concession stand and the
construction of a new concession stand located at Tamarac Park in the amount of $119,226;
and
WHEREAS, prior to demolition and construction, additional work was identified to
address changes on the construction plans and Change Order Number 1 totaling $1,600 was
approved by the City Manager on January 31, 1997; and
WHEREAS, since that time, reassessment of the project has continued, as has the
demolition of the original concession stand, and due to additional problems discovered during
the reassessment and demolition period, additional changes to the construction plans are
necessary which have the effect of increasing the project cost; and
WHEREAS, the Director of Public Works and the City's consulting engineer,
Lakdas/Yohalem Engineering, concur that the additional work represented in Change Order
Number 2 is necessary and appropriate; and
WHEREAS, the cost of the extra work when presented by the contractor in Change

Order Number 2 exceeded the bid price of the contract by $10,665; and
WHEREAS, by City Code Sec. 6-156, all change orders over $10,000 must be pre -
approved by the City Commission; and
WHEREAS, funds are available in the Parks and Recreation Impact Fees Fund to fully
fund Change Order Number 2; and
WHEREAS, it is the recommendation of the Director of Public Works and the City
Manager that Change Order Number 2 be funded, accepted, and executed; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interest of the citizens and residents of the City of Tamarac to approve the acceptance and
execution of Change Order Number 2 to the contract for the concession stand to Atlantic
Coastal Construction at a cost of $10,665 funded from the Parks and Recreation Impact Fees
Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution upon adoption
hereof.
SECTION 2: Change Order No. 2 to the contract for the concession stand is hereby
approved and the appropriate City officials are authorized to execute Change Order Number 2
between the City of Tamarac and Atlantic Coastal Construction with funding from the Parks and
Recreation Impact Fees Fund, a copy of which is attached hereto as Exhibit "1 ".
SECTION 3: The City Manager or designee is authorized to make changes, close the
bid award including but not limited to making final payment and releasing bonds when the work

has been successfully completed within the terms and conditions of the contract and within the
bid price and Change Order Number 2.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any provision of this Resolution or the application thereof to any person
or circumstance is held invalid, such invalidity shall not affect other provisions or applications
of this Resolution that can be given effect without the invalid provision or application, and to this
end the provisions of this Resolution are declared to be severable.
SECTION 6: This Resolution shall become effective immediately upon its passage and
adoption.
